When they told me about clearance and delay, they did not keep my passport, but gave it back to me at the same time and hence, I was able to travel. they, however, canceled by previous visas. I never asked them to withdraw my H1 application.
According to my spouse, there were three treatments at the embassy:
Passports retained for approvable/approved cases
Passports returned for rejected cases
Passports retained (no options provided to applicants) for audit cases
In your case, evidently they gave you an option as to whether you wanted to go with the delay. Am I right in assuming that?
Or were you asked to wait with your passport till they cleared up your case at their end?
We are not withdrawing our H1B application that was approved by USCIS. We are merely contemplating withdrawing from getting the actual visa stamp because of the uncertainty.

Initially they said the audit could take 4 weeks but their website (login enabled) says it might take up to 8 weeks.

EB2 cannot combine education or work experience. It must show a single source degree.
Note the following information from the 2006 annual conference of the American Immigration Lawyers Association (AILA) in San Antonio, Texas. "For employment-based immigrant visa purposes (aka green card), the U.S. Citizenship and Immigration Services (USCIS) will not equate a three-year diploma plus a post-baccalaureate diploma as being the equivalent of a U.S. Bachelor's Degree for either EB-2 or EB-3 classification. Additionally, the USCIS does not accept a combination of academic background and work experience as being the equivalent of a U.S. Bachelor's Degree for "green card" purposes"
This can be done for EB3 IF it was stated on the labor certificate.

Education evaluation was not done for bachelors because the Labor only required masters. My attorney is planning to use 2 years of my experience to compensate for the additional 1 year of bachelors degree

Please check with both Immigration attorney (for 485 withdrawal), and a divorce lawyer in India.
I believe that if the marriage was conducted in India, but US court issues the divorce decree, such decree is not automatically recognized in India. You might have to file for such a decree in India too.
Personally, withdrawing now, and reapplying is a better option. You will be playing Russian roulette if you decide to wait for some time to "withdraw" -- as USCIS could suddenly make dates current (remember last year), and approve a bunch of application. Of course, consult an Immigration lawyer to see if you can withdraw and re-use the same application (140) later. If not, withdraw and start a new GC (using current 140 as basis for priority date) -- you could even get a EB2 classification.

I am also single and filed 485 in July 485. My PD is Dec 2006 under eb2. At present the EB2 dates are June 2006. I am carefuly waching the dates every month to pull back my application if my Eb2 dates becomes current to my PD date.
But this question often hunts me...
1. If USCICS apprvoes my 485 by mistake while my PD date is not current, can I let them know about it and get the 485 approval cancelled or is it irreversibale...??
2. HOw long does it take to notify USICS to withdraw my 485...??

You will have 15 days time between visa bulliton publising date and the date on which PD is current. Within that 15 days you can get marry, and apply "follow to join" petition for your spouse.

How much does technology come into picture? I changed jobs using AC21 and am on EAD, my new job utilizes only 50% of the skills from previous job and am getting trained in new technologies in the new job. I am not sure if the new employer will list all technologies mentioned in the labor, but will definitely list all those that are being used. Any comments?

it is an acceptable proof, they said they have a rule that if the document has no expiration date, they can only give you a driver license with validity 6 months beyond the receipt date of your document (with the wild assumption that any I-485 application is approved or denied within 6 months)
In some of States they accept EAD also which can be valid upto two years. But any way it is pain.

Hi Shamu,
A colleague/friend of mine and his wife decided to have a home delivery. So, they contacted this nurse practitioner/midwife, who used to come to his home once a month and do all the stuff that goes along with pregnancy. They also delivered the baby at his home, which took off all the expense that are associated with a hospital delivery and I'm pretty sure the entire cost for the 9 month term was <5K (actually around 2-3K).
But I believe that was possible because it was a normal delivery with no complications.
So, if you and your wife are in the same situation as most of the people here (i.e. late 20's or early to mid 30's ) there is no reason why you would not have a normal uncomplicated delivery. So having a home delivery is an option.
I am a father of a 15 month old and felt that most of the months that we went to visit the doctor was pretty superficial. They did not tell us anything which you cannot find out from the internet or the maternity books. Who delivered my daughter in the hospital? Well a nurse did.
Also in India my wife told me that most often women don't go to the doctor unless there are issues. (For the period leading up to the delivery. For delivery they go to the doctor.)
So, for uncomplicated deliveries a home delivery could be an option, just check it out and the nurse practitioners (OBGYN variety)/midwives are fully qualified and sometimes more experienced than the doctors as that is ALL they do, they deliver babies.
So check this option if you feel it is OK.
Good luck with your insurance search.

Applied AOS On: July 5th.

Am seriously thinking of applying new AOS without medical exam, EAD & AP after consulting with my lawyer.
