Medical exam results are valid for one year for filling. If USCIS accepts your application with exam results. they will remain valid till your case is decided.

Being half indian/italian i can see the indian pessimistic nature rearing its ugly head about the May 21st date,there is no bill signed yet,but still everybody is acting like its the end for anybody who has not filed 1-140.I talked to my lawyer on Thursday and he said that if CIR does pass there is no way USICS can deny an approved or filed 1-140 and there has never been any immigration law that affects retroactively to existing filed applications.Imagine all the lawsuits of people who have spent money getting there LC and 1-140 approved.
Next week i will be filing 1-140 and 1-485 consecutively and i am sure there thousands along with me who will have a class action lawsuit if this stupid rule actually see daylight.
Chill out and think positive plaese(i waited 6 yrs just to get my LC certified so i know what suffering is).
Worst case scenario, senate will pass this bill, the house will pass this bill, the president will sign it and then someone from the USCIS will come by and tell em you're a bunch of jackasses, are you effing kidding me, you people are so goddamned detached from reality, go back to your rooms and come up with a better pile of horseshit than this, your time starts now.

while i am waiting for response, i need to explore my back up options.
i need to finish my MBA before i leave this country. I was on my H-1 8th yr extension in 2005. after that i have been on EAD.
My wife is on H-1 but i think she is on extension based on 3 yr extension of my unfortunate 140.
Can I switch to F-1 status next year?
I understand you start accruing illegal time while MTR is pending and if it gets denied? So i don't want to take that risk.
I know i don't have any options, but any suggesstions...
can she apply for labor/gc? i'm sure her extension of h1 cant be revoked. why dont you swtich over to h4 until you graduate and apply for canada pr as well until things work out

You will be okay. Don't worry too much. Just submit your paper work and relax! I have the same education like you. i.e 10+3(Eng Diploma)+3(B.Tech)+2(M.Eng). My labor called for MS+0. I got my 1-140 approved last year at NSC under EB2.

I think this is a great thread to alleviate people's concerns about travelling out of the country. I returned on 22nd Feb using AP and it was painless. The immigration officer saw my AP, took my picture and prints and that was it.

USCIS is fine. My lawyer is one of the prominent immigration lawyers in USA and his staff had advised this. Anyway, if you have doubts, then it is best to speak to USCIS. They would help you out.

same here eb3napa, every time it goes to TSC, infact, for the time I am waiting now (look at my PD) TSC knows me as a regular customer (read it as bakra) for AP and EAD renewal every year for 3 people in the family. this time the freakin system sent our applications to NSC and i am worried now, since I have made my travel bookings for november. Can I go after 90 days and show them the air tickets to expedite or get another AP in the local service center?
It is taking a lot longer than the last couple of years. I filed mine end of June, normally TSC would have approved it by now. Unfortunately this time it was transferred to the evil NSC and I am still awaiting an approval.

hello guys
I was returing after 3 weeks vacation from india and i went for stamping at new delhi adn got 3 years h1b ( this is my first h1b ext ). At POE officer was rude and he told me that he knew that I am not working as what my docs says. I gave him all letters and all that still he was saying that where did i get computer traning ??? etc.. I told that I have MS in Com Scie from USA but still he was rude and even I had valid stamp for 3 years he gave me only 2 years of I 94. when I asked how to get that one more year he simply said exit and re enter OR talk to ACS ( may be he means USCIS )..
so it could be true taht people may be turned back at POE.

If children are in "Status of Adjustment(I-485)" there are not effected by this aged out issue. What do they need when they go to college?? appreciate some pointers??

One thing that most people here do not understand is that Universities have only two different categories for both admissions and Financial Aid: GC or Citizens get normal treatment. Everyone else, whether they are on AOS or H4 or any other status are considered International Students both in selection process and for Financial Aid. It is very simple - International Students are Not Eligible for Any Financial Aid. They will have to pay Full Fee, which is about 50k/yr in good Universities.
If DREAM Act covers Legal Kids, it will cover those in AOS too, which will enable them to get GC before their parents do and be eligible for selection as a local and for the Financial Aid that locals (GC and Citizens) are eligible.

Well I have a good friend of mine EB3 INDIA also whose PD was October 1998 ie 3 yrs before my PD of August 2001. He finally got his GC 4 months ago in June 2008.
f) If you EB3 India by the time GC process is done there is 80% chance you will be either 1) diagnosed with Blood pressure medication before you get GC 2) become a religious fundoo 3) dont give a rats ass anymore.

I spoke to rep at NSC today he said my case is clear and just waiting to be adjuducate based on RD..but when i asked him about the name check he said he do not have an access to that however he again said the nothing is holding up my case just a matter of RD...so what can i interpret based on this is my Name check has been cleared or not?:confused:

Immigrants has no rights in whole world.. even for Banlgadesis in India or Indians in america or anywhere else ..
With globalization of market gates should be open for highly skilled people. There should not be word "Immigrants" or "Alians" for highly skilled people. Markets are open for businessmen why not for highly skilled people..
