I was really afraid to ask this question as people here don't like different type of question, then also i thought to take a chance.
If you are a working couple with kids, you know the value of having a maid here.
So I am planning to get a maid from india.
Can she apply for b1 visa (with sponsorship letter from me).
Can I specify the actual reason(help with child care) for visa or I just have to mention "visiting purpose"??
I am fine with her traveling to india every 6 months.
I came here on H1 and working on EAD(dependent with 485 pending).

There was a thread somewhere, where the IV member wanted to import a bitch from India. Check it out. I guess the visa rules are the same. You need a large container though.

A friend of mine did his B.Com from Vivekananda College in MAdras and NIIT and then gave his GRE and TOEFL. He applied for Master's in the advertising media field and got admission in UFL and Ithaca College, UFl later withdrew the admission saying he does not qualify but he managed to come to Ithaca College and finish his MS. Ithaca college is a low grade college, so there will be a lot of places like that you can try. You must target those forums on the net and contact respective department in unioversities. You can write to the Department heads saying you are interested ..... a lot of them will deal these things on a case to case basis. No rules are hard and fast. So I will say you do have chances.

Is your current salary less than the proferred salary in the LC? If yes, I am not sure how to answer your question. I don't think this should be an issue as the ability to pay has been established by the approval of I140. However, you should try to get this answer from your lawyer.

I am going to get the Emp. Letter stating availability of job, with the salary indicated in the labor/I-140, with the "no less than xyz per annum".
For the I-134 or I-864 (still trying to decide), I will get the letter from the employer stating my current salary.
Please let me know if you see a problem with this. I don't have a lawyer, hence the questions - thanks a alot.

Immigration was not a concern in the midterm poll. The GOP Congress would never look into this issue in Lame duck. This will be passed on to the next congress. People believing that this is the only time for the GOP to sign off a bill that they like with all enforcements is slim.
Until President Bush pushes this issue to be definitly pass bill we cannot expect something this year or in the comming years.

I agree with you qplearn. This is what I learnt by comparing H1Bs and citizens.
1. H1Bs are willing to relocate.
2. H1Bs are more flexible in terms of schedules. A citizen will get out of the office at 5.00pm regardless of what. Also they dont like oncalls or after hours or whatever u name it unless they are paid separately for it. Where as H1Bs are not.
3. I felt like H1Bs are more eager to learn new skills. ( Probably due to the underlying insecurity).
4. Also H1Bs are mostly younger. When I first came to US I was 24. Most of the citizen colleagus were 35+( programming team). There wasn't anyone below 30. For most of the people as age goes up, flexibiliy and efficiency come down.
And this is capitalism. Money will find a way. If they dont get H1B they will outsource it for sure. I think we don't need to worry much about H1Bs. Rather we worry about EBs. My biggest fear is that due to corporate pressure if they increase only H1Bs, our fate will be even darker.

Now that everyone is current, I want to file AOS again as his derivative in EB2. (I have no hopes on EB3)
There is a question in I-485 (have you ever applied for AOS before , give date, filing location and final disposition")
Could anyone help me writing the reasonable answer please?

IV or its members are not against anybody. All we are trying to do is, to reduce our delays of getting Greencard. All the groups know that EB-3 is in the worst shape and still the cases of 2001 are being processed. Situation is really Frustrating. I hope we can find out some solution to reduce the delay.

Good to see an update from IV with regards to pending 485 cases /FOIA request initiated by IV members / IV. But the huge difference in data made available to public via USCIS Home Page (http://www.uscis.gov) to the one provided via FOIA request is disappointing, though IV has paid for this per my understanding. Since USCIS updated, the data provided to IV is correct, though the one published in their website is different, it is really confusing. Just like the USCIS processing of cases. The data in USCIS website is as of Aug 25, When did IV get the FOIA request provided to them. Is it around the same time, thou the difference is so huge.
Think we probably have to wait until next updates are posted to USCIS website or if IV gets some updates, that is shared in general forums.

Guys, I would like to visit India later this month for a cousin's wedding (booked tickets to India on 28th of this month). Had neglected to file AP extension earlier and than my lawyer screwed up and delayed it by a month.... Application was mailed on the 16th Oct and received on the 19th (receipt date is 19th Oct). Based on how its worked out for most of you I should be getting my AP soon, but who knows....just keeping my fingers crossed.
Any other path I could pursue to expediate the process? Really need to be in India end of this month...though it cannot really be classified as an emergency.
