Today I got a call from an officer in "immigration and customs enforcement" asking for an appointment to visit my residence for checing my immigration status.
I am on H1B visa.
I would appreciate if someone could give any sort of information related to calling for a home visit.

Further to my above post, I have following questions
1) Once the client side project is completed (assuming the employer is paying to employee), how much period we can stay waiting for a new project? Is there any limit of the period?
2) Once the pay from an employer is stopped, with in how much period, one has to go to home country? Is there any limit?
3) Can an employee stay (assuming he is getting paid) with out client side project and working on skill upgrade and waiting for a new project?
4) What are the documents I should be ready with? I am staying with my family.

I am in the same situation as you are, hoping to file EB2 with a dependent who aged out just after EB3 filing. My lawyer yesterday (Fragomen) confirmed that the dependent will get included in the EB2 filing.

Are they going to approve cases which was filed during July 2007 with 2006 or 2007 priority dates, if they fall under namecheck issue.

I am one of the unlucky ones on EB3 india who missed the july 2007 bus. With my PD under EB3 India, I know I am looking at 10-15 year wait. So I am planning to switch jobs and apply under EB2. I have done some research and I know that the position and the qualifications both have to match to go through in EB2. Those have successfully ported from EB3 to EB2, Can you guys throw some light on whether USCIS has any specific requirements like salary, previous holders of the position etc etc for EB2. Also, if i apply I-140 under EB2 with the new employer and pay 1000$ from my pocket for premium processing, are there more chances of rejection/RFE due to premium processing?Pls help me get out of the EB3 shit.

This is my first post. I worked my ass off to get a favorable
solution for retrogression during the budget bill. But as everyone knows it was defeated in the house reconcilation. I'm not being pessimistic but my gut feeling is that eventhough senate comes with something, the chances are slim that the house would agree to it. Sensenbrenners bill which house passed has no provisions for EB immigrants and backlogs. I'm pretty sure all of you are aware of Mr. Tancredo's fury against immigrants too.
Having said that I dont mean we have no way out. We have to work very very hard. We have to raise money and do some hard lobbying. But above all we have to get our employers to back this issue. With all of the above reasons I think it might be a very bad idea to guess we would have any favorable legislation in a shorter span of time. So we have to plan something for a longer period of time and execute it very diligantly, I guess.
I think Immigrationvoice is on the right path... Lets face it people!!!

EB immigrants are not a hot political issue with the House, when the illegals are. Nowhere do the house representatives, except Tancredo and the likes, voiced their opposition to expanding EB immigration and providing some sort of relief for people caught in the backlog. I believe that the immigration provisions were dropped from S.1932 just because it was a wrong bill. The pork got chopped off and this pork was too easy to compromise as there were much more important issues to fight for, like drilling in Alaska and Medicare. This bill IS about immigration issues and is about border security issues as well. The fact that Frist's bill drops the very controversial guest worker program can be considered as both a good and a bad thing. It is good since the bill will sail more smoothly through the Senate and hopefully the conference. On the other hand it is bad since Senate representatives in the conference now will not have this guest worker program to trade and drop when House reps will demand to drop something off the bill. To my understanding the way the conferences work, they need to meet somewhere in the middle in between the versions of the bill and since we have the very minimalistic bill passed by the House it is the Senate which will need to compromise and drop provisions from its bill.
But taking the guest worker program off the bill is a good start I guess.

What does such a response mean?
To me, it is evident that IF the action is clearly defined AND some one has a clear mandate, then people will come together to participate and contribute.
I am tired of hearing how the loopholes in the immigration system are taken advantage of. If we focus on increasing the cap for Indian EB category [across the board] and recapturing the lost visa numbers, then the remaining problems will take care of themselves. For this, we need to lobby until we get a reform legislation to pass.
And for people that are furious that a very small percentage of folks are taking advantage of the system, i urge them to look at the majority of the people that are leading a honest life and take solace. You are not alone in this journey. And don't let lack of GC put a damper on whatever you wish to do. Get creative and make use of the same legal system to achieve what you want. You are in the same framework as those folks that are taking advantage of the system are. Work the system in the right way.
I have neither met a honest person that has ultimately lost nor a dishonest person that has ultimately won. Please have some self-confidence and self-respect and keep fighting for what we truly believe in. When you hit a low point share your experiences with others here - in a productive manner.

Starting July 16th, 2007, labor certification has a 60 day validity period. Meaning, a I-140 petition needs to be filed within 60 days from labor approval date....If immigrant visa numbers are unavailable (dates retrogressed), you wont be able to file your I-140/I-485 concurrently but you can file your I-140 petition irrespective of your priority date as long as you have a labor approved. You dont have to apply for your labor again and again....Its just that, once you get your I-140 approved, you will have to wait for dates to become current to file I-485...

Anyways, your "assumption" that majority of people are against reputation system is not correct. We see these threads occasionally but it seems almost everyone give reputations. If you are against a system and you have a choice not to participate in the system, would you still participate even if you hate it and can chose not to participate? The participation of almost everyone is a testimony to the fact that majority opinion is not against reputation system.
As far as -ve personal messages are concerned, you have the choice not to look at it. Why not exercise that "choice" and not put the burden on someone else for leaving you an obnoxious message. Its like you are searching for bad information about yourself and as soon as you find something, you start complaining about it. Good that people cannot look into the mind of everyone else otherwise you will ask some mechanism to erase those "wrong" thoughts from their brain. I mean is there an end to this thing?
Have you heard of the word - Hypocrisy. Well, that’s that I am calling here. Why do you keep looking at your reputation and -ve messages if you don't care about it? And if you don't care about your reputation then why you continue to look at it every minute, and complain about it. Either you care or you don’t. It can’t be bother at the same time. And I am choosing to express my opinion for this senseless behavior as it irritates me. I hope you agree that I can make that "choice" to express, I mean you may want to check with Chris Hansen before saying "yes".

Which is that people giving reds are usually (though not always) doing it as a personal attack (you suck, F*'s etc.), whereas every green that one receives is usually on subject matter (I have not seen a "you stud"!! kind of +ve reps ;) ).
Also, what it wrong for people to complain about the system? If people have the right to give reds, why shouldn't the forum be allowed to complain about it? And if the popular opinion is against it, then the system can be dismantled.
At both ends (the extreme left and the right) it is always "my way or the highway". Neither one recognizes that there are people with different view points, and that everyone should be given an opportunity to air their own views (live a life of their choosing etc.).

We have shown the CA (Chartered Accountncy) equivalent to both a US bachelor's degree and a US Masters degree with an expert opinion letter. As far as I know they have all been approved. We have detailed research and we suggest the attorney cite it in the brief as well because that makes the case even stronger than just citing it in an evaluation or expert opinion letter.

This is what you can do - Both in Mumbai and in Delhi, you have USCIS approved doctors who help people going through CP. In other words those who choose to go through emp based CP or family based Green Card which US embassy issues, go through Indian hospitals in Mumbai and Delhi. I think Gangaram in Mumbai has this facility. Ask your wife to get it done from there. Do not wait till the last moment, as someone pointed out, a slight delay in flight could............
