Pappu,
Do I need to post my question on this thread or I can pass it on before in time to StarSun or you? B'cause posting my GC issue with personal information would not look appropriate on a public forum.
Let me know.
If you have privacy concerns (you should not be as everyone is identified only by their usernames on IV forum) you can email starsun and then be available to ask it yourself in the call

1. I am a US Citizen living in India?
Yes
2. If I am a GC holder living in India?
No (Yes if the person resides is in the US while claiming SS benefits)
3. I am neither a US citizen nor a GC holder living in India?
No (Yes if the person resides is in the US while claiming SS benefits)
Even with 40 credits it is not possible for Indian nationals to get SS payments in India. If you look at the rules closely on the SSA website, there is no simple way to get benefits paid in India unless you are a US Citizen. You must be present in the US for that
Refer to http://www.ssa.gov/pubs/10137.html, #2 and #3 WRONG
What happens to your right to Social Security payments when you are outside the U.S.?
EXCERPTS RELATED to 40 CREDITS COUNTRIES
You are a citizen of one of the countries listed below, and the worker on whose record your benefits are based lived in the U.S. for at least 10 years or earned at least 40 credits under the U.S. Social Security system. If you are receiving benefits as a dependent or survivor, see additional requirements.

Additional residency requirements for dependents and survivors
If you receive benefits as a dependent or survivor of the worker, special requirements may affect your right to receive Social Security payments while you are outside the U.S. If you are not a U.S. citizen, you must have lived in the U.S. for at least five years. During that five years, the family relationship on which benefits are based must have existed.
Children may meet this residency requirement on their own or may be considered to meet the residency requirement if it is met by the worker and other parent (if any). However, children adopted outside the U.S. will not be paid outside the U.S., even if the residency requirement is met.

We have limited time and we have to achieve a lot. Our time and efforts should be utilized in a much better way, don't you agree? I appreciate your posting of your links. And what is your point? Include as a small comment or note at the top. It is easy for any one to 'google' conference, immigration and bill to come up with a few thousand good and relevant link. If I post a good number of them, one would definitely be lost.
Posting links should serve a purpose here. The primary purpose is achieving IV goals. A smaller purpose could be to see what the other side is saying, but my suggestion is to ignore them in general.
I went to both the links; one of the I understand is a Libertarian organization and the other radical left. As anyone can see, they don't represent the views of mainstream America. So, it is a waste of time and effort and above all a distraction here. That's my advice.

Yes if you look at cnn-ibn you may see such a heading .. but there are thousands of vernacular language media that 90% of its population read everyday and even completely indian English media which is celebrating Diwali just the way they should. Yes foreign investments are there but they are not as big as they are made out to be . If Citibank would like to invest today whom will it invest with - GM or Tata Motors? Money is just something that change hands and flows where there is the greatest potential.India has her strengths and it will beat the odds.

Hello Everybody,
Due to budget restrictions, I may be getting laid off from my company soon. I have filed for I-485 and have received EAD. I am currently on H1B. I have a citizen friend who runs his own company. He has no employees. He does pretty much all work by him self or get it done by hiring outsouced help whenever needed. He has a legitimate company - but he does not have big revenue (May be 100K/ year). Would it be okay if I join his company on EAD to get my GC going or should I look for a firm that employs lot of people and has sizable revenues. What (if any) are any risks?
Thank you.

3000 seems to be an average number.
I have been on H1B for 3000 days so far and I am still waiting for GC, (filed for 140/485 in November) and I thought I have been waiting for too long, but it looks like one of these people might actually qualify for Guinness Book.

against the mouse, press it against your forehead and think about the benifits that you milked from this country".
Lot of people didnt milk much benefits....only people who came on F1 and worked as RA/TA probably "milked"
from US
Rest who were working on H1B paid all the taxes same as any american and
got no returns for it.
A whole lot of people milked from "H1B" workers
As a matter of fact H1B worked for far lower wages than the market forces
would decide thereby keeping the cost of IT infrastructure support for the
financial services, insurance, retail etc low just as mexicans work for
below min wages to keep the cost of maintaining the infrastructure low.
Corporate America knows this and thats why they always shout for H1B
shortage , they NEVER shout for EB visa shortage or just do a lip service
because it looks bad.

Relax. Take it easy. What makes you so angry. People are just expressing their views.
I apologize, I got carried away,
It is just some people posting such negative views, it breaks everyones spirits.

From what I understand you can only and still will only be able to file I-485 when your PD is current. Now, if you belong to rest of the world EB2 the moment your labor clears your PD is current so you can file at the same time I-485 and I-140. In future you will have to delay the filing of I-485 for the three months that I-140 takes to clear (if your PD is current the moment the labor clears).

What will be my status after i file my I485?
My current I-94 will expire on 16th Sep 2007 (on the day my current visa stamp in my passport expires and my current H1 B is set to expire Mid April 2008).
I am planning to make a trip to Cannda or someplace to get a new I-94 as soon as i get my new passport (i had sent it for renewal on june 2nd). But i am a little worried about my status if i am unable to make the trip.
So my question is what will be my status after 16th sep 2007 (once i file for I485 (first week of July2007) and my I-94 expires on 16th Sep 2007)?
Appreciate any responses ...
Your question is not clear but when you say I-94 I assume you mean the I-94 that you got the last time you entered the country, right? The expiration date on that has nothing to do with your status as long you have an approved I-797 for your H1B extension till April 2008. You are in status till that time.
But you do need an unexpired Visa stamp on your passport if you leave the country and want to come back to the US.
So the way I see it, even after filing 485 you will continue to be in status till April 2008 and then I am sure you will extend that for another term if your I-485 is still pending.
As for going to Canada to get a new I-94, it may not work because they do not make you surrender your old I-94 when you go to Canada and so therefore do not issue a new I94 when you return after a short trip to Canada.

no EAD will just be the basis for her SSN. it will just hurry up the process. What status she will be in will be determined by the I-9 form that will say H1.

This is correct.......once the employer revokes H1B, that is a red flag for the immigration officer. Officer may or may not ask for evidence. Be prepared to show a same or similar job offer.
Thanks.Last year my GC sponsoring company canceled my H1B once I got EAD.I didn't get any RFE.
