There's a possibility that Harry Reid might lose the Nov election but Democrats will maintain a slim majority in the Senate. In case that happens, Durbin and Schumer are the frontrunners for the Senate Majority leader's job. Schumer is not entirely trusted by the unions because he is seen as being too close to Wall Street and the business lobby while Durbin has solid working class/protectionist credentials. This is Schumer's attempt to bolster his image as a friend of the unions.
Obviously, it's morally wrong to rob Peter to pay Paul but no one thinks that the Democrats are the party of saints.

i called the office and asked about license renewal which is coming up next month, the lady over there told me that if you have valid michigan drivers license and social security number, we will renew it now but there is no certainity for renewal afterwards. She told me that temporary permit will not do, you need to have valid michigan license.

Some of you have expressed your opinions and stated that people from india with bachelors degree are more important to the economy than EB-5. I dont think so, a company may outsource software jobs to third world countries but i am sure Americans will continue to need agricultural laborors, daily wage workers, workers for snow removal, waste removal...etc on a ongoing basis. They are more required than software engineers whom they can find in India for real less.

One idea on top of my head is that the core group along with the lawyer can take appts with the senators concerned and explain the problem, or if that is too hard make a clear draft and mail it for personal delivery to senators office with all our endorsements.

My attorney received the letter from BEC 2 weeks after I saw my case status as "certified". He told me earlier that the physical approval letter/notice is required to proceed with the next steps and he couldn't proceed with the paperwork only with the online status as certified.

Asking for dates to become current given this increasing anti-immigration sentiment turns out to be too much. It is OK expect that greencard takes 2-3 years to get completed. At least I think that way. Moreover, remember that as long as mistakes with amnesties are not repeated, in few years that damn 245(i) cases would be taken care of.
Folks, in reality we don't need to pay lobbysts to go there and tell lawmakers that the SKIL bill is a good thing. There are very powerful lobbysts already doing that and they are getting paid by US employers, entities way more powerful than us. I don't believe that our cry for support on SKIL bill is a smart use of our energy and money. What we need is really a lobbyst to go there and fight to tone down those bills and stop the out of touch approach it has been in place since the S.1932 defeat.
What would be realistic given this atmosphere ?
1. Asking to elevate quota to 290K for EB is too much. Sorry. I would say elevate quota for two years to 290K, until you let the backlog cases/245(i) go back to more manageable levels. A recapture is also a very good option, since that sounds fair and unharmful to many, including Roy Beck (Numbersusa). I know because he e-mailed me saying that a recapture would be fair.
2. H1B increases from 65,000 to perhaps, what, 90K/year for the next three years, to be reevaluated by then ? Increasing this at 20% year simply doesn't cut it.
3. The idea of making advanced students self-petition for greencard would simply be shut down for good. Forget this one as well.
There are other things that I would be glad to discuss if IV core members are willing to send a lobbyst there to work on *our behalf* and finally represent us.

But the question is what is too much and what is too less?
In order for the date to be current or to remain current at least
300K + X Visas are needed X being the all the people whose labor
is cleared and who is waiting for I485 approval.
If all the unused are recaptured we will not get 300K Visas
( I guess ). So the minimal we might need would be
1) Quota Increase to 280K
2) Recapture unused
3) Do not count Dependents.
4) Remove country cap
I'm pretty sure that it would be really hard to get these much.
Any one of the above getting passed will not help us substantially. May be wait time will be get reduced an year or so.
We will be really lucky if one provision makes it to law. And we will be
REALLY REALLY lucky if Priority date comes to JAN 2004 after a legislation get passed if any.

Guys,
I need to travel out of US to get a new stamp for my recently approved H1B extension. However, of late I am hearing many horror stories which are giving me goose bumps. Apparently people having fully valid H1B stamps are being turned back from POE. The reason apparently being given is that US is not taking in any more foreign workers while so many americans are without jobs.
Is there any grain of truth in these stories, or is it just baseless rumor? I mean, why should immigration authorities object if the person has already obtained the visa stamp and company requires the person at work?
Has anybody else have heard these stories? Or is it another scare tactic of the anti immigrant league?

I need to travel out of US to get a new stamp for my recently approved H1B extension. However, of late I am hearing many horror stories which are giving me goose bumps. Apparently people having fully valid H1B stamps are being turned back from POE. The reason apparently being given is that US is not taking in any more foreign workers while so many americans are without jobs.

I have a theorey about when IO will inform you about name check. I think IO will tell you about name check only if it is cleared, if it not cleared they will refuse to discuss about it. I came to this conclusion because I have called the USCIS number about 4 times in the last 10 months and every time the IO refused to discuss my name check. At the same time a lot of people had luck veryfying there name check with IO on the phone (a vast majority of these people for whom IO replied had name check cleared). I took infopass and the IO at infopass told me my background check is pending. This is just my stupid theorey dont put much weight to it. I dont want people to feel bad reading this.

You have to file "delinquent" FBAR for prior years 2007, 2006 etc. and explain to IRS why you did not file (ex. not aware of the requirement). If needed amend your tax returns for those years to include undeclared overseas income (which the FBAR will reveal, and is the main reason for FBAR filing itself). This may seem like overkill, but when it comes to Citizenship time, you want to have all your tax issues straightened out.
FYI, the deadline is not really extended to Sept 23. Its just that you have until Sept 23 to file the "delinquent" FBAR with an explanation of why it is late. The FBAR is still delinquent if not filed by June 30. See this link where it says delinquent FBAR.

A. Civil penalties can be assessed anytime up to six years after the date of the violation.
I have filed FBAR since 1999, only now there is a lot of press about it and IRS is focusing on it. In 1999, 150,000 people filed FBAR. In 2006, 400,000 people filed FBAR. So compliance had increased due to IRS threats. I can bet you that a LOT more than 150,000 people had overseas income in 1999 :) The law is not new, just being enforced now since the US Treasury is broke !
Is this some new form ? (effective 2008) or is it an old one
What happens to the *-2007 reporting ? should I specify in the same form ?
