I have the letter thay gave me and proof I did work with them.
And I guess I will start keeping news paper clips because right now everyone knows how bad the real estate market is but in 5 years or more I hope USCIS remember.

Employer has to show that he can support all the employees that have an 140 pending. It cannot be attributed to being sadistic alone.
However, having an official AC21 process would be good.

In this case, once an official request for AC21 is filed, CIS can release that particular employer from all liabilities for this 'AC21ed' 140. Since new employer is not required to show any financial statement (in case of EAD), this may be a good option.

The second bill (HR 5634) says that people with PhD from US universities are cap-exempt from EB. So it means some quota will be freed up from EB1 and also from Eb2-NIW.
Read all the bills. I guess you are bummer !!!!
I looked into the PDF's - seems like PhD does not have to be from US universities (can be from anywhere within 3 years of applying for greencard).
Of course it would have helped more if masters is also included but this is at least a start - hopefully more provisions might be added as it goes for debate.

(2)Ensure and request USCIS not to reject our immigrant visa petitions filed in July and provide us interim benefits of a pending immigrant visa petition. We make this sincere request on this Independence Day with the hope that people who played by the rules will not be punished.
It doesn't matter if we are not rewarded as long as we are not punished!

Law comes from three sources:
Comman Law: Laws inherited from the british justice system (evolved over centuries).
Legislative Law: Laws passed by congress and signed by the Prez.
Regulatory Law: Regulations created by the regulatory agencies to implement the laws made by congress. Congres doesn't always finalize all the details to the last comma and leaves that work the relevant government agency. For example, FCC, SEC create regulations about how the congress' laws are to implemented. These regulations have to conform the laws passed by congress. These regulations have the force of law.
So when congress did not stipulate any specific overflow mechanism, it left it completely up to USCIS to work that out.
Historically EB2-RoW overflowed to EB2-India and EB3-Row overflowed to EB3-India. Soon after EB3-RoW was retrogressed, USCIS channelled EB2-RoW to EB3-RoW. This is expected to continue till EB3-RoW becomes current itself.
Therefore, if you're looking for any progress in PD, whether EB2 or EB3, the key parameter you should be watching is EB3-RoW cut-off. Only when this becomes current, others can even _think_ of nirvana. Without overflow of RoW's, both EB2-India and EB3-India cannot progress more than a day in every bulletin (at a average). EB3-Row moved a month and a half in Jan bulletin, which counts as a progress, however small, for everyone. That holds true -though not easy to intuit- for EB2-India as well!

When there are so much negative opinion, instead of chasing this avenue, let us all focus on what is tangible (such as connecting with media and building up public support). If by chance he goes against the legal immigration too, then we burn candle from both ends. The risk is not worth it.

That is because I see lot of kids come to "what was the name again" schools with megre or no GRE scores just to land here once they get to OPT they get 8 - 10 yrs of experience out of nowhere and they are out in the job market. I can spend all day writing about them, the school and the quality of education but it is not going to do any difference.

What IO told is correct. Untill the case 140 is not approved, EB information is not updated and IOs at the infopass has limited access.
If the 140 is approved, IOs at infopass can see this, otherwise they cant.
I was also under the same impression that IO at Infopass is able to see whether my case is in EB2 or EB3. She told me that she cannot see even though both of my I-140s are approved and interfiled(hoping success).
