    I do not know of the SanDiego breakers 10k. I will look it up in runners world. 10K's should be lot of fun. I will support you if you take the lead with this. I can get my workout buddies and my family to participate in these events with me. I was thinking of signing up for the SanDiego rock and roll half marathon in summer but it would be brutal to run 13.1 miles in SanDiego in May. I am going to be signing up for the Nike Women Half Marathon in SanFrancisco this year as well. Count me in to support with this event, getting people to participate, fundraising etc. Some of my friends are certified fitness trainers and they teach in fitness clubs around OC. We could use their help for sure.

    techy2468 same here. i had deleted part of my last post even before u replied because i felt it was going off topic.

    "post office monthly income scheme" - that is good info i will definitely check on that.

    In short as long as a person is on H1B he is no better than his indian counter part working in a multinational or maybe he is worse, atleast person in india is close to family ,spouse can work anywhere etc etc.
    So the sooner the person gets GC the faster he has made his efforts worthwile - otherwise he will find his story similar to what sai posted in first article of this thread.

    I am switching job using my EAD and my 485 was filed 2 years ago (EB2 Sept 2006 priority date). I-140 is also approved. My new employer will not sponsor for green card or H1 but the job is similar, actually it is exactly the same as I am merely taking a full time position in my client's company. My old employer is OK with the move and have even offered me to be on their payroll until i get my GC. Can I have two employers?

    I've been thru many jobs here, and none of the offer letters mentioned that the job would be "permanent" (whatever that means). It's especially not possible to have that written on job offer letters for contract/project-based jobs. In any case, UDCIS does *not* require you to mention that on your EVL.

    in my case, my rfe was clear that my evl needs to state that my job is "full time and permanent". it also asked for salary, "specific job duties", educational/training requirements, date of starting the job.

    it also said that the ac21 letter my company lawyer had already provided when i changed my job was inadequate in details!!! howzzat?

    I am also in same situation. Two 140s (eb2 and 3) both have same PD. Have beed trying for interfile from last one year. I do not know if my case is eb2 or still in eb3. I enquired from Congressman and she told me that my case is assigned to a IO on 6th Aug so its in eb2. She is not listening to anything else after telling me this information. I have infopass on 2nd Sep. lets see ...

    I vaguely remember a discussion several months ago on the forum about people that have gone back to their home countries after having waited for their green cards.

    We have a media interview opportunity and need to find such examples. I remember an instance about a person going back to Bombay after he had immigration issues. He had set up his company there. Such people who could have helped US economy and growth will make a compelling story.

    Pls. let me know urgently of any such cases and I will follow it up. This is required today and we have a short time window.

    Two of my colleagues went back to India after facing GC hurdles. Among the two one is Phd in Atomic Science and Computer Science and lead a group of people and another is a Project Leader.

    In the first one's case it took more than 4 years for him to clear his labor and got frustrated by this process. He initially sent his family back to home because of uncertainty. That created more hurdles for him as well as his family could not able to get AP in time and he is nearing completion of his 6 year H1 as well. Eventually he decided to pack his bag and went back to his home country, setup a big business and now visiting US on business Visa and take some of the jobs from here to there :)

    [Side note: His approved LC remains unused at the company end even now, but finding a suitable person seems to be an uphill task for the Management and HR]

    In the second one's case his labor took almost 5 years to clear and having frustrated, he decided to go back as well. He does not want hang in a place where a decision cannot be given in a timely manner. He got some special technical skills and his roll is now being replaced by 2 people. He also went back to his home country, joined a big IT firm as a Director and getting more jobs to be outsourced there :)

    In both the cases, US is a clear looser by not taking advantage of the skill sets they have.

    Are we required to carry GC with us all the time ? :confused:

    My attorney says we must. What if I lose it or damage it ? Can we carry a photocopy ?

    Yes, the rule is to carry the original. If lost, apply for a new one. So, i preached.
    I never carry it, one day one immigration officer is going to catch me and grill me.

    I know a person who applied TIN number for their parents as they stayed in US for more than 180 days(that is technically possible as some months have 31 days, so if you correctly plan your paretns trip, people on visitor visa will be allowed to stay for 6 month or 183 days) . Also ff you talk to your immigration officer at the port of entry and convince him that an extra three days would be helpful for parents, he might give you 183 days visa.

    You need to prove the substantial presence of parents in US.They have a formula to calculate that (total number of days present in current year + 1/2 of number of days in previous year + 1/3 of the a year before previous year) and it that total is greater than 180 days + some other technicalities(which are easy to prove), you can file for TIN number and file taxes showing them as dependents.

    By the way, friends, I stay behind my words. Last year my family and I started working on "plan B" and when time comes, we will move out of the US after 6-7 years chasing of a mirage. Of course, if the GC mess here miraculously improves we would stay but I must be crazy to really believe that.

    Anyhow, everyone has to choose individually to stay and wait or to "vote with the feet". We all know it is a tough and painful decision but for me this is like a rotten tooth - the sooner you get rid of it, the better. Just my way of thinking.

    Our "flirt" with the US immigration system resembles very much the unshared love - you love a girl and do everything for her but she is a spoiled bitch and just plays with you. Some people will never stop circle around this girl but other will finally get pissed off, will say the f-word and will move with their lives. Suddenly these people will discover that there are lots of other girls, honest and thrustforthy, who deserved to be loved. Voting with the feet... :-)

    The government's surprise offer, then abrupt reversal, of an opportunity for thousands of skilled foreign workers to obtain permanent residency in the U.S. highlights the problems of the overtaxed immigration system and the frenzy that results from a chance to apply for a green card.

    The scramble has put tens of thousands of workers and their families in limbo after many of them and their employers spent thousands of dollars in hopes of securing permanent residency. It may result in a class-action lawsuit against the government by frustrated applicants.

    The problem began on June 12 when the government seemed to open the door for thousands of foreign workers and their families to end the long wait to apply for a green card. That is when the State Department published a Visa Bulletin, which is a monthly notice closely watched by immigration attorneys and their clients because it determines who is eligible to file a green-card application the next month. The June bulletin announced that practically all skilled foreign workers who had been previously deemed eligible for an employer-sponsored visa could now take the final step of applying for a green card.

    By law, the U.S. can issue about 140,000 employment-based green cards each year. Last year, the government fell short by about 10,000, despite the long waiting list; leftover visas cannot be rolled over to the next year. The June announcement aimed to prevent the visa slot from going to waste, according to a State Department spokeswoman.

    The announcement was greeted with a mix of jubilation and panic by thousands of engineers, lab scientists and other high-skilled foreigners who had waited years for their place in line. Working ahead of a July 2 date for filing the application, intending immigrants rushed to gather documents, complete paperwork and obtain medical exams. Many of their dependents boarded planes for the U.S. to meet a requirement that all family members be present at the time of filing.

    "The bulletin created a land rush among legal immigrants desperate to finalize their green-card applications," said Steve Miller, a Seattle-based immigration attorney.

    Then, on July 2, the State Department issued an "update" that reversed the previous bulletin. It stated, effective immediately, there would be no further authorizations for employment-based cases. The U.S. Citizenship and Immigration Services, which processes the applications, said it would instead simply process existing applications to meet this year's quota. "We already had sufficient applications pending without new applicants...," a spokesman said.

    Mike Aytes, head of domestic operations for the USCIS, said all 147,141 employment-based green cards have now been issued for the year.

    I have been constantly trying to get the message out here that it is imperative that we do not condone illegal or unlawful activities including covering up out-of-status cases. I have received so many REDs for doing it. Go look at the other two posts I have replied to. Some people who don't like the fact that I advise people to leave the country. They are the ones that give me reds!

    I saw this on an anti immigrant site by a M*****r.

    Hope some of you will learn a lesson from it and stop posting threads about Telgus, Eb3 vs Eb2.

    I have also seen posts by ignorant educated illiterates on IV where they advice people to do illegal things. Some of you own consulting firms or businesses and try to promote it by posting and sending Private messages. If we see such message, let us give reds and report to IV. We also need to discourage people from answering wrong info to posts where someone is illegal/out of status. All this used against us.

    Administrative Fix-IT campaign


    No. It's not a typo. USCIS indeed needs to help us in order to help itself. With the recent campaign by Immigration Voice to request the administration to pass certain measures that would immensely help the High Skilled Legal Immigrant community, USCIS can legitimately and administrative improve its processes, so that it can go back and do what it does the best - Adjudicate immigration applications.

    Despite the reality of a huge economic deficit to be borne by the new administration, the Inspector General recently cautioned Congress about the impending backlogs caused by outdated policies and the slow pace of IT modernization of USCIS. One statement in particular stands out - USCIS has come out with plans to modernize its processes, but these plans are pending approval.


    Quote : Until USCIS improves IT management and operations, the USCIS will not be in a position to either effectively manage existing workloads or handle the potentially dramatic increase in immigration benefits processing workloads that could result from proposed immigration reform legislation - Oh Law Firm


    The current administration should pass these administrative fixes in order to better the main purpose of USCIS.

    Some of the fixes include -

    1. Recapture administratively the unused visas for permanent residency to fulfill the congressional mandate of 140,000 green cards per year.

    Due to processing delays, USCIS is forced to waste approx. 20,000 visas allocated for the Employment Based Permanent Residency process. This measure will indeed help USCIS to process and clear the backlog once and for all.

    2. Revise the administrative definition of "same or similar" to allow slight additional job flexibility for legal immigrants awaiting adjudication of adjustment of status (I-485) petitions.

    By strictly defining job categories, legal immigrants are subjected to undue hardship and career stagnation. When a legal immigrant decides to move to another job with a different (and usually better) position, he/she is forced to start the legal immigration application cycle again, causing more paperwork and process cycles on USCIS's part. One way of Simplifying the process is to relax or broaden the definition of "same or similar" job description while applying for a visa during a job change. Imagine stuck in the same job for 6-10 years because federally mandated visa numbers are not available but you have been successfully approved to get one.

    3. Allow filing of Adjustment of Status (Form I-485) when a visa number is not available.

    Form I-485 is the last step of the Permanent Residency process. This step is required in order for a legal immigrant's status to be adjusted to that of a Permanent Resident. Without this step, applicants cannot apply for I-485 and have to wait until visa numbers are available.

    4. Implement the existing interim rule to allow issuance of multi-year Employment Authorization Documents (EAD) and Advance Parole.

    EAD or Employment Authorization Document is a temporary status allowing the applicant to work for any employer until the immigrant's 485 application is adjudicated. AP or Advanced Parole allows a applicant who is waiting for his/her I-485 to be adjudicated, to travel to his/her home country in the event of an emergency. Both these documents are available for a hefty sum and are valid only for 1 year. With recent backlog estimates at 800,000 applications, USCIS has to endure tremendous workload by renewing these documents once a year. By issuing documents valid for 3 years, this burden can help USCIS focus better on other adjudication work.

    5. Allow visa revalidation in the United States.

    Visa revalidation, per the State department, is required to be done outside the US at a consular post in an immigrant's home country. This causes undue burden on the legal immigrant.

    6. Reinstate premium processing of Immigrant Petitions.

    For those employers looking for a quick adjudication to an immigrant employee's petition to work, premium processing has been a god send. Premium processing forces the employer to pay more in order to receive an expedited decision on the petition. Premium processing was suspended due to receipting backlogs after the July 2007 Visa Bulletin fiasco. Now that the receipting backlogs are over, USCIS should now reinstate premium processing for immigrant petitions.


    In-house cleanup of the USCIS by embracing the above administrative fixes will immensely help USCIS realign its purpose of adjudicating visa and permanent residency petitions rather spend a good portion of its time working on supporting "pending state" measures.
