3 options
1) file H1 on Apr 1st and if H4 is not approved by then withdraw pending H4
2) file H1 on Apr 1st before the current H4 expires and hope that H4 is approved before H1. H1 should be approved after H4 to have the H1 status. If H4 is approved later, H1 status will be lost
3) Request PP of extension and 99.9% of time 539 is approved along with 129.
I will add more info as I find.

i mean it did say about my previous exp but the position for which the LC was certified did not need exp.. thats how the govt off advertise it seems.
i am freakin frustrated about this whole thing...if it is the ability to pay then..would my w2 be sufficient for the last 3 yrs cos my pd is 2005.

I need urgent advice from you. As you know my wife is on F1 visa and completed most of her credit hours needed by school. She has get only 1 credit hr to complete the course. However, that�s below 9 hr full time student status. She has been asked to register for additional 8 hrs..and pay tuition fee accordingly ( > 8K). Which I think is unreasonable. They told her that if she doesn�t register by tomorrow they have to report it to INS. She told them that she has EAD..there answer doesn�t matter in order to remain in school and F1 visa she has to register.
My questions is:
1) Can she continue working on her Thesis on her EAD and AP ?
2) What will happen to her f1 if she use EAD
In response to these questions my Lawyer said
1.) yes, she can continue to be a student as an adjustment applicant � she can work using the EAD and travel using the AP.
2) she is basically no longer an F-1 because she has demonstrated immigrant intent by filing the adjustment. Which is fine � she has valid legal status as an adjustment applicant and can work with the EAD and travel with the AP.

The problem that IV member Drifter had with his I485 application has been fixed. IV had contacted USCIS and USCIS said that they will reinstate his case.

You can file as many I-140's in any category (EB2/EB3/NIW) as long as you have a certified labor for a bona fide position with a matching education and company has ability to pay for those positions. These I-140's can come from one company or different ones it doesn't matter.
In your current situation:
1. Don't even think about doing anything with pending I-140 and AOS. There is a definite delay in I-140 approvals at both NSC/TSC so waiting is the best thing to do. As long as your qualification matches the LC description you will get your I-140 approved. If your I-140 is pending 30 days past the processing time and you haven't received an RFE, it might have been stuck in security check. Your lawyer needs to open a service request to find out what is going on.
2. For the labor that is expiring in Jan, go ahead and file an I-140 petition right now, there is nothing to worry about two I-140. If nothing else this petition can be used for 3 year H1B extension in case the first one gets stuck.
3. The second I-140 that you are filing can't be used for your pending AOS if your priority date is not current. Check the Pearson Interfiling memo ( from link below). If your priority dates are current and will remain current (EB2 ROW) file for an new AOS application when your second I-140 gets approved. If by this time your first I-140 is approved you can simply toss the second I-140 in the office shredder.

Just want to share the info that I have received the Permanent residency approval notice Y'day.
Have been here in us for more than 10 years. No more h1b renewals/ stamping, DL renewal issues/ EAD issues etc etc.

Is there a conspiracy, first there was delays in the processing of the EADs, now there is delay in the production of the EAD cards...
Are there more RFEs happening too?
My EAD renewal took almost 90 days to get approved, and my employer was ready to let me go if I did not get the approval before my EAD expired. Just made it with 2 days to spare.

I recently added pages to my passport in India while I was in Vaccation. It was painless process as I went through travel agent and have to pay extra money. No police verification is required if your renewing. Adding pages/renewal is all the same process.
If you apply in Tatkal, you will get your passport in a week. If you do in India, I advice you go through some travel agent.
Did not renew here as my job requires frequent travel at short notice.
If you are not travelling internationally then it is best to do it USA.

We paid with one check for: two I-485�s, and two EAD�s. In little space on the check where it says �for� I wrote fees. So, just want to let you know from my experience that, obviously, it does not matter if you paid with one check for all forms and applicants (in our case total was $1,150) or with separate checks for each application.
Our details:
PD � Aug., 2005
EB-3 ROW
I-485, EDA � reached TSC on Jul. 2nd
Check cashed � 08/22
Called Bank of America and got all 4 case numbers from the back of the check.
Checked INS website � applications were received on Aug. 21st and currently pending.
Receipts were mailed .
All applications were prepared and sent by lawyer, so I don�t know exact time when they reached INS or who signed for it.
