    barobar..pan...one of the reasons bills were easier to pass then was because there werent so many groups who would moblize resources to kill a bill. Even the suggestion of a small ammendment has hundreds from well supported groups calling the lawmakes. We dont stand a chance of competing with them or even making them understand our simple requirements all on our own. Currently the word 'amnesty' is enough to get everybodys blood boiling. Any immigration measure is sure to hijacked by the the extremist positions on both the sides. The result is that nothing will be passed. I dont expect anything different in 2009, no matter what the candidates say. if you look at the speeches they are all slowly hardening their positions. Not matter what you say Hispanics support groups are huge and have enormous clout, as is evident from both the candidates sucking up to the various groups.

    (an approach)For the short term people with a law background can analyze the existing laws to see if we can get an adminstrative solution. Just like DOL/USCIS were able to interpret the law to change the visa alocation process, i am sure some of the enterprising ones amongs us can devote some resources to find out if there is an adminstrative soultion to the problem.

    We probably need some help from IV core in regards to political and legal issues in going forward with this idea. Based on the implications, we can first decide whether to go forward with this and then finalize what we want to ask for.

    When this bill was passed, I am assuming that the congress was a republican congress since the president was from democratic party. Is that correct?

    Guys,

    I am on H1B and no EAD/AP. My stamping expired long time back. So do I need the Transfer Visa for Germany if I need to travel to India...if so, whats the procedure to get one.

    Also what are the countries does not require the transit visa if the stamping expired.

    Just curious...are you and ryandacosta the same person? ..you seemed to refer to his previous post as your own..so got me thinking. Never mind.
    Anyway, no one said it is taboo. As it has been clarified, where are the resources/people?? And it all depends on what exactly you mean by "reaching out"?
    If you have some good ideas.. thats great. Please follow-up and share it with the forum and IV-core.
    we have folks coming up with great ideas but then vanish and never follow-up only to return and complain that the idea was not implemented. So best approach is to take it up as an action item and do it yourself. Surely there will be volunteers here who will be glad to help.

    IV reaching out to new members is taboo?
    Why are you reaching out to lawmakers....because you want them to make favorable laws benefiting immigrants....will they do it without your reaching out...maybe...but most likely not
    so reaching out makes a difference isn't it
    You want more members to contribute and help out...but you want to do it without reaching out to them. Think about it...ya it might happen...but won't you get better results and more resources if you reach out.

    I didn't blame anyone for anything...nor did i question anyone's efforts or intentions...i was simply seeking basic information about the organization and how it is run....i am guessing here ...but i think this is the first question on people's minds when they decide to contribute or not...a good PR campaign to promote IV among existing 1000's of members on this site won't be a bad thing

    guys after seeing such a long thread i gave some credibility to the post and called USCIS... after jumping through several loops and CS agents ... none of whom had any idea regarding the development mentioned in the post. So after insisting to talk to a senior person I was transferred to ... what they call head of information and CS rel or wat ever it is... i dont remember it exactly... anyway.. i explained our situation/concern/paranoia to him... he listened carefully and gave me these following reply...

    1) USCIS is working diligently to process the receipts, but since USCIS is handicapped by limited resources compared to the huge wave of applications it will take some time to post the receipts. In his words "we understand your agony but you also have to understand that we cannot work like machine and solve this in couple of days... we are putting our best efforts and pulling all our resources we very seriously handling the situation"...

    2) When told abt the rejection news ... he said he dont have any such information and "we in US gov agency dont play the carrot and stick game... we will honor every word of the july 17th bulletin"

    3) when asked what will happen as the visa nos are not available ... he told me "rest assured in USCIS has devised a plan that will take care of majority of the concerns ... but it is unwise to ask anything about the plan as USCIS is in no liberty to divulge any further information about it"...

    4) at the end he said not to go berserk at every rumor at every blogs ... "we are all very reasonable people even in USCIS and DOL and understand the gravity of current situation " .... "very govt is tied with some level of bureaucracy so some delay is unavoidable but we are working at our peak efficiency to minimize that"...

    5) jokingly he also added that his neighbor is an indian guy and her daughter playes with their kid ... he said "my daughter will kill me if her friends need to go back to india for this"...

    So, you got to realize that my thoughts stem from a totally different basis.....to see H1Bs (and GCs??) being pissed away to glory every year in the name of IT-manpower-shortages (bull@#$%) and the ensuing problems we all face.


    The third school of thought is outside the actual pool of H1B jobs I was arguing about, aka. contracting.

    I believe that you are an employee. Not an employer. I am sure your thought process would change when you are an employer. BTW, Did you get an ivy league education? Do you work in a decision making capacity?

    Also, your thoughts stem from a "Oh I make enough money as an H1B and I don't work in IT so I wouldn't give a damn about those other guys in IT". You belong to the same section - AN H1B.

    If the H1B quota were to be eaten up by people from your profession how many of us here would worry about it?

    My Labor started showing "CERTIFIED" from Jul, 12th. Called the Legal Department today to check if they have received the hard copy, but was told they are still waiting. Also asked to see if DOL started using e-mail option as well to notify about the adjudication.

    Hopefully, they should receive the certified copy atleast by the end of this week.

    Hello Kodak57,

    I dont have a Birth Certificate and the Certificate of unavailability is next to impossible to get from the Local Muncipal Corp.

    I do have 2 Affedevits 1from my parents and second from my uncle stating that the record of birth is unavailable and that i was born on a specified date etc.

    Would the affedevits along with a School leaving certificate work?

    As far as I remember, my PERM labor was cleared in about 7-10 days time from the time of application. It was so quick that I was pleasantly surprised. Go ahead and file your LC ASAP. I believe you can then immediately file for I-140 and then I-485. The key is for your labor to be cleared at the time of 485 filing.

    But from the point of recruitment to application, it took about 3 months. I hope it is faster for you. Make sure you get all your previous jobs experience letters. That's what took me longer otherwise the time period from recruitment to application would have been 2 months.

    I am very happy for everyone who can file, congratulations again!!!

    My situation is not as happy though, and I need the advice from you all. My company supposedly started my PERM recruitment a month ago, yet they don't really communicate with me even though ask), and I have strong suspicions that they haven't even started it. I am feeling that most likely I will miss this great opportunity of all dates being current...

    My question is, how long did PERM take for you guys (for those who went through PERM). The PERM thread is not very long, and someone mentioned there that "if the lawyer is good the process takes about 60 days" (I mean, from the time recruitment starts to filing)...my only hope is that my company has in fact started my PERM, that it will go through soon, and on top of all that hope that dates don't retrogress again in the mean time. What a long shot, I will probably miss the boat! :(

    I appriciate your response, first the reason I have posted here as mine is also a 3 years Engg Degree issue and I thought my case will fit into this thread, please let me know if not. Even I have Master's, my attroney is saying that it can not be equated to US Master's unless I have 4 years Bachelor's degree.
    My LCA has not been filed yet, before that I am not able to convince the attroney that my Bachelor's is equal to 4 years bachelor's degree.

    I am not sure if this adds any value but AICTE did mention in their web site about "LATERAL ENTRY TO DEGREE ENGINEERING ", if any body is interested you can get it at the below link.

    *sigh* I am not getting my hopes up...I hope you're right though!! But basically I posted that just to show that one estimate isn't correct...and the other, well, I guess we'll wait and see. But I tell you what, if I get my GC in November then the speculators in this thread can use my situation to predict theirs better :)
