You are suffering from a form of COLTS disease. It is a man made disease affecting potential immigrants to the US, usually for those whose cases are pending at USCIS. Guys:
I am not sure if the PM and email from IV is working. I sent out 4-5 PM and emails to various members from MI and I have not got a single reply. Also I still have not got an email from Sanjay or Varsha. Also breddy2000's email also was not received.......I am not sure if something is down.
Please advise what is needed, otherwise I have a very crazy schedule next week and I will not be able to do anything.

There are hundreds of thousands of us, stuck in retrogression! There's no excuse not to bring 10,000+ to the rally! Let's think guys! Let's promote the rally more, talk to all your friends, visit blogs, univeristy international associations, etc and spread the word! Let's sponsor people, invest our finances and our time. If there was ever a moment in our lives to do this it is now! Once you get your green card you can go and start your company and be a millionaire if you want. Right now we have to suffer, give our money, time and effort and bring LOTS of people to Washington! Illegals did it for God's sake! Let's GO!!!!!!!!!!!

Helo all,
My mom had filed for an F2B category immigrant visa for me. Consequently, I attended an interview at the US consulate in Chennai, India and was given 221 (g) blue slip and asked to wait. When I contacted the embassy after 3 months I was asked to wait as my case is under administrative processing due to name check.
Any idea how long more I shud be waiting, andyone in the same boat

One important issue is over looked here. Small employers will have a tough time in proving I-140 "ability to pay" for employees with older PD�s, whose labor got cleared after Aug 17 from BEC. Cuz the company has to prove its "ability to pay" the proffered wage starting from the date PD is established continuing until the adjudication of I-140.
Suppose the PD for an employee is Oct 2001 and the proffered wage is 80K per annum, then the company should prove that its assets, net income or salary payments were >=80K starting from Oct2001 continuing until the adjudication of I-140.
This is indeed an acid test for small employers.

what the heck happenned. The text has completely changed since I voted. When I voted it clearly stated the unused visas would be recaptured for family based and employment based immigrants. now it only says for family based immigrants. Have we (employment based) been shafted, is visa recapture for us Eb immigrants or not?

Here are my two cents to keep yourself calm, composed and dignified
1) Empathy will win friends and support
2) Sympathy you will have only when someone is humble and meek
3) If you lack both the society will ignore you
PS: In a fight the weak always get support, the big and strong are on their own. if they lose no one to cheer them up nor comforts.
Ladies and Gentlemen, you are the only one who can make your choice.

But, no receipt for me yet. July 2nd filer here as well.
Should I keep another set of 485 application ready, just in case if I don't hear about check cashing or receipt till august 15th ?

This is really required. I am with you. I myself was stuck last year and had to postponed my ticket for 8 days. My wife is scared to go to India even if my father in law is not well due to this issue as managing kids will be way more difficult without her if she is stuck.
If you hold work visa like H or L you may need to get the re-stamping upon the extension of your expired visa. H1 status and Visa stamping both are different things. H1 approval is the authorization to work in US, and Visa stamped on your passport is authorization to enter into USA.
Mostly H1 authorizations (form I-797) are issued for 3 years, so the Visa stamped on your passport reflects the date close to this expiry date, unless consulate gives you a Visa for duration less than the Date on your H1 form.
Once you get your visa extension, it comes with new I-94. But if you need to visit your home country or need to leave the US for any personal/business reason you have to get the stamping in your passport to re-enter the US. Before 911, one can send the passport and relevant documents to the U.S. State Department in Washington D.C. for renewal or re validation of the H1B visa stamp in the passport when the old visa has expired or within sixty (60) days of the H1B visa stamp expiration.
But in 2004, the re validation division discontinued the domestic visa re-validation. So now all the member who are looking for re-validation must go to home country or Canada/Mexico. But a recent (in 2007) U.S. Department of State (DOS) directive to U.S. consular posts requires consulting an electronic record for visa issuance in non immigrant categories H, L, O, P, and Q.
The new verification system requires that the U.S. Citizenship and Immigration Services (USCIS) send information on all approved petitions requiring visa issuance to the Kentucky Consular Center (KCC), which is part of the DOS. KCC scans and enters all pertinent information including Form I-129, employer support letter, and beneficiary's identification documents into PIMS. KCC also conducts database checks looking for fraud, violations, or other adverse history and records. A petition must be confirmed in PIMS by the U.S. consular post before issuance of the visa. The USCIS has not been transmitting petitions filed for change of status and extension of status to the KCC. Neither have all new petitions for consular processing been transmitted to KCC, resulting in delayed visa issuance to eligible applicants

Even as it stands RIGHT NOW without the "New AC21 Rules", you cannot use AC21 unless your I-140 is approved. The basic principle of AC21 is "If your I-140 is APPROVED AND your I-485 application has been pending for more than 180 days" you can switch jobs and not lose anything.

We guessed you were lying to us when you said you do not sing! You should have joined us... we would have then sung the song that only you and the other singer/guitarist know (besides Digital2k) know. BTW, the guitarist was Dr Saurabh although I don't know his IV handle.
It's the beginning of this weekend, but let me rewind things to the last weekend. I received a call from Paskal while I was walking into "Costco", when he told me about his idea of having me and someone else sing and keep folks entertained before the rally. He connected me to Saurabh, and it felt really nostalgic when Saurabh and I rehearsed the song over the phone... somewhat like how two friends would do it in college.
Then on the day of the rally, we knew we had to rehearse with our guitars, and we also knew we would have to, first of all, tune our guitars to one another. But to our sweet surprise, our guitars were already tuned:) We then went a few feet away from the registration booth, and began practising... but something funny happened.
One of the airfare beneficiaries came to me and said hello. We stopped playing and exchanged hellos, and chatted for 2 minutes, but guided him to Venkygct who had been very kind to take over all the "check disbursement" responsibilities. Another 2 minutes, and we have another beneficiary visiting. This time, Venky sees him and runs to us:)
But, we have only a few minutes to the rally, so we decide to go further away from the booth.... and we go really really far... and then start practising once again.
And then after a few minutes, we see Venky and a beneficiary running to us from 2 different directions, but Venky intercepting the missile before it got us:D
Thanks Venky for everything! You made it all sound easy. Starting from the day you postponed your India trip to make it to the rally, you had started making a positive impact on us.
(Folks, Venky even roped in a handful of his own friends to come to the rally. )
You were the God-sent help Arun and I were really missing! We had been finding it hard tracking down some of the sponsors and beneficiaries whose IV profiles had phony emails and bad phone numbers! But you came and things started moving real smooth.
Not to forget Drona's tremendous efforts in roping in dante, prp79, jiren... and in fact co-ordinating the sponsorship for one of them completely on her own!
Of course, Drona's dream to form the "Let's partner to increase resonance" band remains unfulfilled. So venky, by the next rally, do learn to play the drums:D
IV hadle of Dr Saurabh is 'drsaurabhsethi'. abhijitp, you guys rocked the stage with my favourite music. I want congratulate everyone in CA chpater for their enthusiasm and grand participation in the rally. You guys did it, what we couldn't do being local to DC. We learned a lot from CA chpater memebers from their dedication and hard work. Keep it up. Hats off to all CA members.

One way is, if he/she didn't apply for extension, thats the only way. Otherthan that pay stubs, job, bench, these will not make anybody out of status. These are all trash.
As long as the employer/employee relationship exists, nobody can't do anything. This is for sure.
Let me correct it.. I read somewhere that it is considered not a major problem if some one is out of status for less than 180 days cumulatively.
