unfortunately, I think there is more demand than supply for EB2 India Mostly (maybe China too)...which will not let any relief be brought to any EB3 categories....If USCIS keeps allocating spillovers to EB2...they will never quell that demand.
I agree with Nixtor that dates for EB2 (I and C) will go back again..to at least 2004 if not later.

I have recently moved out of state and started on a different job. I updated my address with USCIS online last week. I just got a email from CRIS for RFE. I have I-140 has been approved since 2004 and applied for I-485 in July 07. My lawyer is from Frogman firm. This was the firm used by my GC sponsor employer. My new position is slight different from Software Developer to Lead System Analyst. I think this should be covered with same or similar clause.
If you have prior experience please let me what to expect and do any preparation now itself.

Relax, LUDS could be internal updates no one can tell you with absolute certainty what they mean. I saw this whole thread you are in panic mode and restless. Just relax man your case will be approved soon.Think of it this that they are working on your case not like others who have filed and heir cases are lying on the shelf.

I'm on H1, I decided recently to buy a house after I stayed more than 5 years in this country and gave an offer to purchase it . I will drop now as I'm feeling unsecured in this country of immigrants and with it's protectionist policy against Indian Talents in this 21st century. It will also influence all of my friends who are also potentially looking to buy houses . I will not buy any stuff and influence all of my friends which costs every H1 holder to lead uncertain state of living in this country.

Apparently CBP officers got hold of the new Neufeld memorandum on H-1B workers at third party work sites and decided to start applying it on their own. Aside from being contrary to established procedures for revoking visas, CBP officers made inappropriate comments and issued threats that cry out for some form of disciplinary action by DHS: It is then no surprise that the outrageous singling out of Indians since the New Year waiting in the line at Newark and other airports by CBP...

Similar situation...
I am getting married in the 1st week of Sep and am planning to get my spouse by mid Sep.
Can someone please suggest if I am fine, if I apply alone for I-485 around Jul30(and not for EAD and AP??) and add my spouse around sep20th. I-140 approval is pending and have a valid visa till '08.
How long does it take for the I-485 'approval' and is 2-3 months a safe window to add ones spouse?
Any suggestions and help with my planning are greatly appreciated. :)

I don't own a D70 or know of anyone, but sometimes I just wonder if it's the hands in control of the device that have a lack of experience and blame it on the equipment.
Rest assured that if that's the camera of your choosing, buy it and I'm sure that you will be fine most likely. There are plenty of happy D70 owners that you're NOT hearing from, they are out taking photos!
The Canon 10D was plagued by forum reports of backfocusing, and perhaps there were a few/some that exhibited this behavior. But the majority do not and with everything, there may be a few bad apples in the bunch.
Buy your gear and don't worry so much about the forum problems you read about. You have a warranty if something just happens to be not right.

My 485 was apporved in July 2010 and have not recieved the card yet. I have contacted with couple of Service Request for non-delivery of permanent cards. First reply from USCIS was that my case was waiting for finger printing information from my local USICS was backlogged for appointments. So, I have told to wait for 60 days for either FP notice or physical green card. After 60 days, I have called them and another service request was created and the reply was completely irrelavant as they says my address was updated for my query about non-delivery of GC.
Is there any other escalation request that I can made for deliveriy the GC or the FP notice? whenever I called the USICS are creating the SR and have to wait for answers like above.
I have recieved the 485 approval notices (for both of us) on July itself but waiting for cards now. Are anyone with the same boat ? Or Is the unusual case?

When you transfer money outside the USA, one of the questions that FDIC mandates the finanacial institution collect is: SOURCE OF FUNDS. If you put this as "salary" then you (and your employer) have ALREADY paid (or will pay by next year) on these funds. There are no additional US taxes on the money. If the money was not earned thru salary (which would not be legal since you are on H1B) then you will need to declare it while filing taxes. If the money was NOT earned "under the table" and was above $600 then, the payer will send you a for called 1099 which will show how much you were paid and you have to pay appropriate taxes on that amount. In your case it most likely looks like "salary", so you have nothing to worry about.

My I485 is pending, recently I have changed my address online. I also recieved confirmation letters for this address change.
After 2 weeks of address change, USCIS issued an RFE. I have not yet received it, but I just want to prepare for this.
What could be the reason for this RFE? Is it common?
People here have related change of address to RFE but I personally do not blv. it happens as I changed address 3 times and nuthing adverse happened.
Wait for the RFE. It could be something minor. Since you are eb1 they might need something related to your job/experience. Each RFE is different and no one can predict what it could be. I have seen that 80-90% RFE can be replied easily so dont worry. Post again when you have information on what USCIS is asking for and I am sure that somone out here will be able to help you out.

I called Senator Ed Kennedy's office and was told that CIR is likely to be introduced in early March something like first week. They of course told me that there are no guarantees, but more a reasonable probability.

As long as you show that your job is atleast 50% different from the previous within the same company, you can use the experience from the current employer. You dont need to be promoted or move to business development.
You can use the 5 years exp from current employer. But the new position itself should require 5 years exp to qualify for EB2. File your PERM then when you file you 140, include your previous approved EB3 140 with the older PD and ask to port the PD. Then when USCIS will approve your 140, it should have the correct EB2 cat and older PD(from EB3 app).
Thats all. I was able to recapture my PD but I had a Master's degree. The only issue was that I graduated AFTER I joined my long time employer. So in the old RIR world you could not use that but PERM relaxed/cleared up the 'graduation' issue and we filed for a new EB2 application. In your case you will use your 5 years exp to qualify for EB2 rather than Masters.
The process is tedious but rewarding at the end. Hopefully your corporate lawyers will help you in this. A lot depends on your company and your supervisor, they need to be motivated.

I just came back from india. Flew via Frankfrut (Lufthansa). Lufthansa was bad. Frankfrut was dirty, no customer service, service Reps are rude. Next time I will avoid Frankfrut. AND I will not pay a dime for transit visa. period.
American airlines was trying to stop me boarding the plane as the CSR was not aware that if someone has AP they would not need transit visa in Frankfrut. I had to fight and make them call Frankfrut to confirm.
Might not be pertinent but American Airlines food was horrible and tasteless. They were running out of food.
