Even before USCIS released the data some of the Donors mentioned that there is discrepancy in the FOIA data and core is expect to release the data to everyone once they receive confirmation from USCIS. We believe in IV. USCIS would not have released this data unless IV and thousands of its members have put their efforts on FOIA action item. There allways will be someone like you to complain about IV like this. So nobody cares what your post says.
1. They had to post the 485 pending list sooner than they anticipated because USCIS "one up"ped them by posting the info on their website and hence they were not able to play "God" with that info anymore.
2. They got my ID and IP banned but still I came back.

I respectfully decline to believe any stories posted in here. Many and I mean many folks from my company have gone to India and come back with no hassled. In the last 6 months I have been outside the country thrice ( not to India ) and have not spent more than 1 min or answered more than 2 questions at the POE.

My wife's case was being reviewed by the Adjudicator due to error on part of USCIS in making a decision. The online status has just changed to post decision activity indicating
" We reopened this I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION on November 16, 2010, and are now reviewing our earlier decision. We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you"
Is it safe to assume that the case is approved? Any predictions on how long USCIS may take to get the EAD card?

I too feel that USCIS can not assign a visa to an application in wait until August 1st 2008. But again we are taking about USCIS and anything is possible. Even if it starts on August 1st, please do not keep your hopes high as August 1st is a Friday, and USCIS officers will take it easy on that day. I guess, the real action will start from Monday August 3rd.
However, what if we realize that not many approvals are coming through after August 3rd. I was wondering if we shall brainstorm on such scenario, and decide what should be our course of action in such case?

Thats regular window of 30days.. not that anything would change if ICPS (Integrated Card Production System) has some delays (god knows what is it , hope its not the only printer in Nebraska)..

I think different aides may be responding to the callers explaining the different experiences.
I called all the numbers- every one was very nice and either said they would convey the message or the congressman/woman is already supporting it.
Congressman Guittirez's aide said he would support it as long as there are no enforcement provisions in it. Can he spoil it?!

cos for the sheer fact you are a temporary legal resident. It might not seem fair to you but that doesnt make it an idiotic response. It goes back to the fairness of temporary legal residents (H1B holders) paying SS and medicare taxes. It goes back to the fairness of not being eligible for unemployment benefits when you lose your job.
I agree for this proposal completely. Why should people both illegal and non working temporary dependents be subsidized by my tax dollars.
This is the first time I disagree with you. When you pay tax, either you pay as an individual or jointly depending on your condition. Govt tax you less if you have dependents and more if you are single. Even if you have single person earning in the family but if you have multiple dependents, you are eligible for tax discounts (or in this case tax rebate check). There is no question of H4 comes here as long as you have one member in the family earning and you are his/her dependent.
What if you have an american with 6-7 dependent kids? Would you say that you do not want to subsidize him since he has so many non-earning members in his family. Same goes with an american women who wants to take care of her kids instead of going to work. How does that make it different from H4.

What is the form ETA 750B?
I filed for my labor in Dec'03 from Wisconsin under EB3. In dec 05 my attorney sent me the form 750B asking for my signature. That is 2 years later. Is this the form the attorney should have submitted when initially filing the labor certification?
I am still awaiting my 45 day letter.

It happned to me also I asked my company for file for me...They kept telling me that they have filed for 1.5 years...One fine day they told me that the DOL can no longer find my application.......Lawyer said she submitted the application and she dunno what happened...

I would like to add here that I really thank IV Core members for having taken this initiative, It is not easy to take up such a huge cause and try to drive it to completion, just look at the state chapters so few members have signed up and are taking an active part, we are the people who are responsible for making this happen and we should take active part in the efforts to achieve our goals.

just about all h-1b's getting rfe's and many, many are stuck in "background check". This is just a cop out by uscis where they are investigating companies use of h-1b's (this is reason for slowdown in processing times ) by vermont service center.
uscis caught many companies in fraud - also consulates - many companies giving internal projects, etc. or fake purchase orders and getting caught by department of state which then forwards to U.S.
ICE is making visits to consultants homes to verify where they are actually working and comparing to h-1b's.
Next; investigations will start with greencards.
I warned last year; that all the noise everyone was making about h-1b's and greencards was going to eventually get hit back by government agencies. Now; we are seeing this.

I think the fairest and easiest solution for the current EB applicants, who are stuck in the backlog, is to grant them greencards right away or at lastest within 1 year after the CIR passed. There should be no limit, no duplicate reviews for the current backlog/pre-adjudicated cases. Once the current backlog is cleared, the new rules/CIR can be implemented.
Think about it... those illegals broke the laws and we have complied with the laws. I am not saying that illegals are not human... but the government should clearly demonstrate a preference for law adherence. Otherwise no one will ever respect American laws. In addition, simply removing the per country limit and recapture of lost visas may not serve us too much good considering the tens of millions of new application coming in. USCIS and the State Department certainly do not have the resources to process all the applications and the current backlog will grow bigger and bigger. The final result? Our application will be lost in the illegal tsumami. :(
So again, they should grant green cards to people in the current backlog right away without questions asked if they want to legalize illegals. :cool:

Thanks Sandeep, I did a recalculation and the Eb1/2/3 wait times for India/China come to almost the same as it is today with the 10% limit
EB1 - 2 yrs

Eb3 - 9.5 -10 yrs.

You yourself had stated that you have second appointment after 30 days. How can this INS doctor certify an event that is going to take place in the future. He wants to complete the second one and give you the sealed cover. Fair and squre.
However, it beats me why you need two MMRs. Any person after 18 is given only one booster MMR, that also generally not recommended. They do antibody titre for MMR and give certification that vaccination is complete.
Do your DD.
Did anyone take thew MMR, tetanus from PCP and toolk the records for medical exam? I did that but the USCIS doctor wants to give me the 2'nd shot of MMR in less than a week. He says otherwise my vaccination is not complete. He doesn't care even if my PCP clear writes that I have one more appt. in a month for the second one. Did any of you guys face this? I think the doc. wants $$ from me. THanks for your comments.

After my vacation, I returned from India to US on last week of Feb through EWR. Officer at POE asked so many questions and I had a hard time answering them. And after 5 mins of drilling, he let me in. He never said anything about recession or why did I want to enter US at this time. I hope whatever discussed here is rumor.
