possible reason for mysterious rejections :
You are a mail room guy, you go home friday (06/29) and comeback on monday (06/02).
You start the monkey business of timestamping incoming mail, but half an hours into the day (around 8 or 9:00 am), you realize "sshhttt: i did not change the date on my stamp, its still read 06-29-2007". In the classical govt. fashion, you do not bother to go back and restamp the applications with the correct datetime. Not because you are evil, but because you simply don't understand the ramifications of early stamping. You think u are doing the guy a favor, putting him/her early in line.. but guess what... the guy's application is gonna get rejected.
Could this be the case with some apps mysteriously being rejected?

I currently have the Canon Powershot S50 which i'm selling.
Looking into the minolta Dimage A2 and the Olympus C5060.
Looking to spend about 1300.

If IV core can help us to set these meetings up and also provide suggestions/ideas, I think with 50 participants, we can convey what we want to. If EB2 folks are also joining us, we can seek support from compete America and have representation from them as well.
We should keep this very low profile - meaning:
1. No high demands - shouldn't ask to make EB3 I current in October
2. Shouldn't compare or discuss EB2 I and C
3. Shouldn't complain their (USCIS/DOS) work style or inefficiency.
4. Don't compare us with illegals.
What we should be discussing:
1. Reference to EB3 I 2001 and 2002 cases and possibilities with new VISA flow structure
2. Difficulties in using AC21/EAD to switch jobs
3. Very importantly - how they view EB3 I dates not moving forward in the last few years (besides last july) and what their plans are to address it (besides passing a legislation)
4. To give us some direction in planning for the GC wait - by providing us how many cases are pending with break-down year wise - will indicate that people can make their own decision either to continue GC process or give up and go elsewhere (we will not demand GC but seek information to enable ourselves to make a wiser decision)
5. Their game plan if a legislation does not pass, say, for the next 2 years. Can they make some changes at administration level to help us? Like relax EAD restrictions?
These are not high demands but fair enough questions from aspiring immigrants who are in the queue as long as 8 years!!
We will send letters to President, Immigration sub-committee, DOS and USCIS chief, CHC members either before or immediately after the meeting.
The intention is not to come back with GC for every EB3 I but atleast make a representation and seek some quality information from them. Also, give them the feeling that we may not wait forever.
If these ideas are stupid, my apologies.
I strongly believe nothing like meeting with people in person.
And, if we are doing this, we should do this as early as 1st week of September.

I got an RFE on Nov 15th for copies of my degree certificates and my attorney sent them in a few after getting the RFE notice. I had an LUD on Nov 30th (Date when they received response to RFE) saying case processing has resumed. I also have another LUD on Dec 2nd. But the status still says case processing resumed. Does anyone know why there are 2 LUD's even though the case status is the same. Does it mean anything?

Guys pls stop taking useless info pass appointments. People like me who have not received EAD and may loose the job are not able to get infopass appointments because of all the people taking appt to know the 485 status. Pls understand......
We always get appointments with in less than 24 hrs in the local USCIS office(closest to Upstate New york). I don't think its a big deal here. I am not sure about other offices.
Again based on the urgency, one can always decide whether to take info pass or not. Appointment time frame is always same for everyone. Unless its urgent(relative to personal needs), one can always take an appointment with USCIS.

Guys,
I took an info pass last week to check the status of my case. Specifically to check whether the interfile is success or not. IO at USCIS office mentioned that she cannot check whether my case is in EB2 or EB3. I am surprised to hear that. Gurus any has this kind of experience?
Also, She mentioned that my case is assigned to an Officer on August 13th. Do any one has any info how many days(on average), an Office will take to approve a case. Any info. is helpful to me and all.
Overall the Field Office people were polite.

When i first came in 1999 marrying us citizen was sort of heard of by IT folks.
by 2003 i was coming across so many cases of marrying us citizen.
among non indians its very common resulting in their PD being more recent.
In fact my friends who went for marrying citizen ...are way better placed in life.
It become so hard to marry from india now with contract jobs lasting short time and salary being so low after cut form h1b vendors. eventually teh pain will reach the point of yield.

Hello All ,
My application for i485 , i765 and i131 was recvd in Lincoln,Nebraska on July 23 , 2007. (Sent by my company's attorney on July 21) . I have been waiting for over 2 months for any updates or receipt notice but nothing so far . After reading some forums in this website , i called USCIS (number from USCIS website) and got my case escalated to an officer who asked my last name ,first name , date of birth and coutry of birth . He gave me all the three receipt numbers for AOS , AP and EAD . All the receipts numbers are starting with WAC meaning the cases were xferred from Nebraska to California Service Center . When i looked at online status of i485 case , it says the case is xferred to Nebraska since it is in their jurisdiction . The other two cases for EAD and AP are pending . I still have not recvd any receipt notices from my attorney . So , i guess everyone who is waiting for their receipt notices might want to call USCIS and get their numbers .

Attorney emailed me this morning all our Receipt Notices for our I-485/I-765/I-131. All numbers start with WAC. Receipt Number of I-485 is the same number as Transfer Notice.

Thank you for your advice. My last M.Sc. and Ph.D. is from the USA. My Ph.D. is about manufacturing of aircraft brakes with Honeywell.

what bothers me is that I am not cited in the literature yet and I do not have awards.

Since you have a PhD and reserach in Aircraft Braking Systems, which can be argued as aircraft safety and in national interest, you may qualify for NIW. It all depends upon you how well you argue your case as NIW and how good are your recommendations and support documentations. You need to get your papers published in reputed Journals and also get onboard of journal publication evaluations.
You also need a good lawyer (however you will end up doing 90% of work because of your unique field of research). However I would not recommend Murthy or Rajiv, because NIW is not their speciality. You need to go to a lawyers who have NIW and EB1 as speciality.
EB1 is not a good category for you, as of now, but it may change depending on your career progress.

I am primary applicant on our 485 application. Mine and my daughters case doesn't show any LUD. But my husband's status changed to case transferred to local USCIS office. He was on H4 for 6 years and have not used EAD yet. No gaps in Visas. no law violatiobns. Prerry Straight forward case. Recently we applied for Online EAD Renewal.
Any idea why his case might have got transferred ? What should we expect next?

Dude,
Take your company attorney & HR guy(al) out for a $250 lunch and first build a rapport with them. Tell them about what you need & do tell them politely that if they care about you as an employee, they need to get on with your immigration process.
Nothing unethical, illegal or embarrassing about push your point forward.
There are ppl who will tell you that sth like this would never work. time ot prove me wrong!
Its your future. Take charge.
Haha. That is an accurate assessment at a 50-foot level. I was pretty disillusioned after a couple of years of working. A mixture of what the fuck am I doing, but not really knowing what to do, and all confused because I was at probably the biggest firm around and and a feeling of even if I switch, what's the point? And not having the balls to switch jobs, for the fear of throwing away what I had, mixed with personal struggles with life and not having the social life that I wanted.
In between all this, the desire to get the GC process kicked off came and went, esp. since I wanted to switch positions to a more people oriented role, and the feeling of gosh, do I want to stay in 6+ years in this job - maybe if I file, then I won't want to change jobs.
As you can see, even I am not sure what was going on there. But my personal life and acclimatizing has sorted itself out rather well of late, and I do want to stay here now that I have a really interesting life (and partly out of fear of throwing everything away and moving somewhere new).
Now, I know that IV is not a self-help trauma group, so I will cut short my story here, which has little to do with the raw facts of my immigration situation :)
And yes, I did not participate or know much about the visa process, or IV till recently, and am a recent need based participant, but I hope that does not stop anyone from contributing their ideas to help me out.
*** Also, to the previous poster (nojoke) who said that big companies usually hold off on perms, are you suggesting that I have a better chance at a smaller company then?
UPDATE: My company attorney suggested talking about this in April, and I am nervous about waiting till then in limbo - things are only going bad to worse, I might as well find a job at a place which will sponsor a PERM sooner rather than later.
I request you to PM me if you have any leads for such companies might still be a good bet for filing a PERM.
