I too feel that USCIS can not assign a visa to an application in wait until August 1st 2008. But again we are taking about USCIS and anything is possible. Even if it starts on August 1st, please do not keep your hopes high as August 1st is a Friday, and USCIS officers will take it easy on that day. I guess, the real action will start from Monday August 3rd.
However, what if we realize that not many approvals are coming through after August 3rd. I was wondering if we shall brainstorm on such scenario, and decide what should be our course of action in such case?

As you might know our community is facing the following situation
1) 140,000 total numbers per year worldwide vs. 1 million applicants and their families waiting in the line. Some from 2001 and may be before that ! It's common sense that it will take at least 6 years to clear just the current backlog, if there were no per country quotas.
2) Per country quotas of 7% exacerbate the situation to applicants from high-demand countries like India, China, Mexico and Phillipines. Approximately just 10,000 visa numbers are available to India where as it's estimated that at least 44% of the applicants may be from India ( based on USCIS statistics of around 44% of H1bs being granted to India every year). As spouse and children are counted, considering 4 members per family, on an average only 2500 Indian applicants get Green cards in a year. As you can see the numbers are dismal.
Meaning, if you are from India, China, Mexico or Phillipines, you may have to wait 10 to 12 years to get your Green Card or more
3) Between USCIS and DOS (Department of State that runs the Visa bulletin) a number visas get wasted every year, worsening the already BAD situation. For instance between 1994 and now 218,000 GCs were wasted by USCIS. ]If the trend continues, it may well mean 15+ years for India/China/Mexico/Phillipines
Now I know the problems ! What's the solution?
1) Increase worldwide EB GC numbers to 290,000 per year or more
2) Eliminate country quotas or increase them to rational levels such as 10%-15%
3) Exempt spouses and children ( dependents) from the GC quota (this will effectively double the quota)
4) Since USCIS inefficiency cannot be fixed by us, implement a 'Rollover' of unused visas to the next year(s)
5) Recapture the unused number of 218,000 visas . This may mean you'll get GC or at least see PDs jump forward by a few years (reducing your wait time tremendously)
I know the solution. But, pray, who'll bell the cat?
Fortunately for us, there is an organization that is working 100% exclusively for our cause. Immigration Voice ( http://www.immigrationvoice.org) a non-profit organization formed by EB immigrants to work for our cause. Starting with barely 200 members when it was formed in 2005, now it boasts a membership of 25,000 members and around 30 state chapters serving every US state with significant EB immigrant population.
Immigration Voice ( fondly called IV by it's members) lobbies the US Congress and USCIS to provide relief to us. They have hired a high-profile lobbying firm Patton Bloggs to do lobbying for our cause. In addition they also do grassroots lobbying at State chapter levels with the local Congressmen.
What's Lobbying? Is it Legal for non-citizens ?
Lobbying or 'Advocacy' is the act of Petitoning the US Government to redress issues faced by any person living in the United States. It's a right guaranteed by US Constitution (First Amendment) to every person living in the United States, citizen or not.
Just like you can argue your own case in a court of law (if you choose to do it), you can also lobby or petition the US Government on your own. If you chose so, you can also hire a professional lobbying firm to do it for you, just like you can hire a lawyer to represent you in the court. Both are legally guaranteed rights. It's common sense that a professional does a better job - be it an experienced lawyer or a lobbying firm. Getting professional help greatly increases the chances of success.
Boy, It must be really COSTLY to hire those DC Lobbyists?
You are right. They are costly, but IV has been managing to keep the effort funded through sacrifices of it's Leadership (IV Core group), voluntary contributions from it's members, local fundraising campaigns by State chapters and selling IV-branded merchandise.
Contributions are what keeps IV ticking and working for you.
I understand IV has been doing all this? Have they had any success so far? I don't want to invest in a campaign destined for failure !
IVs success record so far in the order of signifance to EB community
1) July Visa bulletin Reversal - Due to flip-flop by USCIS 350,000 applicants were denied the promised ability to file I-485 in July 2007. Chances are you might have been one of them ! We faced the grim prospect of losing thousands of dollars and countless hours of effort .
IV conducted 'Flower Campaign', i.e sending Flowers to USCIS director Emilio Ganzales to request redressal of this unfair decision (in the spirit of passive resistance movement of Mahatma Gandhi). It provided wide media coverage to the issue nationwide.
IV through it's California chapter, conducted the successful 'San Jose Rally' to highlight the isue to the Congressmen through the media. It also took an active role in petitioning San Jose Congresswoman Rep. Zoe Lofgren to help fix the issue. As it turns out Madame Lofgren, who also happens to be the Chairwoman of House sub-commitee on Immigration, was instrumental in forcing USCIS to rescind (revert) it's prior unjust decision ! An IV effort that paid rich dividends.
IV actively particpated in discussions with USCIS in deciding the modality of reversing the decision, and was the first group to announce it, even before USCIS and US Department of State !
IV Walked the Talk and helped the EB Community immensely
3) Lobbying USCIS for administrative reforms - IV participated in the FBI Namecheck backlog reduction meeting ( when it approached alarming figures with some waiting for 1-3 years), where USCIS announced increased FBI funding to expedite the checks and other process improvements to increase efficiency.
IV also successfully lobbied USCIS to increase validity of EAD/AP to 2 years from the previous validity period of 1 year. It has resulted in a saving of at least $1400 per year for every EB immigrant family that has filed I-485
IV continues to lobby USCIS to relax USCIS strict determination of 'same and similar jobs' (defined by AC21 law) to provide job mobility and promotions

This is probably the worst cheer-leading I've known. I get it that you are all excited and anxious to get stuff done but insulting people and calling them idiots makes you look a fcuking prick. Keep your suggestions to yourself and don't tell me how I need to raise my kids.
If this is the kind of diplomacy we (as in you all) are going to show in DC then we (as in you all) are doing more damage than good to the EB community. Your pompous cheer-leading act ain't gonna work with them DC diplomats. So I sure hope the IV leadership makes sure of your absence among important meetings.

By participate I mean being in DC for the event or donating airmiles or donating funds for the event.
5. You love getting disappointed by looking at Visa bulletins every month.
It is a way of life for you. You eagerly wait for the bulletin and get disappointed when it is released. You love the suffering this creates and there is nothing you would do to get rid if this scenario. It is just too important for you.

You absolutely love to track how people who started their process almost a decade ago are getting their GC now. You are fascinated by how each year, the wait time increases exponentially.
You love to either predict or read prediction threads. You can't do without the rush that you get when you predict or analyze a prediction using your excellent analytical skills, even though important and necessary factors are missing for the prediction to come true.
The joy of predictions..ah...what will you do if you get your GC?
3. You love the fight.
Come on. Admit it. You the love the fight between EB2 vs Eb3 vs I vs C vs legal vs illegal etc..You love to fight or read about it or moderate it. Who wants a GC faster when you can indulge in the joy of being in a hostile environment. The negative energy, stupidity, arrogance and the ignorance of the members fighting is sheer pleasure that you cannot live without.

The classic age old laziness. What joy is there in getting you GC sooner? You may live a free life without any worries. The sheer ecstasy of being being worried about your future, that your laziness ensures you get, cannot be compared with anything else you experience.
The joy of inaction that ensures getting your GC a few years or possibly decades later or not all is in no way comparable to the pain of getting your GC soon by working on advocacy to fix your issues.

Who doesn't? The ultimate joy in the world. The state of uncertainty. You just cannot compare anything else you would want in this world than for the joy of being in this limbo.
The excitement that envelopes you when you think:
a. of whether you will get your GC ever or
b. of your uncertain future for you and your family or
c. that you will get your GC in a decade or not at all due to anti-immigrant measures that may pop up soon
is nothing to sneeze at.
You just love the limbo you and your family are in. Who would want to let go of this wonderful state and have a certain future. come on.....

I guess a couple people beat me by a few days. I came to the US on Aug 6, 1994. After three degrees, I started my labor cert process in November 2001. With the same employer through out this time (except for small stint after Hurricane Katrina).

Do you have an old AP that is valid till Sept 19,2010. If then you are good. The IO has done it right. If you apply for renewal, then they will extend from the expiry of the old one. This was the case for me last 3 times, but this time, the approved on July 11 and made it valid one year from approval date and I lost couple months due to this.

I talked to my attorney this morning and we are going to file a separate case in EB-2. I have seen many people cutting lines labor substitution, illegals getting married/cutting a deal to US citizen just to get green cards and after 8 years, I think I can not just wait and think that someday something good would happen. It will cost me 5000-7000 USD to re-file my entire green card process but I thik it is more painful to just watch this non sense happening around me and not do anything about it.

New job and re-filed under PERM (EB3...thanks to lawyer, B.Tech from IIT + 5 years of exp)

I understand. I'm also in similar situation. Filing another case in EB2 is no doubt best thing to do. Money is not the main factor. But I'm afraid new labor approval (considering PERM delay), I-140 approval and refile (with older PD) may take close to two years (considering current processing time). Also if many of us are doing this then another new rule may be introduced to "block" these cases as they will notice sudden increase of EB2!! Another thing is we're already in AOS pending state. I'm not sure what will be the impact of doing this now. I hope you've discussed all these with your lawyer. I told my lawyer about it and he came up with all negative sides of EB3 to EB2 PD transfer. But I'm still thinking to go for it.

I just went to German consulate at San Francisco and applied for a ATV for my wife. My wife is traveling to India on last week of May. The lady at the counter told that the rules have changed and if you are using AP you need a ATV. She also mentioned that it will take 3-4 days for issuing the visa. Thanks to OP for bringing this to attention.
Did she mean that we need ATV while coming back to USA. I do not have time now to apply from here. I am thinking of going back there and applying in India before coming back.

If it is a University granted diploma with a 3 year BTech then it is officially equal to US bachelors, absolutely and should be. (In this case, it is not even required to emphasize that it was a 3 year course)

What I was emphasizing is a 3 year degree compounded with aptech�s and niit�s so called diplomas that are evaluated to US bachelor�s degrees.
Also, on the other hand a 3 year degree with 3 year PG degree should only evaluate to US bachelors not masters. These are some of the things that have been nicely exploited by some people. For a clear understanding on this go by credit hours and courses included.
In the tech world especially in computers, educational degree is a secondary thing when compared to experience and who can do the job of programming. At the same time, there are few places in this world where degree�s matter and one of them is with GC.
