i applied for EAD on Dec 21st, got card ordered for production email on Jan 21, and got the card via USPS 2 days ago. My PD is just few months away from May 2006 (EB2), but I still got 2 years validity (on the EAD card).
I cannot possibly imagine the fact that PD wont move even a few months when spillover begins.

News Clips won't help much. Better to get some documents from your Company that shows it really is on the downside like financial statements. However, make sure you also have a proof that when they applied for I-140 and you applied for GC, the company is still in good financial status; that is was only later that the company suffered losses.

Well what can I get from them? The letter the company send on June did not say I was working for them in that moment. The letter said that they will have a job for me when GC was approved, but they heavely depend on those mortage loans and they have not sold houses in some time.
They did not have job for me when approved.
The promise can not be fulfilled because of bad bussiness.

Any idea of how many number of I-140s ? May be 50000+. It looks like it might take at least an year to process these I-140s in NSC/TSC. TSC is faster when compared to NSC, where the priority dates has not been moving, at least for EB1/EB3. What do you say ?
A trivial question: Do they process I-140s based on labor filed date (priority) or I-140 filed date ?
Hopefully they will reinstate PPS for I-140 after they are done with receipting the July/Aug applications.

Yes its good USCIS have revenue to hire more people to process our applications. Well said.
It makes no difference whether they allow concurrent filing of 140/485 or not IF YOUR EMPLOYER IS WILLING to pay extra premium processing for 140. IF not , it makes minimal difference (2-3 months delay). Earlier this year, people were getting 140 approved on 6-8 weeks average without premium fee.
If your date is not current:
This rule makes 0 difference. File 140 and wait for approval while your date moves forward. Once its current, file 485.
If your date is current: File 140, regular processing 2-3 months and then file 485. If you can get premium processing done then it would be 15 days and then file 485. Either ways, you are delay in filing 485 by 2-3 months. In the grand scheme of things, its negligible. It would take even 2 months for your lawyer to get the paperwork straight for filing 485.
So please relax, this new rule that does not allow concurrent filing of 485 and 140 is not earth-shattering. Its a revenue generation move. And its good as long as revenue stays in USCIS as they do need revenue to hire more people to process files faster, which is in our own benefit. All you need is the job title and the duties for AC21. At the time when we filed your labor application, we did not use SOC code. The code was assigned by State Wage Unit when they determined the prevailing wage. They did not care what the job title was. Rather, they determined it based on the acceptable field of study to maximize the salary required. Consequently, it often did not match with the job title on the application.
Like I mentioned above, the occ code as assigned by SESA may not match the job description on the application. It is the risk you will take if you followed the occ code to find your job title and/or skills.

How many copies of RFE do they send? i mean do they only send one RFE notice to Attorney or do they send one RFE notice to Attorney and a copy to employer?? Can somebody tell me..
Only one copy is sent to the attorney.....If you applied under premium processing, USCIS faxes a copy to the attorney before mailing the RFE hardcopy....

The issue is that my company lawyer said that there will be a need for a visa stamping done for the extension because of the Last action rule. The murthy forum reference is something I dug up via google.
Because the extension will be for a future date (March 1). Current visa stamp is till Feb 28, 2007. So if the officer gives a new I-94 with Feb 28, 2007 as the validity date, the attorneys claim that it will invalidate the approved extension due to a "Last Action Rule".
It is hard to trust these corporate lawyers.

I have a Ph.D and 2 M.Sc in Aerospace and Mechanical Engineering. I got my H1-B and I also have been employed for 3 months now. My company policy required 3 years before sponsoring me. I do not want to wait that long to start applying. How can I tell if I am qualified for EB-2 with National interest waiver? Is that the only way for me to get GC?
I also want to mention that I have 5 proceedings papers but not journals. I also do not have any citations for my proceedings papers.
Please advice me what is the best senario for me and if I have any chance to apply for EB-2 with NIV.

There were speculations that AUG bulletin will be released at 1 AM EST , then 2AM EST , then 10 AM ESt , then 11 AM EST....
None of the speculations came out True - Anyone has any idea when AUG Bulletin will actually come out ?

Lets say her H4 expires on Apr 10th 07. If her I 129 application is filed on Apr 1st, Do you think her I 129 is considered to be ok? Again, USCIS wont be able to generate a receipt notice with in 10 days and assuming that the receipt notice will be generated after Apr 10th, what kind of impact will it have as her H4 would have expired by Apr 10 th? It looks like the bi specialization program is causing more delays because the cases need to be transferred from VSC to CSC. As Andy pointed out, there is no guarentee service for H4 approval with PP.

Last year, his h1 under PP came in 2 weeks as clockwork and my H4 case got separated and was processed in about 5 months. I also had RFE and they wanted to see hubby's H1 they approved under PP. :mad:
I felt awful after that, :( just waisted my time and $$$ .
So, I think we may specualte that since there is PP available for H4s (recent phenomenon), we may see more cases where they would process only H1 under premium and H4 as standard.
But, folks, $$$ amount only goes up. You will shed 2K for your extensions under PP and then process her H4-to-H1, additional couple of thousands..
Don't know what to tell you really...
