Sorry to hear your situation. If there is a concerted effort from someone in the IV community, i am more than willing to be a part of it.
For now, i will try calling my local senators and explain/highlight this problem.
PS: I think this is a much better use of our time than trying to guess the next bulletin dates.

Has most people here already got their Green Cards? It appears so looking at the lukewarm response here!
Make no mistakes. CIR is going to pass in a year or two with or without EB Recapture/Visa increases. If we continue down this path of inaction and expecting others to act on our behalf CIR will pass with just the H1B increase to mollify the business community.
Anyone not participating in the Rally, please don't whine here if CIR passes with no EB increases/recapture. Don't blame IV, then, for your inaction. You want to see the real person to blame, just look in the mirror.

I guess we all are fine with that and will still live in hope and hey lets start a fight over eb2 v/s eb3 or if not that lets try demeaning each others posts or if our porblem is still smal lets talk about Shah Rukh Khans being stuck for over an hour....I think doing all that will get us our gcs pretty soooon....

Then why exactly is anyone going around asking questions about this get banned? The evidence is me - I was banned for just asking questions. I have no "scores" to settle and I do not believe in this so called "organization" which rakes in thousands of dollars and does nothing. Where is all the money going? People get banned foor just asking questions like these and even for no reason whatsoever. People, just wake up, your green cards will come sooner or later. You do not have to pay someone to "fight" for you to get a green card. After paying all this money, where do you find yourself? You are in the same place when you started. It does not take a rocket scientist to realize this. I understand that this is a place of comfort for someone who is affected by the whole green card situation but why not leave it at just that? Why does this "organization" collect money and not disclose where it is going and act like fascists by banning people asking questions? I do not see any section in this website that has the accounting information like any other "nonprofit" organization. Why is it all that secret?

The attorney Rajeev Khanna explains about the interpretation taken by INS/NSC of bachelor degrees which are of not 4 year duration. NSC takes the stance that one cannot combine degrees/diplomas to be equivalent to a 4-or-more-years bachelor degree. NSC argues that a case to be considered as EB2 with BS+5 years exp, that person should and must have a conslidated one bachelor degree of atleast 4 years. You can listen to the first 15 minutes of the mp3 file of conference call of dated Apr 19 2007. He explains the matter clearly.

But most people who talk about 3 year degree rule are talking about an actual 3 year degree program(like BSc/BA/Bcom) in India. My degree is a 4 year degree but allowed to be completed in 3 years because of our advance standing by virtue of completing the diploma in the same fields of Engineering.
It is a regular BE/BTech program in India (if you are familiar with them)

hello guys
I was returing after 3 weeks vacation from india and i went for stamping at new delhi adn got 3 years h1b ( this is my first h1b ext ). At POE officer was rude and he told me that he knew that I am not working as what my docs says. I gave him all letters and all that still he was saying that where did i get computer traning ??? etc.. I told that I have MS in Com Scie from USA but still he was rude and even I had valid stamp for 3 years he gave me only 2 years of I 94. when I asked how to get that one more year he simply said exit and re enter OR talk to ACS ( may be he means USCIS )..
so it could be true taht people may be turned back at POE.

What u have stated is factually incorrect. After you get EAD and you have completed 180 days after filing 485, yes you can use AC21. However, your statement that employer cannot harm is wrong. The employer can still withdraw you 140 and then use the labor for someone else or keep the labor. Once 140 is withdrawn, your PD is lot. You don't have a PD. When your 485 comes up for approval, no one seems to know how USCIS will treat your file. Well, if you don't have a PD, unless your category is current, they cannot approve.
Well for India, EB2 and EB3 i am not sure if it will ever be current.

I agree. Life on EAD/AP is just as if you had a green card - except you can not start your own company. But one can keep changing jobs, promotion etc. The con is that one has to apply for EAD/APs each year meticulously. If the employer is paying then even that is a minor irritant.
But as the saying goes the grass on other side always looks greener. Once you get to file 485 and get benefits of AC-21, one wants the green card, and then one longs for the Citizenship to get over the hassles of keeping documentation at all times. Once one gets citizenship people then forget about others in the queue and soon forget the trials and tribulations they underwent:)

Please also consider the fact that there are some of us who have to file EAD after we get the 485 receipt. Our lawyers/companies didnt file EAD with 485.

I would be in the same situation but the companies which did not let their employees file EADs in the first place would not be willing to provide the Receipt notices to them. They will instruct their attorneys to hold on to the RNs or and not give even a copy to the employee.

Adjudication is a continous process for uscis it is happening everday if visa # is available. I donot agree your IF...and explanation of SMART (If USCIS is smart they would not act till September bulletin is published around Aug 12th so that they get the time to adjudicate all cases till September 30th before EB-2 India gets retrogressed again).
No govt agency works that way.
You will see approvals right away from Aug Ist for "ripe" and 'Low hanging fruits (your 1 and 2)'. Sure everbody is anxious and interested in interpretions but stressed out....may be not.

Does anyone know when this FBAR thing started? I have never filled it out and I am sure I had > 10K $ in Indian banks for the last 3-4 years. Do I have to send some kind of amendment FBAR for 2006 and 2007 also?

URS/Treasury says that they worry about only people who are hiding money and not the one who goes and declare volunteerly.
They started little more aggressively this year and you know that most of the countries are doing this nowadays to get the hidden money from Swis.
The money you have saved in FBAR is nothing compared to 50 million saved in Swis by some big fish.
It is important and the awareness of FBAR is increasing, So correct it this year and do not wait for next year.
A good sign is, IRS extended time for filing this year and use it. It may be a OPEN WINDOW for everyone who missed in previous years.

AP renewal should not need FP again. Sorry what is SR? Also, I was given the understanding by a lawyer that USCIS may not even speak with you if your date of submission of AP is not within the currently posted timeframe. Going by that, you certainly did well.

But I got email from German Embassy - its required now and its recently changed. So add $150 to your ticket. 92 for transit visa fee +$20 for them to post your passport back + $10 for passport size photos at Costco + you have to go and post your application.
Would it be nice for them to publish it on the website on April 5th itself. I booked the ticket on April 30 and it wasnt there. I did everything right. I still dont know what I did wrong.
I followed all the rules.
I again called the airlines - its non refundable. I hope this helps people decide not to fly Lufthansa again.

my intention is not throw water on your expectations, but if you read through definition of what PDA means it also says if a case is being revisited after denial its also pda instead of initial review. for pda which says NOTICE SENT it is generally 2-3 days.

It is the GPO's responsibility to list all items passed by the senate and not by the house as unfinished business. This unfinished business can remain unfinished indefinately..The fact that it is listed in the calender does not mean nuch...It is on that calender from May 11th...Most likely it would die with this congress...
