The evidence of experience should include Job Responsibilities(detailed), Salary, Dates and peferably on company letterhead (or at least should have full contact information of person writing the letters, to prove authenticity). If the papers you already provided (affidavits from co-workers, previous co. offer letter, yearly appraisal letters and last few pay stubs) have all this info, they should be enough to prove your experience.
Are you sure your 'company lawyer' is handling this case well? There are innumerable horror stories of company "lawyers" messing up a perfectly good case and 'forgetting' to submit all documents with the petition. Please get all the papers from your company lawyer and consult with your own attorney to discuss the case ASAP - it will be really worth paying for this consultation.

I am in 9th year extension with priority date 09/2002.
My I-140 denied on 06/18/08n and immediately I485 also denied.:mad:
I have Visa vailid till Jan09.
1.If I change employer and able to get labor cleared before jan09 , can I apply for I140 PP and get H1B exension.
2.Is the Priority date transferrable if I change the employer?

Thanks. I finally got the receipt notice yesterday. They gave me a receipt date of May 11th and a Notice Date of June 11

I applied for H1B extension in october 2006 as my H1B was about to expire in December. After five months of applying, got an RFE in Febraury 2007 . My employer replied to the query in Mid March 2007. My employer was reluctant to do a premium processing when he replied the query, saying that he doesnt want to take any risk. CSC transfered my case to Seattle, WA field office ( the field office is no where near my employers physical location, not even close to where I live) on April 4th. I guessed that its because of new H1 petitions filed in April. Its been more than 3 months and no action taken on my petition. We tried to convert into premium processing, but the field office rejected it saying they dont accept premium processing in their jurisdiction. So nothing else to do but to wait wait wait. Total time passed since my initial petition in OCtober ( 9 months).
My license has expired in March and the DMV do not renew my license with out a new I-94. Really its been a hell with out DL and still depending on others for necessary needs.
I am tired of telling the story to every one. Why not one more time here. I want to find out what other steps I can take to expedite the H1 Petition. Is there any way around to get the license renewed. Please share your experiences and suggestions.

This is really pissing me off, without a driving license for the last 4 months, passport expiring soon, Wife's H1 petetion Query ( as her H4 renewal is in hold due to my H1B RFE). Guys please post some ideas on how to deal with this situation. I even opened a service request about my case. But no progress. what should be my next course of action to move the case.

Yes, I must correct myself. It is not 525 (even though that is what the ever hurrying radio talk show hosts said).
That's even better. Percentage wise it is now 300/435. How about that?
I was away this morning for a big community project that I am involved in. I wanted to round that off with a morning brunch with the Congressman I quoted, but couldn't pull it off. I had met Mr. Mark Udall a couple of times in Friendship and Business Chamber get together in Denver, CO. He is a fine gentleman.
I prey his words come true at the earliest. Got to go. Have to mow the lawn, as per home minister/ interior secretary.

Bit of addtional information that might be just what was needed to make final call.
I spoke to Fragomen, my Law firm, and they informed me that priority date for filing I 45 (Green Card last stage) is current for Labor applications (EB3) filed in April 2001 and unless something dramatic happens again, things will move at its own pace.
My Labor (in EB3) was filed in March 2003. Estimated time to get GC might be anywhere between 1 year to ... who knows....
I am leaning towards resigning and start it fresh.. wherever...even If it is US fresh H1 will always be there.

I have been banned too - simply because I raised the cause of international students and IV's duplicity in its stance, and that makes some GC-greedy members paranoid. :D

IV can offer a platform. You continue to post hateful messages against IV. IV is a platform and if you want to do something get students together on a platform, we will guide you. Just like we are helping people stuck in Perm Audits these days. But it is upto people who are stuck to take up the challenge and not expect someone else to do it for them and they will simply come to the site and pass judgments.

If you put the IOs into situation where they can potentially make mistakes...
more often then not, they will make a mistake. Then you have to pay the USCIS to fix their own mistake by filing MTR. Not to mention unnecessary stress... That being said, everybody has different risk tolerance.

My plan is making the following
Movie - A full length feature with characters that represent our life (includes H1 to GC process) in US with humor
Documentary - A professional documentary on our issues like H1 problems, GC backlog processing etc.
Any other thoughts from your side would help.
I am an ex NYFA student in digital film making. I would like to make the above two things by end of this year. Any of you are interested can participate. Again I don't need any money contributions. Just need your participation as actors, script writers and as other team members.

Our numbers must grow, and the immigrant community must realise what is happening on their back.
My wife does not get it in her head (now she understands a bit) all this politics, she thinks we are on h1b, and America needs us and we will become Americans soon. NO.
Mailed is not equal to received or applied for transfer. Until you have proof that USCIS has received your application, dont start at the new employer. Waiting for the receipt # is the safe route down the road even though you have to delay by a week or so.

my lawyer as always only wanted me to pay in full :mad: however yesterday I got fp code #2 for 10/2/7 so i will take that day off and get appointment again!!! :eek: and will be back with news
