    I think there is not much harm here because the new law says any unused numbers in the previous year will be added to the 290,000 quota next year. So, even we don't get the numbers this year due to the per country limit, next year the size of the cake will be a lot larger.

    Couldn't help checking the forum as I dash around today.

    Zheng, isn't the point of the whole exercise to decrease the wait? You'll wait another year, during which time even more people will have joined the queue.

    If CIR is supposed to reduce backlogs and waiting times, this is not the way to do it.

    I don't know about you but a year is a long time in my life. Esp after waiting for so many years already. Making me wait yet another year when there is no need for me to wait is HARM by my definition.

    I used my AP twice in the last 4 months. Once at Long Beach Port on 12/21/08, and once at SFO on 3/27/09. Both times I went into secondary inspection and took about 20-30 minutes mostly because of others waiting before me.

    The officers were nice to me, they ask standard questions like location of my work, what I worked on and how long I was outside the country. I felt that if you have been here legally, have all your papers right it should be no problem.

    I have heard of people being denied entry, i think they are rumors. Most DHS officers are polite and after seeing some of the crooks who end up in secondary inspection I can see why they can loose their calm.

    As you know, you and your wife will be able to file your applications to adjust status to permanent residence in July 2007. You will need to prepare the following for your adjustment applications:
    1. Form I-485, Application to Adjust Status. You can find this Form on the Internet here:

    Please complete this form in draft format for you and your wife. Please write "unknown" instead of leaving questions unanswered.

    2. Form G-325, Biographic Information. You can find this Form on the Internet here:

    Please complete this form in draft format for you and your wife. Please write "unknown" instead of leaving questions unanswered.

    3. Photographs. You and your wife must each have six color photographs taken in accordance with the photo specifications that you will find here:

    4. Passports, Forms I-94 and Nonimmigrant Visa Documents. Please send us a copy of every page, including any blank pages, of each of your current and any prior passports.     5. Birth and Marriage Certificates. Please send us a copy of your and your wife�s birth certificates and of your marriage certificate. If your birth certificates do not contain your name, your date and place of birth, and both of your parents' names, you will probably have to get affidavits from parents or older family members to fill in the blanks. We will review your documents and let you know if affidavits will be needed.

    6. Medical Exams. You each must have a medical exam done by a CIS approved physician. It is my understanding that it is already becoming difficult to get appointments with these physicians. You can locate these physicians at this website:

    Immigration law requires that you submit proof of vaccinations with your applications for adjustment of status. You will find the vaccination sheet that the CIS physician must complete and enclose with your medicals here:

    Please take proof of your prior vaccinations to the medical exams. If you do not have proof of prior vaccinations, you will probably have to receive those vaccinations at this time.     7. Identification Documents. Please send us two color, slightly enlarged copies of your and your wife�s drivers licenses or other photo ID, with the photos as clear as possible.

    8. Employment Verification Letter. I will forward a format for this letter to your employer.

    Can anybody confirm the following
    1. If 325 is required for 485 filing for infant baby ( parents already haved filed 485)
    2. Is Affidavit of support needed for the baby? If so is it I-134 or 864?
    3. Ours is employment based AOS so assuming baby will also qualify for same? or will it come under Family based?

    Halooooo, we are waiting for more people to join a worthy cause. Remember this is one with a glimer of hope because lot of people are saying the Dream act might pass through.
    any immigration related bill favoring solely the legal class meets with oposition primarily from the proponents of CIR (ilegal immigrants) and also from the anti-immigration lobby.
    For Dreac act atleast the lobby of the ileal immigrants will support it. If we try to somehow push the clause of legal agedout kids into this bill, I dont think it will be opposed by many specifically.

    It will also pull out the children of legal group into a separate group (after 5 years of waiting) and therefore more visa numbers will become available for the adults.
    Please keep this thread on top so that it wins support of other IV members too. Hope many join the cause soon and we are able to communicate it to the core for guidance and help.

    My labor was approved Friday, 7/13/07 (online status) after 4 year wait. It took 2 weeks from the time we sent Recruitment Response. Hope to receive Certified notice from DOL by end of this week.

    You need to get certificate from US agency(anywhere in USA) that will prove that your earned degree/diploma is equivalent to B.S in Computer or Electrical engineering done in any USA. I have applied for EB2 with B.S + 5 years of experience and to prove B.S equivalency I send letter from agency as a proof. I dont remember agency name but there are plenty in and around USA. I will post name of the agencies in my next post.

    This is not really stopping any fraud. But diverting money to border security. If they really wanted to secure the border and wanted to stop fruad, they should have created a bill that imposes heavy fines on employers employing undocumented workers.

    It would have stopped not just illegal immigration and also secured the borders with the money. But no politician has a backbone to punish American Citizen employers employing illegal Hispanics. They cannot risk losing American citizen industry votes and money and Hispanic votes.

    They can do away with Desi body shops and Desis because they how divided desis are and fight with each other.

    I totally agree with this. The best possible way is allowing H1B to move free between companies and also allowing to file GC themselves rather than tying with a company.

    One thing some might be missing is, that there are lot of people in EB3 that are stuck who cannot even apply for I485 in H1. Some companies may even be forced to lay them off because of this limit. I agree with Pappu.

    I see a Fundamental Flaw in this. Here is the roughcut of my thoughts...


    How can you say that company having more than 50% H1Bs is doing fraud. How about companies having 45%.
    What if company has $9/hour or any minimum wage employee 50% and cut the pay for the rest of 50% H1B's.


    By restricting the companies to do H1Bs you are taking away the freedom from H1B candidates to change jobs. This in turn will make the candidate bound to the company which gives good scope for armtwisting directly impacting the salaries and taxes. By keeping the fee low you give freedom to H1B's let them compete in the open market. Let the companies pay competitive salaries to the candidates. This will help the citizens because they are all on the same salary levels and will avoid unfair competition.

    By taking away the freedom of legal immigrants and companies which hire them you are scaring them and making them spend less. This will have direct impact on consumer spending and thus the economy.

    Please be reminded job creation is not static is is elastic. The more you encourage companies to hire, the more they pay, more taxes can be collected and more spending will happen.

    lots and lots and lots of h-1b's getting denied. extensions, change of employer, 140's approved, etc. doesn't matter.

    just about all h-1b's getting rfe's and many, many are stuck in "background check". This is just a cop out by uscis where they are investigating companies use of h-1b's (this is reason for slowdown in processing times ) by vermont service center.

    uscis caught many companies in fraud - also consulates - many companies giving internal projects, etc. or fake purchase orders and getting caught by department of state which then forwards to U.S.

    ICE is making visits to consultants homes to verify where they are actually working and comparing to h-1b's.

    Next; investigations will start with greencards.

    I warned last year; that all the noise everyone was making about h-1b's and greencards was going to eventually get hit back by government agencies. Now; we are seeing this.

    Do you have a lawyer? what is his/her take on this? Did you use a company lawyer? If you are denied due to ability to pay issues, presumably everyone else during the same time period/similar jobs are to be denied too. Have you talked to anyone in your old co. who might have applied in the same time frame?

    We must lobby the Governor on this issue. She has expressed interest in both keeping jobs in Michigan and in the Innovation agenda. Repeatedly speaking about attracting IT jobs, Biosciences jobs, and alternative fuel technology etc. None of this is helpful to do that.
    She can push the legislation suggested by Terri Lynn Land at the very least.
    We must convince her that, targeting legal immigrants this way WILL cause them to leave the State even if not the Country. This will hurt Michigan.
    If this rule stands as is, I for one will be moving out within a year. My job prospects are good and frankly this would be too much to take. I suspect I will not be the only one doing so. Michigan's competitiveness will decline substantially.
    Michigan in my view can ill afford this. Michigan lost 30K people net last year. Housing is in the slump of slumps, coming in at the top for foreclosures and with price declines averaging the coastal markets, bearing in mind Michigan did not have the run up in home prices in the first place. This would be another nail in the coffin for Michigan's economy.
    I do feel she (the governor) is likely to take heed to our concerns. She has been rather quiet during this entire period on this issue.
    What do you guys think is the best way to get her attention about this issue?
