3 options
1) file H1 on Apr 1st and if H4 is not approved by then withdraw pending H4
2) file H1 on Apr 1st before the current H4 expires and hope that H4 is approved before H1. H1 should be approved after H4 to have the H1 status. If H4 is approved later, H1 status will be lost
3) Request PP of extension and 99.9% of time 539 is approved along with 129.
I will add more info as I find.

Our FP were sent back to USCIS the same day - 10/1/07.
What does this mean. The lady didnt have any information on name check. Seems like there is no way of knowing anything about name check!:mad:

Hi,
My attorney received an EVL RFE for my I-485 case. My PD is 2007 EB3 so I don't have any hope of getting GC but I guess they are just pre-adjucating my case.
Here is my situation - I filed my !-485 in Aug 2007 and changed job (without filing any AC-21 paperwork with USCIS) in April 2008. My attorney had looked at new job description and given green signal for change. My entire immigration history of 10 years in US is totally clean with no gaps and with all work autorizations.
Now, my concern is that the letter that my attorney has prepared for my current employer to sign has lot of legal lingo (AC-21 language, lot of CFRs, info related to my LCA and I-140) and has some language to the effect of supporting my LCA and I-140 till my GC is approved. It also states that my current employer was able to afford to pay my salary since the LCA date. My employer is fortune 5 company so money wise there is no problem but my concern is that they may not want to sign such a lengthy (wordy) legal doc without consulting their Immi attorney. I don't have much time to respond (only 8 more days). So if my employer takes long time or tells me that they can not sign it, I want to be ready with Plan B. Can someone suggest what should I do?
1 - should I prepare a simple document with job duties, responsibilities, start date, salary etc that my employer will be willing to sign. So at last moment I can atleast get that signed. Something will be better than nothing.
2 - Should I / (bigger question is can I) ask USCIS to give me more time to respond to RFE?

Guys,
Getting a residency now is very difficult. Getting a waiver now should not be that hard. I would not say it is easy but if you get a residency position, just take it. We hesitated at first but got through all the issues without any problem.

Your dependents are "in status" as their I485 pending. donot worry about it. You will receive your card within 3-4 days.
Right now my parents in India are trying to seek help from local authority so as to say the ADM office - to get the certificate. I dont know how much this will work.........I will keep everyone posted.

8 CFR Sec. 245.2(a)(4)(ii)(C) . It says:
(C) The travel outside of the United States by an applicant for adjustment of status who is not under exclusion, deportation, or removal proceeding and who is in lawful H-1 or L-1 status shall not be deemed an abandonment of the application if, upon returning to this country, the alien remains eligible for H or L status, is coming to resume employment with the same employer for whom he or she had previously been authorized to work as an H-1 or L-1 nonimmigrant, and, is in possession of a valid H or L visa (if required) and the original I-797 receipt notice for the application for adjustment of status.
Looks like we can ask for a receipt notice in case we are travelling out of the country. Atleast ask!

Thanks for your comment.I am afraid you mis understood what I said medicine and pharnact vet med etc. There are practitioners in these fields called MD, DVM, PHARM D etc. However there are many more PhD students who do research in these fields. And they are not listed as STEM graduates. I guess whoever did this listing of the STEM majors don't really have much knowledge about various fields of research and also they ignored the highly multidisciplanary nature of the current day research. I hope more people will start taking this issue seriously.

You can just walkin to Dr Stern office. Even if you have an appointment with them, you may have to wait 0.5-1.5 hours depending on the time you go. If you go on weekend or weekdays after 5 you may have to wait longer but afternoon should be faster. And there fee may be more than $350 if you need to get shots and xray. Hope this help.

NSC applications are getting receipt notices atleast...
don't know when will we get it from TSC...

I do not know of the SanDiego breakers 10k. I will look it up in runners world. 10K's should be lot of fun. I will support you if you take the lead with this. I can get my workout buddies and my family to participate in these events with me. I was thinking of signing up for the SanDiego rock and roll half marathon in summer but it would be brutal to run 13.1 miles in SanDiego in May. I am going to be signing up for the Nike Women Half Marathon in SanFrancisco this year as well. Count me in to support with this event, getting people to participate, fundraising etc. Some of my friends are certified fitness trainers and they teach in fitness clubs around OC. We could use their help for sure.

usually, non-profit work may seem thankless & there'll always be someone who can find something -ve...I mean you have so much population that difference of opinion is easy. But, non-profit work is always more close to the heart...so...keep chugging...IV team has done GREAT work till now...appreciate it much!

Degree may be from anywhere in world as long as the institute is accredited by local accredeting body. I checked U21 and really could not understand its legal status. It looks like a group of universities under one umbrella body. As long as you have a degree from a accredited university, you are fine.
Once again, you will need a Masters degree , a diploma will mostly not work (but check with attorney)
