Actions speak louder than words... Lou Dobbs says Microsoft has waged war against the American middleclass by taking the company to Canada. But that hasn't stopped the company from starting a development center in Canada, nor has the company cared to answer Lou Dobbs in a press release or anything. What I am saying is, we should not care about what Lou Dobbs thinks or says on his show. As long as we being here helps grow the American economy, nobody cares about what Lou Dobbs thinks!!!

Good question - based on what I am reading on this forum, it seems to me like the RFE is requested for people who travel a lot in and out of the country. My wife has traveled a lot of times - I even lost track in the last 5 years - and she did tell me that they did not take her I-94. It would be still attached to the passport and when she enters back - if the travel time was less than 20 days, the officer discarded her new I-94 and asked her to keep the old I-94 - in some cases, he/she would just take it during entry. This happens mostly when she travels to Mexico or South America. The evidence that was being requested is the dates of travel and type of visa used to enter the country with the required documented evidence on the passport (color copy).
In my scenario, most of my stay in US, was limited to the stay period mentioned in my VISA though I-94 was given for longer period. There was one instance when I-94 date was given for a longer period than Visa expiry and I stayed till my i-94 date though visa expired. For this particular stay, when I look at the US Entry and Exit dates it would say as if I overstayed though legally allowed and only way to prove that would be the I-94 copy. I dont have the copy of that I-94...

I am not sure if this is that simple. There are no clear laws that state what would be the implication if:
Your I-140 on which you were granted an extension is revoked by your employer. This is quite possible if you are not working for that employer and the employer decided to go by the book. Most big employers would do it just as a prodedure. Some would do to subsitute the underlying labor.
I have heard various things in this regard some from lawyers too, and I haven't got a clear answer on it. This provision comes from AC-21 which fails to state the above condition. There were further directives (Yates memo etc) after AC-21 to clarify various situations, unfortunately this situation wasn't answered in any of them either.
If you draw parallels from extensions granted on Labor Certification, the H1B is valid till the end of duration as long as labor remains pending. If Labor is approved or denied or subsituted the underlying H1B status is quentionable. This could mean that the extension granted is not without strings attached. This is just my opinion.
If you have an approved I140 (does not matter which company whether former, curent or future employer), you can get a 3 year H1 extension. There is nothing your current employer can do. How ever, as the others suggested above, you should find you new job and transfer your H1 by using premium processing to be on the safe side. Also apply for new GC process which would allow you to port your priority date as long as your I140 is not revoked for froad/misrepresentation. There are certain rebates on this too.
If you are layed-off, there is nothing much to think. Just act quickly to get your 3 year extension and be optimistic.

This month end my I-94 will be expiring and 2 months back I have changed my passport to a new one as it was expiring. I have renewed my H1 recently(15 days back) with the H1 extension I received new I-94, would that be sufficient or I have to go out and come in again for a new one

If you have them prepare a complaint with DOL, attach the timesheets and clearly mention what has been going on since you completed work and any emails or phone bills showing calls between you and employer. Clearly mention your employer threatened to sue you if you pursue opportunities outside his company.
Filing a complaint is easy, cheap and risk-free - do not be afraid - and do not be rude - just do it

This is just a humour but has a meaning underneath if you try to understand. I am comparing USCIS to a product selling company. If USCIS was a TV selling company what would happen to the customers the way it acts ?
You could buy a TV but you will not know when you will get it. It could be shipped the next week, the next month, next year or never.
The credit card will be charged once, may be charged twice or a valid CC may get rejected.
Somebody who buys a TV from USCSIS a 2 years after you do, he may get it sooner than you do.
USCIS has no way of knowing how many TVs have been ordered and how many of them are in stock.
In case you do not receive your TV in two years, USCIS acknowledges that there is a long wait time for some and does not do anything about it. USCIS thinks acknowledgment of wait time is more than enough that it has done for the customers. Customers did not deserve this but USCIS did a favour to them being a good "Customer Service" company

I sent mine and spouse's 485 receipt notices and both the I-140 approval notices. I sent only copies. You really need to find the correct PO Box number of TSC or NSC to send the documents. My attorney sent the letter to NSC general service PO Box and I do not think that it was correct. I am planning to send the same stuff again to 485 filing PO Box.

Hi All,
I am in a very strange situation. I filed my PERM LC in Jan 2006 and approved in March 2006. While we are preparing for I-140, my company found LC Sub with the PD of Jan 2003 and filed I-140 based on that LC Sub in June 2006.
My LC Sub based I-140 is still pending since June 2006. Then in July 2007, I filed AOS based on that pending LC Sub. I got the EAD & AP. My wife has started working on EAD also.
Still my I-140 is pending and PERM LC is going to expire on Jan 13 2008. My company lawyers are saying that if the I-140 is not approved by Jan 9 2008, they want to withdraw my pending LC Sub and file a new I-140 using the PERM LC.
Question 1: If they do this, what will happen to my pending I-485, EAD & AP?
Question 2: Lawyers are saying that they have to withdraw the LC Sub based I-140 because the job descriptions are different? Is it not possible to file a totally new I-140 and keep both of them pending?
Please help me decide guys!

Even though it was not really the anthem for anyone there, it was a nice gesture to sing the national anthem of the people we are asking to help us. Plus, it is the only anthem that we all have in common...

I took the pain of driving to NY all the way from Boston to get my passport renewed. I woke up at 3:00AM and stated off at 4:00AM so that I could reach the consulate by 8:00AM. I was told by my friends that I would get it in the evening itself. Unfortunately, I was faced with severe disappointment that they are no longer returning the passports on the same day. The worst part about the Indian consulate in NY is that they didn't update their Website. When I called them several times, non one answers the phone and speaks with courtesy.
After arriving at the consulate, we were made to wait in the cold for atleast an hour until 9:15AM (They open the doors at 9:30AM). They have no mercy for people. Also, the approach they took to call out people was terrible. It was like a fish market. I asked them if would get my passport back on the same day. I didn't get a straight answer until my number was called. I went there and atleast that lady talked to me with respect with a smiling on her face. Atlast I was told that they are not returning the passport on the same day. They asked me to pay 20 extra dollars so that they'd send the passport by Express mail (USPS). She also told me that I can track the passport.
I then drove back to Boston, the same afternoon. After exactly a week, I got the new passport booklet along with my old passport. I am fortunate enough to have all of the details printed accurately.
My strong advise to everyone is to send their passports by mail.

My case got transferred from NSC->CSC->NSC. After making numerous calls individually, finally called NSC with my wife online too. Surprisingly she got her FP notices a week after we called where as I am missing mine.
Further more, my case was scheduled earlier than my wifes application. Not sure what is going on ? Does this sound normal ? Anyone else who received their FP notices separately and were scheduled on different days ?

Nobody is policing here. This is to inspire some of those 8,394 "mature adults" who made no contribution yet love to surf this site. We are all starting to think that core group is wasting its time if only 212 members out of 8,606 (only 2.4 %) want to support this organization.
Your logic does not really make sense to me. If I contribute X amount, I do so because I believe in IV's cause (which is my cause too) and not because someone else has contributed Y amount.
I think we are all mature adults and not school kids, and do not require such kind of policing.
