Its amazing... doesn't law have respect anymore from congress??
When you apply for I-485, one major scrutiny they do is about your status.
They even ask "Have you been out of status in USA for anytime?".
If you were out of status or over visa date(illegal) even for a day, most probably GC applications gets rejected.
Now congress is planning to reward people who were always illegal.
I though politicians are drowning developing countries... but I don't see any difference beiween developing countries and USA now... may be not now but after few years they will at same level. Politicians are same everywhere..

Hey its Guidi again,
I too have had that un-even focus problem. The photo was in focus on the right and out of focus on the left. Very wierd. Nikon told me it was a depth of field problem but both subjects were standing exactly at the same distance from the camera.

I efiled EAD and AP for my wife and myself over this weekend. My earlier documents had been filed at TSC. In answering Question 11 of EAD, I "assumed" Dallas TX Field office and USCIS TSC are one and the same. So I selected Dallas TX Field office as the answer.
When the receipts were generated for our applications they were generated for National Benefits Center with MSC as the prefix. This got me confused and I asked this question (http://immigrationvoice.org/forum/showthread.php?t=19323) on IV. This evening to research what is going on I started a dummy application and saw what I had done wrong. I canceled the dummy application.
I am writing this to alert anyone to not do the same mistake. I am mighty concerned. I will call USCIS tomorrow morning and ask on what will happen and where should I send me supporting documents. I will also get hold of some local attorney.
In the mean time what do you guys think of our situation. Any experiences, ideas? Please share. This will be long night :-|

Under Post decision activity it will mention a date :
"we approved this petition and sent it on date -->
This date is when they mailed your green card.
If you do not receive it in 7 days after that date (that is mentioned on "post decision activity" message, you need to check with your local post man/post office and then consider infopass to see what has happened.
The card comes in a "neutral looking envelope" with "return service requested"marked on it and upper left corner has address of Nebraska or Missouri (two places where they are produced). Nothing else on that envelope (it is slightly large than norma envelope): keep looking for it in your mail.

Hi,
Sorry about your employment situation.
If you think it is serious enough, I strongly recommend getting an Attorney's advice on how to transfer your H1B smoothly and also to clairfy any questions that you might have.
Paying few hundred dollars for attorney's consultation is worth the peace of mind that you get, once your questions are answered.
Murthy.com, shusterman.com etc are some of the good ones that I know of.
Good luck and donot worry too much (as these kind of things never stops occuring in life).

The only issue I see with using H1/H4 visa for re-entry is that if your I-485 is approved while you are outside US and you use H1/H4 for re-entry, it invalidates your GC and you have to start all over again. You either need to have your GC or an approved AP in hand when you re-enter US in this scenario...
That is not true. You should have no problem re-entering if you have a valid Visa or AP, even when GC is approved. Technically, you have to be first "admitted" and then the green card status takes effect. you have to show the IO at POE, the latest I-485 status if you have, which they can always check in their system.

I have been a long time supporter of IV and all the work that IV does, I have been on this forum for for a while now and have always believed in the cause of IV and though I am not active on the forum for some time now I have actively taken part in a lot of the efforts that IV has undertaken and have contributed monetarily as well .
Besides the fact that IV can try to help members in extreme situations like the one I am in, IV is really the only organization that watches out for our community, it is all we have. We need to be an active part of it and should make it stronger.

That is the point. It was not of your own volition.
Also, there is no rule that says citizenship is not available to people who do not work for the sponsoring employer for a certai nperiod of time after GC approval. It is just good practice to stick around for a few months after approval, but it is not law.
You will have no trouble. Change your status from bittersweet to sweet and have fun. Also, good luck finding a new job.

I hope IV does push for the 485 measure but if for whatever reason they change there mind and dont push for 485, I would be disappointed but that will in no way affect my attitude towards IV. Over the past year or so I have seen enough of core tem to say they take a decision in the best intrest of IV.
I have not filed for I-485 and neither am I close. I feel I-485 is much more controversial interim relief then most members think. This is explained in a post (from a law firm) in another forum. Another reason for my feeling is that AILA is not supporting I-485 filing for health care: they are supporting a temporary 25K-75K increase in GCs. It is possible that health care GC does not have I-485.

If you are not married before GC, you are in a crappy situation. If you marry you will have to deal with lots of mental misery, distance, stress etc. Not worth the pain. You can look at this option - after GC, you are allowed to stay outside the country for a max of 1 year without a permit and 2 years with a permit, without affecting your GC status. The flip side is your citizenship is delayed and you are similarly delayed in sponsoring your spouse. Also, it is not a good idea to stay out more than 6 months at a stretch in any calender year so that your citizenship is not affected. Maybe it would be a good idea to join lobbying efforts to allow sponsorship of immidiate family of GC holders. Lots of people are in this situation. Without a GC your professional life is screwed and with a GC your family life. Good Luck.

im 17 and have my first "job" or request as its gonna b for free to giv me sum experience.. plus i work for them!! (part time as im in my penultimate year at school with no intentions of goin to uni)
i tell u theyr gonna be the coolest farm on the web!! lol
i thout itd b a good idea to at least get 1 example of wat i can do on the web b4 i start askin ne1 for money... just to let them no im serious uno?

I am in the exactly same situation.
I talked to my Attorney and they are going to send me Originla I-485 receipt notice. What they told me the RD on original notices is July 2, 2007.
If this is true, then I will just ignore the Aug 28, 2007 RD on my Transfer Notices.
Try to get your original I-485 from Attorney and check out what the RD is on them....
An please post here if you find anything else.

Hi folks !
need help .
I140 denied from NSC .got REF on 03/08 . Was for A2p.fellows got same RFE and got approved from same employer but mine got denied .Didnt get official notice yet .What are my options .please advise.
Im on 4 ye H1b .and have option to change employer and also have option to keep the same employer and work for another employer at the same time .
please advise !!!
Keep your options open regarding changing employers and file for an appeal if you can. Notice should tell you the reason for denial. What is your employer/attorney saying?

We can understand if USCIS does not send anything to employee for I-140, but for I-485, which really is an application from the employee, it is really not legal for the attorneys to dance on employers' tunes and provide our paperwork to them and then blackmailing us together.

You yourself willingly knowingly signed G28 form and gave all the power to your attorney. USCIS is not suppose to be sending you anything. And IV has nothing to do with it.
You have to realize, that your attorney/employer have to be willing to support your GC honestly, since you might need them in case of RFEs, etc. If they are playing games, then invoke AC21 and leave them.
You can sign G28 with another attorney, and your new attorney will request your case from your previous attorney. Your previous attorney will have to be REQUIRED to send ALL your papers (including that RN).
