    Hi fundo14,

    I saw you post regarding the case being transffered to Des Moines Iowa. My case has the exact same update as of March 19 2008. Its been like that since then. Yesterday, I spoke with an IO from NSC and she told me that my case is picked up for Extended processing. I am not sure what it means!!! I have applied for my EAD and AP renewals and asked her about the status of those in light of the pending additional processing of my I485. She told me that my EAD and AP renewals also would be held up until the additional processing is completed. On pushing again, she told me that in case my EAD is due for more than 90 days, i would have to walkin to a local center and get an interim EAD. I am inferring that it may be a pending interview call. My attroney also said the same thing. I dont have any criminal background, didnot do anything illegal in terms of immigration like being out of status or on bench.. So my best guess would be that its a pending interview. I had taken a infopass appnt last month and the officer in my local office also told me that my ead and ap renewal would not be approved until additional inquiry is completed. I am quite concerned and confused from last month as to what is wrong with my application to warrant a refusal of my EAD.

    Lately, I have been observing several people have their cases transferred to Des Moines Iowa and interestingly around the 19th of the month. I am guessing USCIS moves cases around the 19th to the local offices

    Thanks guyz !!

    I did spoke with Sheila Murthy Lawyers on chances of maintaining GC processing and Consular processing.

    My firm is OK with my long Leave of Absence...Only thing that threw spanner in the wheel was comment from Sheila Murthy firm's advise.

    Per them, to renew AP and EAD, I need to be phsically back in states and also stay in States for the duration of approval i.e. if it takes 3 months for renewal of AP and EAD, then I need to be in States for that duration.

    I asked them what if I can apply 5months in advance, from Outside US and someone can fedex it to me. Max I can come back for few days.
    .. Per them this will not work...

    What do you guyz say ?

    Important Note - I think the fine print of this bill was discussed a few days/weeks ago and the visas will actually be going to recent grads (within the past 5 years). It will in now way help the EB2's and EB3's who are waiting in line forever.

    I think this is the right time to work on modifying the text of this bill. If not these GC's will be given away to people who haven't even applied yet !

    The D70 is said to be of better build quality than the digital Rebel. The image quality, for all practical intents and purposes, should be considered so close that it's not a concern in choosing one vs. the other. Of course, you pay $200 - $300 more for the D70, and you buy into the Nikon system (which some people have already written off as dead and jumped over to Canon), so that might be a disadvantage, depending on how you view the current camera market. Note that I own neither yet, shoot with a film SLR, but would buy a D70 if I could afford one... so take these statements with a few grains of salt. ;)

    Also, consider that you'll be wanting large memory cards very quickly, if you don't have some already; if that must be factored into the budget, then the DRebel is the only one that fits within the limit you stated.

    Today I called. Automated phone system didn't provided me option 3 and 4 after "keep listening to updates on case" step. It's said invalid option. Second try again I think used 3,3,1 which takes me level 1 CC. Luckily level 1 guy asked few questions(last name, first name, receipt#, dob, A#, etc, etc.) and let me go to Level-2. Level-2 again asked me for same info (last name, first name, A#, etc, etc.) but told me "call after March 10th 2008". So not much success. What a wastage of time. :(

    this is called inter filing.

    you please call USCIS and follow up on your case,let me see what they say.

    I started the US immigration in 2006, PD-September 2006, by CP, EB3ROW. DS230 renewed 3 times since then... a couple of months ago I applied to Canadian PR, now I am waiting for my interview date. So I have two processes parallel - US GC & Canadian PR. My question is : How these two immigrations can jeopardise each other? :confused:
    Logicaly I will attend the Canadian interview first, will they ask me about US immigration? should I tell the truth? Will they deny the PR because of the GC process?
    Presume that I have successfuly done with canadians and have landed in Canada with my PR in 8-10 months from now, and suddenly, I,ve got an invitation to the GC interview... :eek: Does the fact that I have a Can. PR will kill my future GC and at the interview the will deny and cancell my case? :confused: Or The interview will be successful and I will have my GC, but somewere in the future there is a point where I should refuse one - GC or PR? :confused:
    I should mention that the GC is the choise No1 , and PR is a plan "B"...
    I believe that my situation is not unique, but now I am out side the US and in my country it is difficult to find a competent lawer. So I hope that somebody from this forum could answer my questions.
    Appreciate all useful answers and ancillary information. :):)

    chisinau, in my personal experience, applying to US GC is not viewed favourably by Canadian authorities. When we tried to land in Canada, the immigration officer specifically asked us if we had applied for US GC. Also, be sure that you do not insinuate to the Canadian authorities that your first choice is to stay in the US, but make all efforts to show that you will be moving to Canada permanently as soon as your PR is granted. The Canadians do not like granting PR to people who are going to use it as a backup for their GC process.

    Way to goooooooooooooooooooooooo....

    I am on H-1B and wife on H-4. We did not get our stimulus payment last year since she does not have SSN.

    For people who did not receive stimulus payment last year can claim it this year. So for people like me whose wives are on ITIN, can get $600 back this year or so I think. The way to do this can be:

    First file Married filing separately, claim $600 credit and then amend it to file married filing jointly. IRS will not ask stimulus back. Let me know your thoughts on this idea. I wish I could get $1200 but hey even $600 is better than nothing.

    Any thoughts??

    Please read......."IMHO".................my opinion, not anyone's else's and are not we all entitled to opinions? Certain I am sure there are several scenarios that might favor one mfgr over the other........."what if" situations abound.
    It's not the "IMHO" or anything... we certainly all are entitled to opinions - "Canon is better than Nikon" "Nikon is better than Canon" "Contax/Carl Zeiss is better than either" "What are you thinking, Minolta has fine glass too" etc. But it is just the "far superior" thing that got me going, because it simply isn't true, while the other statements certainly do have parts of truth to them. I guess some people do treat camera manufactureres with the same kind of "fanboy-ishness" that geeks do to Intel or AMD. ;)

    10/31/2008: PERM Filing Alert for IT Occupations and Certain Professional Occupations

    When the permanent labor certification system used DOT system, there were a number of IT occupations that fell under SVP 8. When the DOL changed the permanent labor certification system, it abandoned DOT system which focused on SVP concept. Since then OFLC has been using O*Net Job Zone concept and applied Job Zone 4 as equivalent to SVP 7 that can require from two years to maximum four years of preparation time (education, training, and experience). The Job Zone 5 is practically equivalent to SVP 8 that can require from four years to 10 years of preparation time (education, training, and experience). During the DOT era which ended on March 27, 2005, some IT occupations fell under SVP 7 and some IT occupations fell under SVP 8. Accordingly, EB-2 labor certifications for IT occupations were filed and approved when the occupations fell under SVP 8. Software Engineer, DBA, Science/Engineering Application Programmer, etc. illustrate these IT occupations.
    When the O*Net Job Zones replaced the DOT, the system downgraded all the IT occupations into Job Zone 4 except Computer Information and System Manager occupation (IT Manager) which remained at Job Zone 5. Since all the IT occupations other than IT manager belonged to the Job Zone 4, had the DOL strictly adhered to Job Zone system as they interpreted, any applications for IT occupations that required more than a bachelor's degree plus two years of experience should have faced a business necessity challenge and denials in most of such applications. However, from March 28, 2005 until June 2007, the DOL de facto adhered to their previous practice under the DOT system and most of the EB-2 IT occupations such as Software Engineer, DBA, etc., which belonged to SVP 8 under DOT system, have been approved without much challenge.
    The landscape changed beginning from July 2007 when they started focusing on the integrity of labor certification system. The agency started challenging such EB-2 requirement even for the SVP 8 IT occupations under DOT if it belonged to the Job Zone 4. The challenge took a form of "audit." Such EB-2 requirements have faced a massive challenge and audits. However, the former SVP 8 IT cases have been approved after the audits in a large number of cases. This practice is expected to change once the new form ETA 9089 PERM application program is launched next year since the new form will automatically consider such EB-2 requirement for IT occupations as the business necessity cases for exceeding the Job Zone 4 requirement. Initinally, DOL was scheduled to launch the new ETA 9089 form beginning from January 1, 2009, but luckily they pushed off the starting date to late Spring of 2009. That was a good news.
    Bad news is a further change in O*Net Job Zone for IT manager occupations. They just changed the O*Net data into version 13.0 which down graded IT manager job zone from 5 to 4! The last vestige of Job Zone 5 in IT occupations has been cruelly crushed to death. Since EB-2 occupation must require either a master's degree or Bachelor's degree plus five years of progressive experience, now all the IT occupations exceed the Job Zone 4 allowed preparation time. We will have to wait and see how this change in Job Zone for IT manager occupation will be managed in actual adjudication of PERM applications hereon, but it is certainly not a positive news.
    The recent downgrading of professional occupations from Job Zone 5 to Job 4 does not end with the IT occupations. There are a number of professional occupations that have been downgraded practically to nonprofessional occupations in some cases. Company General Manager is downgraded to Job Zone 3!! Employers who start PERM recruitment should review the attached Job Zone changes and seek legal advice. Believe me, there are a lot of surprises.

    ONE BEDROOM FLAT... AN INDIAN SOFTWARE ENGINEER'S LIFE...- A Bitter Reality

    As the dream of most parents I had acquired a degree in Software Engineer and joined a company based in USA, the land of braves and opportunity. *When I arrived in the USA, it was as if a dream had come true.

    Here at last I was in the place where I want to be. I decided I would be staying in this country for about Five years in which time I would have earned enough money to settle down in India.

    My father was a government employee and after his retirement, the only asset he could acquire was a decent one bedroom flat.

    I wanted to do some thing more than him. I started feeling homesick and lonely as the time passed. I used to call home and speak to my parents every week using cheap international phone cards. Two years passed, two years of Burgers at McDonald's and pizzas and discos and 2 years watching the foreign exchange rate getting happy whenever the Rupee value went down.

    Finally I decided to get married. Told my parents that I have only 10 days of holidays and everything must be done within these 10 days. I got my ticket booked in the cheapest flight. Was jubilant and was actually enjoying hopping for gifts for all my friends back home. *If I miss anyone then there will be talks. After reaching home I spent home one week going through all the photographs of girls and as the time was getting shorter I was forced to select one candidate.

    In-laws told me, to my surprise, that I would have to get married in 2-3 days, as I will not get anymore holidays. After the marriage, it was time to return to USA, after giving some money to my parents and telling the neighbours to look after them, we returned to USA.

    My wife enjoyed this country for about two months and then she started feeling lonely. The frequency of calling India increased to twice in a week sometimes 3 times a week. Our savings started diminishing. After two more years we started to have kids. Two lovely kids, a boy and a girl, were gifted to us by the almighty. Every time I spoke to my parents, they asked me to come to India so that they can see their grand-children.

    Every year I decide to go to India. But part work part monetary conditions prevented it. Years went by and visiting India was a distant dream. Then suddenly one day I got a message that my parents were seriously sick. I tried but I couldn't get any holidays and thus could not go to India. The next message I got was my parents had passed away and as there was no one to do the last rights the society members had done whatever they could. I was depressed. My parents had passed away without seeing their grand children.

    After couple more years passed away, much to my children's dislike and my wife's joy we returned to India to settle down. I started to look for a suitable property, but to my dismay my savings were short and the property prices had gone up during all these years. I had to return to the USA.

    My wife refused to come back with me and my children refused to stay in India. My 2 children and I returned to USA after promising my wife *
    I would be back for good after two years.

    Time passed by, my daughter decided to get married to an American and my son was happy living in USA. I decided that had enough and wound-up every thing and returned to India. I had just enough money to buy a decent 02 bedroom flat in a well-developed locality.

    Now I am 60 years old and the only time I go out of the flat is for the routine visit to the nearby temple. My faithful wife has also left me and gone to the holy abode.

    Sometimes I wondered was it worth all this? My father, even after staying in India, had a house to his name and I too have the same nothing more.

    I lost my parents and children for just ONE EXTRA BEDROOM.

    Looking out from the window I see a lot of children dancing. This damned cable TV has spoiled our new generation and these children are losing their values and culture because of it. I get occasional cards from my children asking I am alright. Well at least they remember me.

    Now perhaps after I die it will be the neighbours again who will be performing my last rights, God Bless them. But the question still remains 'was all this worth it?'

    I am still searching for an answer................!!!!

    I-140 PP is only available if you are within 60 days of your H-1 capout. So for most people who are porting PD from EB3 to EB2 , there is additional wait of six months to an year just for I-140.

    Porting PD from EB3 to EB2 can easily take 1 year including new PERM application, I-140 and I-485 interfile.

    What is interfile ? Is it changing the underlying I140 for the 485 application ?

    Can we do that ?

    Can the new I140 be from the same employer or does it need to be from a different employer ?

    Guys get a life, focus on the core element here, the element is to relieve ourselves and others from backlog. Read all these posts, what are we you all focusing on when dates will Retrogress

    When I called the customer service #, they said it could take up to 3 months.

    Lawyer is asking more now for
    Filing I-140 - I-485 - EAD - AP (for both me and my wife)

    Have I paid too much? Should I pay more to him?
    Your lawyer is cheap. I paid 7500 for 1 labor certification.
    Question for you. What USCIS fees did you pay. I don't recall any USCIS fee on labor stage.

    I was not bragging. I was just thinking out aloud, so to speak. Economic ups and downs like this this are a normal part of economic cycles in a capitalist economy. My observation is that IT industry is not as badly affected as other sectors. I have not seen people sitting without jobs for extended periods. I mean, some people do loose jobs but they get something else within a couple of weeks. That is pretty much normal functioning of markets.

    This is not your normal recession... Whats happening right now is once in a lifetime event... This is the kind of stuff you will be telling your grandkids about! This is payback time of the excesses of the past 25 years of loose monetary and fiscal policy under Greenspan... Your observation about IT industry not being as badly affected is true only till the month of October... Till then things were in sort of slow motion esp in IT sector... Not anymore!

Americans to a large extent have not known what real poverty is... The social implications of this fall out are going to be awfull... Don't take things for granted...     My LC and I140 approved (PD: may 2004). Applied 485 on Aug 8.
    I became father last month.
    My new born son is sick and he needs total attention for next 4 months. I have used up all my vacation and planning to apply for medical leave. Pediatrician recommends me getting medical leave and support my wife.

    I work in a very big hardware company. I have completed 3.5yrs in H1B so far.f I apply for medical leave, I may get a pay cut (like 20 to 30%). Will I be affected because of this medical leave? Are H1B's allowed to take medical leave (upto 4 months)..

    This should be non-issue as far as GC is concerned. This is a very genuine reason to take a medical leave.

    Also consider other options such as getting your mother or mother-in-law come to US to provide care, hiring nurse or live-in-nanny.

    You may be right in saying that people should be united, but you cannot and should not FORCE them to be. Censoring threads that you think go against the 'united' theme would be just wrong and would hurt IV more than it would help it.
