I have used AC21 and have not sent a letter yet to USCIS as it is optional and that is what my attorney recommended...that is to wait for an RFE (I have changed address as I moved to a diff. state; chances of an RFE increases)
That said, I am wondering that with a G28 representation on the files with USCIS, if I send a AC21 letter all by myself (without attorney), will it be honored by USCIS ? I am comtemplating of doing this as I wanted to prempt the RFE thereby saving precious time (when date is current) and the money that I would have to pay my attorney when the RFE reaches him (I would rather he reply to an RFE but want to give my best to avoid it)
any ideas ?

I received an RFE too in Nov 1st week. It was about the evaluation. (It was submitted earlier but still) Lawyer mailed them the required document and now the status has changed to "We received your response to the request on Nov 14th and the case processing has resumed".
How many days does it take them now to make a decision? (Btw I am EB3 and my 140 submission date was Nov 2006)

Thank you all for providing some excellent information. Special thanks to members waitnwatch and fromnaija for providing Arizona specific information. I certainly think that I should take this further in light of all the new information. I even talked to my GC attorny and he also thinks that I should have have given resident status.

The pdf file in your post indicates that you would qualify for in-state tuition if you have filed for GC. How does the university determine that you have filed for GC? After you have filed for labor or filed for 140 or only after filing of 485? Those 3 dates could be years apart and depending on how the university defines that you have filed for GC could determine the residency status. If you have any further information, please share.

Because of illegals granted amnesty any legal immigrant filing after Apil 30, 2001 faced longer waits and backlogs because they consumed the existing quota of immigrant visas. In essencem legals were penalized for obeying the law and standing in line.
Let's do a poll to see how many EB3IND folks will be willing to be a party to a class action lawsuit to provide relief. Obviosuly if the lawsuit prevails the plaintiff's pending GC applications will be approved. GCOP, mirage or anyone else- want to put up a poll (i don't know how to do it)
This might be a better option for many who cannot do a Writ of Mandamus lawsuit

My I485 is pending, recently I have changed my address online. I also recieved confirmation letters for this address change.
After 2 weeks of address change, USCIS issued an RFE. I have not yet received it, but I just want to prepare for this.
What could be the reason for this RFE? Is it common?
I have seen changing address triggered RFEs in some cases where an applicant moved out of state or even to a new city within the same state. In such cases, RFE was asking for proof of employment in the same or similar role.

yes, my I-140 is approved. If your old employer revokes the I-140, as part of the processing of that revocation the USCIS *might* issue an RFE or NOID asking you for an updated employment verification letter. Per my attorney its more likely that USCIS wont do anything to the 485 right now, but will check the status of the I-140 while processing my 485. As part of preadjudication it might happen earlier, but also possible that it will only happen when my PD is current or almost current (July-2006/EB2/India). At that point we should get an RFE, and thats when my attorney plans to inform USCIS about the AC-21 change of employer.

The Swiss do not break down the source of the Indian money and it could all be EU accounts of Indian companies that have operations in Europe. We just do not know. As Switzerland has the lowest tax in Europe, a lot of companies with operations in Europe have accounts there.
If India had sensible policies it could generate Trillions of $s and this 1.4T would not matter.
I am trying to start a Pvt Ltd in India and it takes about 40 days and $3000 to get started. In MA, it takes a few hours and less money despite the much higher lawyer fees here. No wonder the country is poor. It is not the corrupt people but the honest (but incompetent) people who do more damage by slowing the pace of business.
The path to hell is paved with good intentions.

You have to stick to Software Engineer field in order to take advantage of PD recapture. If you move to Business Development using MBA than its hard to justify same or similar. Find a new job which requires EB2 and show BS+5 to qualify.

what option you used to call? my case is similar. but both labor is mine(one stuck due to auto remand). I want to know if interfile is automatic or not? I am candidate for layoff this month end after 7 years of job in company. I also want to call to USCIS know.

A few days I called Comcast to disconnect CNN and CNN headlines from my cable. The Comcast representative was surprised as to why I want to cut CNN. She transferred me to her supervisor. The supervisor noted down my complaint and said that he will get back to me in 3 business days. Next day I got a call from Comcast that they will block CNN entirely from my cable. Now, if I switch my job and the new employer is not ready to transfer my H1-B, can I use my EAD to work(provided my I-140 is not revoked by the previous employer)

No I did not. Because my attorney did not ask me to do so. But, after I got my GC, they emailed me some instructions on what to do and what not to do. In that list they had this instruction to carry my GC with me all the time in BOLD.

My wife did her MS from US university and is currently on OPT working with a small US Oil services company in Texas. Her OPT ends next May.
Question:
Can a non E-Verify company file for H1 visa?
Can a person extend their Drivers License in Texas during cap-gap? My wife's OPT ends next May and if her employer files H1 visa, can she work from May till October and extend her drivers license also?

There were about 600,000 AOS applications including the July and August filers. So that number less 60,000...roughly about 540,000 applications still pending with USCIS....
