IV is the only group that is trying something for EB gc's!!! If you don't agree with IV mission statement - least you can do is SHUT UP! If you have other selfish agenda's take them some place else... don't use IV as a platform to segregate a group.
(In my personal opinion... IV should BAN anyone who suggests anything that breaks this group down! Enough is ENOUGH!)

my LUD for I-485 did not change since 8/28 even after my FP is done.
Today I got email regd EAD that the card production ordered.
called FBI Helpdesk and she told me that over weekend(sat 9/22) then have sent the approved file to USCIS. May be USCIS is lost my file somewhere.

Sorry for not mentioning in my first post earlier... Just now I received a copy of the Letter which my company received from the USCIS. It is mentioned as "NOTICE OF INTENT TO DENY (NOID)".
Reasons:
- Section 203(b)(2)(A) of the Act states
- 8 C.F.R 204.5(I)(3)(ii)(C)
These are related to the Education for 3 yrs degree..
- What is the next step ?
- What is the chance of a positive result?

My I485 is pending, recently I have changed my address online. I also recieved confirmation letters for this address change.
After 2 weeks of address change, USCIS issued an RFE. I have not yet received it, but I just want to prepare for this.
What could be the reason for this RFE? Is it common?

My wife changed her job after getting H1B transfer receipt. Her previous H1B is not expired or revoked. After one month with new employer, her H1B is denied. We didn't appeal, but immediately filed new H1B with another employer and give paystub of the denied employer with all details. She got her H1B approved with the latest employer. This happened 4 years back.
So, if H1B denied, you can file appeal or find a new job and file new petition ASAP.

Before Sep 2009 it was two minutes time to take LCA. Now it takes 1 week time to approve LCA. We never heard about Employer-Employee relationship before 2010.

My wife worked as a consultant for first half of 2008 with a desi employer as an employee (on W-2). After many calls and emails we received W-2 Thursday that has income and taxes of only first two months. Now he says that he showed remaining 4 months as his profit so he can only send 1099. Please advise if I can take any legal action against this employer.

There is an option in turbo tax, if you didnot receive the w-2 from employer you need to submit another form. So explore that one and will give you more information.
I guess if you are submitting that form, IRS will take care of your employer issue. Otherwise just call the Trubo Tax people if you are using them.

Hi Experts,
The question i've is:
I heard from my Immigration Lawyer that,from November 01, 2008, any person who works in Information Technology (IT) and who has Advanced Degree from USA like Master's is eligible for EB3 Category only and not EB2 category. Please confirm if the above statement is true or not.

EB2 or 3 depends on the Job requirements primarily... you could have a masters and be working for a job that requires a bachelors as minimum requirement then you are only going to get an EB3 (no exp example)

Given the hopelessness of the situation in March, switched jobs and was unable to file labor for a variety of reasons. Now everyday I see people come over and tell me how they plan to switch jobs once the 6 month mandated hibernation is over...I feel like breaking something. Lot of them have even stopped working, confident that a new job awaits :mad:
8 years of paying taxes in this country and not even a piece of plastic to show for it. :mad:

His name is Yann ,I hosted him .
myself , chandu , siddhi, poonam and tikka had lunch with him at the Union Station and he did tell us his experiences .
Ppl on their own have to realize the importance of a movement like this .No amount of convincing by friends/relatives would make any difference.

My Guess is that NSC is already holding them up and only TX started rejecting the first day filers hence USCIS HQ ordered TX only to hold them.

I am in a similar position and am going to wait till the end of the year for the AP. I am hoping to be able to go for the H1B stamping with the AP. So if there is any problem with the H1 I can atleast re-enter using the AP. Its a nice backup...

I got my FP apt on 12/14. There was no lud on my 485. I had opened SR for fp in october, but didnt help. Then I used the POJ method to get hold of IO at TSC on 12/7 and she created one for me, the notice date on FP says 12/7. Hope this helps.
