Look at the actual text of the act to see who the select group of students are:
"SEC. 4. CANCELLATION OF REMOVAL AND ADJUSTMENT OF STATUS OF CERTAIN LONG-TERM RESIDENTS WHO ENTERED THE UNITED STATES AS CHILDREN.
(a) Special Rule for Certain Long-Term Residents Who Entered the United States as Children-

Now what does that mean?? They would become what legal kids are now? the only difference being; legal kids age out and ilegal kids never age out.
The problem we face is: This new adjustment of status applications will be considered independent, unlike those of our kids who are linked to the parents application.

Or are they by some freak chnace thinking about legal immigrants, point system etc. I dont think so. I guess now he is mixed up legal and illegal. One more twist to the saga. I guess they just want to tire us and then drive us out ?

It really comes down to what you can get where and at what price. Take it for what it is worth, none of this is India bashing or US bashing. In my mind:
In US you can get the following easily:
1. A safe place to live. You don't have to worry so much about thefts. Crime rates are really low in most places compared to India. If you own a good house/car in India you are an easy target for theft.
2. A comfortable family life: Unless you work for a bad boss/company or are a workaholic yourself, you get to leave at 5.30 everyday. Not so in India.
3. Access to goods: access to all the cars/electronics/stuff is a lot easier in US. There are few/no stores like circuitcity/bestbuy etc.
Overall, US offers a very good life from a material stand point. You can get all the good stuff in a safe and healthy environment.
In India you can get the following easily:
1. A place where you feel at home: No matter what you do there is always a subtle feeling of being an outsider in US. In India you don't need to explain anything (appearance/custom/religion/...) to anybody. Everthing is obvious to everyone.
2. A large extended family: No matter what you do, you can not have that here. Family bonds are always stronger than friendship.
3. Long term friendships: Since you tend to live in the same city in India for a long time you tend to build long term friendships.
But even with the above advantage, I think going back is a lot harder for ppl who have been stuck in the GC queue for one or more of the following reasons:
1. You have kids who were born here and may have trouble adjusting.
2. You have gotten used to simple things like running water/uninterrupted electricity/security/etc...
3. You have been stuck in the same job for years and can't find a suitable position in India.
4. You are afriad of uprooting everything.
If you are indeed planning to go take baby steps. Work slowly but surely on issues like career move/housing/schooling etc...

I efilled mine and send documents on 10/21 and i got approved yesterday though i not yet recieved the same.
Looks like those who efiled are getting approved much faster. They sat on it for nearly a month and now my case shows it was received on the 19th of Oct, but hasn't been updated since 10/22 and is still "Initial Review". whereas yours was received after mine and has been approved much faster. I just hope I get in the next 3 weeks, i am thinking of getting a Infopass and head to the local USCIS office in the coming week. Could someone please advise, I really need to be in India at the end of this month. Is it advisable to travel without the AP and have my friend mail them to me by courier to my address in India?

Guys, let's use Thanksgiving to rejuvenate our strength. I don't know which one is worse;you turn around and we have CIR which mixes our issues which the even more controversial illegal alien crowd. Now many people are saying that piecemeal bills such as the DREAM act has more chances to go through. That would probably be a blow to our community.
I will just enjoy Thanksgiving and think next week on what to do.
It is the H1B section of the SKIL bill that some Dems and many Repubs are afraid of touching --- especially, those Dems who got re-elected with a hard line on immigration. If we can somehow separate the two and push for only the EB part of the SKIL bill, we may be in better shape. And yet for the industrial lobby, the H1Bs form the meat.

I have one PD 01-04/EB3/RIR stuck in DBEC. My company is ready to file a new labor in PERM EB2 at no cost. Is it okay to go ahead with PERM when RIR is still going on? I woud like to keep my PD if I can.
If my PERM application is approved .. my RIR labor application will still be valid or will get rejected ?
Quick response/advise would be very helpful.

You will lose your RIR automatically when you apply for PERM with same company and same job description. If everything is same, they should in theory retain your old PD but it is not guaranteed. So, there is some risk associated with this process. Alternatively, you can continue to wait for a few more months for your RIR to come through. BECs have been chruning our RIRs at a fairly decent rate. They have an oct 2007 deadline to meet with all BEC cases.

This funny business of turning away non-immigrant workers at airports/consulates must be tackled head on by IV. This is outrageous behavior on the part of immigration officials. If a person has valid visa then it automatically implies that all the concerns of DOL have been addressed. Immigration officials have no business poking there nose in it.
We must draw a line here. Let's tell CIS is that we can not take the crap any further. Such kind of behavior on their part plays havoc with temporary workers life. Just imagine what happens when a family is split in half due to the denial of reentry.
Yes, something has to be done from IV to tackle such kind if issues..

I'm obviously NOT a core member, so I do NOT speak for IV.
However, it is clear that for several years now, any bill which alleviates the situation in any way is tough to pass, and needs absolutely everyone to pitch in. In this situation, it is wishful thinking that a campaign for any bill which targets a specific section of the legal immigrant community will ever be introduced, let alone pass.
In any case, IV's goals are more broad based, and the attempt is to improve the situation for Everyone, EB1 to EB3. I'm EB3-I, priority date early 2003 myself, so I can fully understand the frustration, but we have to deal with the facts and proceed pragmatically.
Tearing ourselves apart with sub-agendas and narrowly focussed campaigns is NOT going to help!!

If it turns out your 2008 income was lower than in 2007 and you should have gotten a lower rebate, you get to keep the difference.
As I read, if you owe taxes for 2008 in 2009, the rebate check would not piggy back on to the owed taxes. So If person X decides to change his normal withholding (which gets him the avg refund of 2600) in such a way that he owes taxes, he essentially has gotten away with the rebate check.

All i can say is this is bad for Michigan.
What a stupid/sluggish thinking. Their auto industry is already in great trouble. Now, they dont want anybody on temp visa to buy a car. Are they thinking backwards? Even 5 years kid can tell this is bad for their economy.
1) F1's will not be interested to go there. Coz they cannot drive to earn their bread. University's will be effecyed badly.
2) H1's will not take a job where they cannot drive.
It could be a winner for Michigan average Joe.
If there is a shortage of H1s there, our 'Joe six pack' will get the job and he will stop going to flip burgers. And the universities will be filled with locals and Michigan will become self sufficient.

I came to US through atlanta airport on decmeber 2008 The officer at the POE asked me my documents which i showed him (AP as well as I-7.. h1b renewal)them.He asked me why did you apply for green card I told him because i am eligible to apply for green card within 6 years i applied. he asked me again why did you apply for green card I told him i am in US for more than 7 years and so i have friends etc,, so i applied for green card. He again asked me why did you apply for green card. I told him i love his country so i applied for green card. He asked that means you don't like India I told him thats not right. He told me go to the baggage area and collect your bag. After collecting my bag i went to the exit door where the person told me to go to a separate room where they look for AP. They don't consider H1B if one has a AP.

Good analysis. What happened in 2007 CIR bill? Initially there were good provisions for EB legal but but at the end it was terribly screwed up (introduced unrealistic point system) and all EB community was praying to kill this bill.
No CIR will pass with mass amnesty to 13 millions illegals.
IV opposed 2007 bill, the point system and all other bad provisions that bill.
But again, if at all there is any possibility of stripping of any EB provisions, it will be because some of the members here don't want to understand that beating down on the undocumented will only hurt our provisions. We have consistently requested all members to not beat down on the undocumented. But we see that some members continue to post against the undocumented. Lets try to be for something instead of against someone. If we continue down this dangerous road of beating down on the undocumented then there is every chance of a repeat of 2007. So be ready to blame yourself if you plan on the undocumented bashing spree.
It takes only one drop of mud to contaminate a clean jar of water. Likewise, it matters what each one of us say or do. There is no need to get presumptuous even before the process has started. We have all waited for the Congress to take up our provisions in some bill. After such a long wait, it will be extremely unwise to shoot down the immigration bill process at the first step.
In the end we all have to decided what is more important you. Do you oppose undocumented more than you support EB provisions? Its an individual choice for each one of us to make. If the answer is yes, then please do not be part of IV effort because you are better suited for Numbersusa. If the answer is no, then please help yourself to gather support for the CIR. With the current political dynamics, there will be no EB only bill in a foreseeable future. CIR will be the only vehicle to carry our provisions. I cannot emphasis more on how important it is not to beat down on the undocumented. If you want to continue to beat down on IV, please do not use IV platform for that purpose.

what he means is that your adult life has been shaped in the US, and that makes a huge difference. how you live and work is quite dramatically different, and how you deal with people and what you expect from them is ...well...a different world....

I think next week is crucial in understanding where this tornado will go.
a. It could be that the yesterdays show was for cameras and as always to fool Hispanic community. No one will talk about the draft anymore and dies of it's slow death. Already, it's off the headlines today on some networks.

b. It could be a sincere and genuine effort from Democrats caring for Hispanic and immigrant community.Not so much worrying about their own senate seats in November.

My status just changed this morning from CPO to PDA, and this is my first PDA. I guess they are mailing something to me.
From my understanding, somebody gets their card together with the letter, some others get them separately .Even the USCIS staff don't know how this happens. I think it is just random.
in all my years of renewing EAD i have not seen a single instance (atleast with me) where USCIS sent a separate approval letters other than those with card. Some got second cpo before getting pda , pda necessarily means they sent out the card.
