Hi,
new to this forum..need some help!
My LC was filed as PD 11/2003, Regular from MI.
I am still waiting for an update from BEC. I wish to know if there are regular applications getting processed and approved from dallas BEC.
Does it make sense at this time to continue on with my application or start a new PERM process? Are there any risks involved in the regular LC?

If you know your approx filing date you can ask DOL for the H1B 7 th year extension proof...If they have your application they are most likely to respond in a few days...For more information on how to send that request please go to the DOL.gov website and look around a bit....
If they respond then you would get the case number ...Donot ask for the same multiple times just once .....

The only benefit I see with these attorney / their associations is to get them to inform their clients who might be facing similar situation about this movement. However, unless monitary benefit is involved these guys rarely act. But it is worth trying.
I think contacting attorneys is actually a very good idea. Lets come up with a list of attorneys who we all can send emails to address this issue.
One good news for you guys ! I, myself, and couple other people in different forums have contacted our lawyers regarding this Dream Act. They have expressed that this bill's interpretation is left to USCIC but they hinted that they will most likely accept a legal aged out's application as well. If they don't then the methods I posted few days ago, can most likely be used to take advantage of the law. We will know when the bill is passed and when USCIC clarifies it for us. Till then, the best thing we can do is - assume the worst and fight for it !

cos for the sheer fact you are a temporary legal resident. It might not seem fair to you but that doesnt make it an idiotic response. It goes back to the fairness of temporary legal residents (H1B holders) paying SS and medicare taxes. It goes back to the fairness of not being eligible for unemployment benefits when you lose your job.
I agree for this proposal completely. Why should people both illegal and non working temporary dependents be subsidized by my tax dollars.
This is the first time I disagree with you. When you pay tax, either you pay as an individual or jointly depending on your condition. Govt tax you less if you have dependents and more if you are single. Even if you have single person earning in the family but if you have multiple dependents, you are eligible for tax discounts (or in this case tax rebate check). There is no question of H4 comes here as long as you have one member in the family earning and you are his/her dependent.

Thanks for the sharing the data. But the data IV got from USCIS looks to be completely false. Did IV pay for this data, if so then please ask for the refund. Any way because of IV the DATA is in public domain.

You are right: USA is much better than India but, it is NOT our country and we dont have any place in society except being used to make this country stronger in return for measly benefits (slightly higher than what you would make in India). How does your life change after GC? You will probably be making a little bit more but it doesnt solve your life problems. Some other worries will start.
Very first think comes to my mind is why are you guys coming to US if you feel India is better. Have you seen anyone from US going to India and taking up jobs. Again dont get me some exceptions from here and there.

I am a Software Engineer , with Masters in Computer Science in EB2 , but EB2 applied with BS + 5Yrs exp, my company didn't want to show Masters as an requirement, since not all SEs have Masters. Will my case also come under STEM ? Anyone else in the same situation ?:confused:

There may be more to this than meets the eye. Michigan has been reeling under unemployment troubles for quite a while now. Getting foreigners to leave the state is one way of increasing jobs for citizens. I would not be surprised if some lawmaker there came up with this bright idea of achieving this via DLs.

I think this needs to be a thread of its own and ideas from this need to go into the CIR bill.
With all focus on provisions that need to get into the CIR bill, we are all forgetting the most important thing, how will USCIS deal with it?
From waiting for our dates to be current, we will now all have current dates but will still be waiting. There needs to be a solution to make sure the agency can deal with the impact of CIR else i really don't see reform happening.
Its all about the execution - thats where the result of reform is seem, if execution is left out, all that was accomplished is politicians have talking points, we have no relief

Ask your new company attorney to send a request to BEC for the case status. And ask your ex-employer not to withdraw the case from BEC at least. They owe you that favor for the work done in past four years. Or you can send an e-mail yourself to BEC.

I am finding it extremely difficult not to be pessimistic but I think we are screwed either way (i.e. even if your 140 has been filed and approved before May 21, 07): PDs will start to retroegress back after this summer's temporary bump:
If the bill passes it will soon be excarbated by the 90,000 limitation (meaning only 90k of those 5/21/07 ppl will get 485s each year on a FIFO base -- the ppl who filed closer to 5/21/07 will get 485s 5 years later). Also, starting next year a lot of consulting companies will start/prepare for restructuring to meet the >50% on H1 dependancy for <50 ppl (Durbin-Grassy clause). This could mean a lot of consultants will be moved around among the parent company's subsidiaries which in turn will force those unlucky consultants to re-file... totally rendering the May 21, 07 advantage void. And even if that doesn't do it, the fact that H1 consulting will be banned will send most ppl packing home.
If the bill does not pass, current retrogression + namecheck backlog scenario plays out (i.e. 5-8 years for most ppl)... unless SKIL is slipped in as an ammendment to an appropriations bill - but do you really believe that's gonna happen? And even then this ponts-based B.S. could rememrge post-09 elections.
I don't know, maybe I am just rambling here. But I am just frustrated as hell as I see all my GC investments in terms of time, energy and money going down the drain. Does anybody see a way out of this?
