B1 people cannot apply GC but L1 people can apply. But many Indian companies like TCS,INfosys,Wipro are not applying gc but bringing people on L1

its a pain, why cant these folks at USCIS do there job when given the first time, it is sad that employment based folks see more tough rules where as the illegals and fraud marrige based, asylum, amnesty continue to flourish..

Before you criticize IV pls read all the posts written by us. Every now and then members demand updates. Well, the updates are on the homepage and the posts we write. There are media stories that have appeared recently. There are events we have been participating and there are action items like state chapters we want all members to participate.
Pls. ask yourself if you have signed up yet for the state chapters, contributed money and efforts, brought more members into IV... before you ask IV to answer you everytime you make demands. Update cannot be a date we can tell you when our bill is coming up. All our efforts are going to lead to that final result. It is the combined effort of every IV member that will produce results not just an effort of some small group of IV members. Every member of IV is important in the success of our organization.
We undestand that there is frustration and we too are frustrated due to retrogression and this is our motivation to work as a volunteer. We do ask members to contribute from time to time because it is needed in order to continue our struggle. Core members have not taken a single dollar on travel whenever they have travelled to DC or elsewhere. That itself is a testament to the personal dedication and sacrifice of some core members that have spent a lot of their savings till now. It was only in the recent MA event we were happy to hear invitation to stay in their places instead of hotel, from the IV membners that attended.
We try to update members and give them some realistic updates rather than speculations. Other lawyer websites and groups post some speculations to stir up their members and show that they are actively working. Pls. understand that we would like to give update when there is anything concrete to share. IV is on top of it and we are aggresively working and whenever we see even a small window of opportunity we jump on it and do whatever we can.
Pls continue to visit IV siteregularly so that you can see all the activites we are planning these days. After the MA event, this Thursday and Friday some core members are travelling to NJ to attend the event in Princeton. This weekend from 9 dec till 13 I will be in Indianapolis. So any local members that would like to interact with me for volunteer effort on the state chapter should contact me.

hmmm... sorry my bad. I did not made it clear to understand. When I said amended return, I meant didn't have to pay tax. I did all these process using help of a CPA. He showed my (TDS) account, but since the tax was already deducted by bank (my parents send me bank's letter) I did not have to again pay tax on that.
However, I did have to pay tax in case of account with no TDS.

We must try to get this provision in the bill.
I would also say "10 years in the US, have W2s, one should be eligible for Citizenship". Forget about he applied for GC or not, or how many times he got screwed up from the employer, as it happens.
And similarly for 5 years, a GC can be given, if you prove you were legal... W2.. etc..

If I deposit ~ 1000$ ( 49,000 Rs) everymonth in the NRO account at ICICI or HDFC. Total for the year would be 12K. Do I have to submit this form. From definition it seems that " If aggregate value of these accounts exceeds $ 10K at any time" means that total sum of accounts 1,2,3 should not exceed 10K at anytime inorder for someone to not file this.

Yes. If your aggregate sum exceeds $10000 in a calendar year, you need to file FBAR. This is not just for non-immigrants but for everybody including U.S citizens and GC holders.

I called USCIS nebraska two weeks back and I got the same response as mentioned by "bigboy007". I called them twice once in the morning and the next time in the evening..I got the same reply saying that "They are holding all the applications that came after June 25th and they are waiting for further instructions. They will assign receipt no only when they have enough visa numbers.
It did not make any sense..
I posted my feedback in another thread and i didn't get any response..
Then, i asked my friend to call uscis and ask for his status. My friend did not get the same response as me. They just checked and said they may not have received his application. So I thought the IO i spoke to may be wrong or might had outdated information.

Looks like we are the piggy bank for the politicians. Any time they want to fund something and they dont know where to look, tax the H1b holders. The regular and other add-on fees have been increasing for the past 10 years, and yet the quality of service has either remained the same or degraded.
I think it is time we let the news organizations know the game that is being played by the congress.
Also, reading most of the letters that were drafted to the congressmen, they sound very biased towards the benefit of the H1b holder. The congressmen are not affected by this law and hence will not support us if we use such language. What we need to do is speak their language, and state the loss the government will face. Use no mention of our problems, but speak in terms of only their problems that will arise. That way you get their full attention, and at the same time get your point across.

Hi All,
Quick question. I was reading on the forums someplace that the STEM provisions mean that the people with 3 yrs experience with an Advanced Degree are exempt from the quota. Though in the same post, it was highlighted that this was only true if the applicant had 3 yrs experience prior to the labor application. I have found contradictatory messages posted on other threads. Can somebody please clarify exactly what the STEM means please?
I tried wading thru the posts on various threads but could not come up with a definitive answer. So my applologies if this was already answered elsewhere :)
Also what is the possible impact of these bills for countries other than the heavily retrogressed countries such as India, China etc. Will the Worldwide EB3 dates become current?

I had a fun time after applying my I-131 that I wanted to expedite. USCIS conveniently lost my two pictures. The Local office had no clue. They could only see that it has been approved. Then, I waited for one month for the document to be sent them. Nothing came through.... They did not give me any RFE for my pics since it was already sent. They lost the pictures along the line somewhere...and the guys kept quiet... They did not even give any update to the local office about my case... The local office was helpless inspite of their good intentions... When push came to shove ...LAST resort.. Congressman's Office... They found out about this Mess in 4 hours and advised me to send them the pics to their Texas office to a particular individual... In 3 days my I-131 got approved..

It may be the reason March was selected for the DC Rally, despite the cold weather so members have complained about. ( Note : I did not select the date).
If CIR is coming up in Spring, we need to make our case - by showing good numbers -by the end of winter ; freezing or not. If we don't do that our issue is very highly to get lost in the Border security, employer verification and Legalization/Amnesty. If we finish the public show of strength - DC Rally and the Lobby Day in March, we can be ready to send Web-faxes, make phone calls etc. in Spring to push for our bills.
During our lobby day and DC Rally efforts, we should get lawmakers to understand our issues and number of people impacted (0.5 million at the least). Once majority of the lawmakers understand that we exist in large numbers, and are facing these problems, they will be more sympathetic when we make those last minute phone calls and faxes.
If we don't do the DC Rally and Lobby day successfully, chances are lower that they may not be sympathetic to us without understanding the issue and the large number of people impacted.
The clock has already started ticking. We have to act fast. If we do nothing, we will miss the boat once again. Will you help IV put Recapture and Visa increase on the upcoming CIR? If we don't, we all have to wait several more years for the relief.
