Visa Stamp in Passport: 13-Jan-2007 (I94 in passport expires on 1/13/07)
Current I-797 : From 02/24/2006 to 04-Jun-2007
3-Year extension based on I-140 from: 05-Jun-2007 to 04-Jun-2010
In this scenario, if I goto India, say in Feb, get my visa stamping done, what will be the validity of my visa in the passport?
1. 05-Jun-2007 to 04-Jun-2010 as stated in my 3-yr extension or
2. the date I went for interview till 04-Jun-2010??
If its the former, then how can I get into US during March '07 as there will be a gap in my visa dates in the passport?

It could take anywhere from a few days to a couple of weeks. For me - it was around 2.5 weeks from the time the status changed to "we received your response....". Plus with the Thanksgiving break - it might take a bit longer. The best thing to do here is just not to worry about it and just wait...since its no longer in your hands.

I am not married yet. What are the implications if I get married to a citizen of india residing in India.

American Dream suspended on the eve of American Independence
For aspiring immigrants ,4th of July is not just a holiday and fireworks but a promise of all good things that are American , which comes to those who follow the law , live by her rules and wait patiently for their turn to be called Americans.
Patience is not just a virtue but a way of life for thousands of Legal immigrants who have been living in the US for a number of years . Besides the everyday stress of Job,Mortgage,Health and education of their children they live with the added suspense of when their application for permanent residency ,commonly
referred as "Green card" will move ahead from its deep slumber.
To apply for a employment based "Green Card" , a employed worker's company needs to fulfill the
requirements of the DOS/USCIS and the date the application is received by the department is referred to as the "priority Date". A movement of a month keeps the hopes and spirits high of the applicants and their families and a couple of months is sheer joy. In 2004 there was a negative trend of retrogression of
the applications in queue and the dates moved back instead of moving front. It implied a waiting period of a couple of years at the minimum. So midway of the application process everything stalled, all eyes turned towards the senate and the house hoping they would mediate and provide respite to this broken situation. Nothing happened and so we waited for the much anticipated CIR as it was told to us that a comprehensive immigration reform will address the situation of the legal immigrants also besides its main agenda to solve the issue of illegal immigrants in this country.
The CIR died , then mid June the USCIS came up with a bulletin announcing that it will start accepting applications for adjustment of status for all employment based applicants and their dependents ..From then on it was a scramble to fulfill a long list of requirements to be able to apply on time. The first task was
for my husband to convince his HR to sponsor the process. Since they had already budgeted for the fiscal year and are on a spending freeze , it took a lot of convincing . The HR complied and gratefully we set out to get our Medical exams(at own cost of 150*2).Since we live in a small state with few doctors we
drove 2 hours to a neighboring state to get them on time. Being a mother of 3 small kids, I could not work on important paper works with them around. So after putting them to bed we spent the entire night pulling out the required documents from archives and placing them in order; numerous phone calls to parents
back in India to collect their date of birth, place of birth information and completed the questionnaire. Got passport pictures(60$) and mailed it all to our lawyers praying it will be one of the first to reach the department office on start of business on July 2nd..little did we suspect that this was nothing but adding insult to the injury plan by the honorable DOS.. They had already prepared a rude
shock when they released a bulletin update on July 2nd stating that they will not accept any applications as they had already allocated all the visas for the current fiscal year in a unprecedented action.
This has left thousand of families like us confused, saddened and in the middle of nowhere.
We are raising families here, our everyday life is no different from any other AMERICAN middle class family with same expectations and hopes, so its not easy to presume that we can pull out or get out of this situation and return to our home countries . We still have faith in the constitution and the spirit of this country and preserve faith that this wrongdoing will be reversed and we will get the opportunity to achieve what we have waited for years in a long queue, abiding by the law and fulfilling all requirements to the
tee..
On the eve of America�s independence let justice prevail and urge the congress and the STATE department to undo this monstrous decision of USCIS ..

I filed my wife EAD on 8th of April, saw couple of LUD around April 20th ... After no LUD's. Waiting eagerly to get approved.

Hello -
As a Primary Applicant my GC was approved (EB-1) but for my wife's application I got an RFE. RFE - USCIS is asking for a VALID wedding certificate showing proof of a hindu wedding under hindu act (dont ask what I was doing or what my lawyer was doing while submitting 485)
Now I have about 28 days (total is 30) to respond to it. I have not rcvd. my GC but it has been approved and has been sent to production. My lawyer told me that as my GC has been approved my VISA is not good anymore. My wife was on dependent visa and so is my kid.
Now as my GC got approved.......my visa got cancelled...........my wife's & kids visa is invalid.............and we did not file for Advance Parole so we cant travel. On top of all this we dont have a wedding certificate.
Any suggestion to address this situation? I cant get a certificate without going back to India and I cant leave the country as If I do so I wont get to enter the country again. Even if somehow (on some legal basis) I can re enter I dont think my wife and kid will be able to re enter US.
If I dont produce evidence then my wife's application will be rejected putting her out of status.............gosh what a mess.....
ANY SUGGESTIONS FROM ANYONE WILL BE HIGHLY APPRECIATED. Murali please respond with any possibility which I can explore upon.

Thanks for your comment.I am afraid you mis understood what I said medicine and pharnact vet med etc. There are practitioners in these fields called MD, DVM, PHARM D etc. However there are many more PhD students who do research in these fields. And they are not listed as STEM graduates. I guess whoever did this listing of the STEM majors don't really have much knowledge about various fields of research and also they ignored the highly multidisciplanary nature of the current day research. I hope more people will start taking this issue seriously.

With dates current (even if they are for a few months), I wand this CIR to just go away. I would rather take my chances with the old process, then face something that is highly likely to be detrimental to us.
Come to think of it...If I (most of us) have our EAD's (spouse can work, job is portable)...would I really mind waiting to get my GC for 5 years...

I belong to my state chapter, I am all for meeting whoever to make an impact but it would be great if we can put together good talking points and issues to highlight when we meet these lawmakers.

Can we see a list of all the positive outcomes of the various advocacy events, lobbying etc done by IV for the EB immigrant community please?
And, if any of those good outcomes are being implemented by USCIS to ease the EB backlogs?

That is equivalent of approx 22 miles. I doubt there is anybody is bombay that drives 35 km one way on a daily basis. But in the US living 10-20 miles from work is not bad. People in my office drive about 40 miles one way without blinking an eyelid. Some drive even more. Plus the cars that they have in india have smaller engines, smaller capacity thereby better gas mileage.
So for people who say gas is a non issue, think again.
Yes, thinking again, my opinion still remains the same. Gas prices in the US moved up from 25c a gallon in the late 60s to what it is now. No one stopped driving on account of that. Ditto with India.

I say, we will not see signifcant changes in the US lifestyle due to increasing gas prices. People will adapt and continue to do what they are doing. But this is theory and cannot be substantiated with evidence. Hence, I accept I could be wrong too.

Get your degrees evaluated by the certified evluators and add your experience to be qualified or you can go for EB 3 but your priority date will remain the same. A friend of mine was in the same boat, but had 3 years commerce college and 2 years MBA from UK and was in his 9th year of H1, I 140 was denied. He appealed and REAPPLIED I 140 with all the evaluations, he got approval in less than a month but EB3 with the same old priority date.

Thanks for your update Ramesh. My labor substituion is EB2. Prior to the filing I have 12 years of experience with 18 years of education. Now going for EB3 is filing a new labor under EB3 or file a new I-140 and say it is EB3 and not EB2. Could you please help me by providing more info on this?
