How about if IV publishes his brief story( off course with his permission), congratulating him on IV behalf, in all national news paper ( with or w.o his name ) Date of entry, profession, long time wait- reasons and all opportunities he may have missed, couldn't buy house, collage-tution probelms etc and all struggles he has his family might have faced. point by point.
Money would come from special campaign. NY TIMES, USA TODAY, Chicago Tribune, Washington Post, Miami Herald etc. News paper industry is struggling so won't cost much to buy a half/quarter page with a title - " An untold story of legal immigration" Or similar kind of eye catching title. Not more than 10-12 lines stating thousands others are waiting in line...
There won't be difficult to get more his kind of cases to run it on regular basis in future.

I just called USCIS today and the officer told me that they haven't scheduled our biometrics yet since they are overwhelmed with the applications. She said I should wait till next year.
Also inquired about my name check and she said that they've started it and it's still pending...
Only option is to wait it out as always...

Yeah right!! buying houses is all hunky-dory when you have all cushy jobs and economy is booming. When economy slows down there will be some people who may lose their jobs with 3000$ mortgages sitting on their head!! And that builder /bank who lobbied for you GC will come knocking on your door asking for payment.
And believe there are defaulters among these highly qualified legal immigrants too!
So again, how did you solve the housing slump problem in the first place???
no body said about actually solving anything. the point is to use it as a lobbying factor. Greenspan said that the problem is around 200,000 to 300,000 houses. if they are knocked out of the inventory then there will be stablization else the bottom will fall out. now if the immigrant community was united (across national lines) and if we had one organization like IV or someone - who had leverage to talk to builders etc -something along the lines of a union - then this would have made a big difference - but of course the reality is that people get EAD and think their problems have been solved and run to buy a house - the fun part will begin if a recession actually happens

Come on we need to learn to forget the cold war days. This is 21st century and the age of facebook and other social networking platforms. the world is getting more connected and there will soon be no place for fighter planes any more. What we need is "food" and "water".....
Nature is showing us again and again the futility of our ambitions (regional and international) through her rather quite infrequent thrashings these days....

I tend to agree with your interpretation that "NOT SUBJECT TO PER COUNTRY LIMITATION IF ADDITIONAL VISAS AVAILABLE" refers to those beyond 140K. The language of law is always beautiful, isn't it?:)
Anyhow, I still think it merits a deeper investigation and consultation with attorneys.

Guys, AC21 rule says "I-485 pending for more than 180 days". It doesn't require that you work for the petitioning employer for 180 days. Even if you work or not, as long as I-485 is pending for more than 180 days, you can invoke AC21.
USCIS will look if you still have "future" and valid offer of employment according to your LC. USCIS is not interested in the past but the future.

I am wondering everybody here is throwing stones at small consulting companies, I wonder how these people came to US surely somebody did there H1? right? People are working in big companies HP/Oracle/SAP bla bla.. but I'm sure they are not the ones who brought you guys here. Also the day they'll get their green cards each of these people are going to open similar companies and do the same thing. This is amazing how people forget their past and forget the people who brought them here...I will call you guys thankless....

Dont let people come here and not pay them / treat them as slaves on contract etc. Look at all the postings (go to murthy's web site--you will see many) Employer not paying, etc etc. In such case whats difference between an illegal hotel worker and these mistreated H1bs. I stay in an apartment OK. One day my neighbour (living downstairs) was crying with his wife and a small kid. You want to know the reason--NO PAY FOR 2 MONTHS!!!!. All his hard earned money was finished paying rent, OK and his kid was sick. No money, nobody to ask. His contractor said WAIT, WAIT and nothing else. Having personally seen this situation, I am a little concerned. Why would you be concerned in asking infosys to disclose the usage of H1bs procurred by them?? If its used properly there shouldn't be any issue. Now how microsoft uses the H1b is more transparent. How many of u working for microsoft have had any issues???

I think most of EB3I and EB2I are missing one point.
EB3I didn't loose anything by the change in spillover policy few years back.
It is EB3-world who lost. Obviously EB2I and EB2C was on the gainers side.

CurrentSpillover EB1row->EB1I/C->EB2row->EB2I/C->EB3row->EB3I/C
(or to be more precise, it is currently EB1->EB2->EB3 since spill overs are not considering country based limitations)
Either way EB3I was last in the que. So nothing changed for EB3I or EB3C.
EB2I or EB2C on the other hand moved ahead of EB3row, that is very noticeable.
EB1I/C also moved ahead of EB2row, by this is not that noticeable, since all these categories were close to "current" either way.
In summary, you change the spillover whatever way.... EB3I is always going to be at the end of the line, least benefiting from any spill over.
