eb3nepa & srikondoji, it is not just non Indians that not standup, there are close to quarter millions Indians in the queue who follow immigration news and who want things work but just do not want to standup. It could either be "fear" or "no care" attitude. It is true with immigrants from other countries too. Immigrants from all countries have a hidden fear, as it is not their country but a country they want to immigrate to and do not want to do anything that displeases the country. It is factual. Very few people actually have the guts to question.

Are these for real? It was 5 months a couple of days ago. Also the USCIS Processing Times (https://egov.uscis.gov/cris/jsps/ptimes.jsp) page is offline since yesterday.

Nope. You can continue to work on H1 eventhough you use AP for re-entry.
Also dependent GC applicant using EAD means losing primary applicant H1B Status?
Nope. Dependant usage of EAD is no way related to primary applicant. Each 485/EAD/AP is a separate application. But if primary uses EAD for work, then dependant loses H4 status and both comes to AOS pending status.

Yes. The malicious code did not download any virus or inject any virus in anyone's system. All it did was to redirect the user via a popup to a malicious website. Antivirus scanners pick this up as a virus alert, but it is not. It is more of an annoyance than a virus attack.
I honestly cannot vouch for the millions of hackers and script kiddies out there that this won't happen but use a good Anti-virus scanner especially if you have kids at home.

The 2001 recession was centered around the tech bubble... Except for people working in IT, most did not even feel it was recession... Infact the recession of 2001 was considered the shortest and the mildest on record... But it hit the tech industry hard which was at the center of the storm... Having learned their lesson, the IT companies paid a lot of attention to their bottomline and preserving their resources... The Ciscos, the Microsofts, the Oracles are sitting on huge piles of cash... So they have not been as quick to lay off people as other industries... So if you work in IT you might be thinking what recession? Things are fine... Just as people in Real estate and finance thought in 2001... However, if you look at the numbers it tells a different story... The peak unemployement during the 01 recession was 6.2%... This time we have already crossed 6.7% and there seems no light at the end of the tunnel... This is a much serious downturn, that will fundamentally affect US and rest of the world. I am surprised at the number of IT people thinking this is a small storm that will just pass away... Lehman Brothers, 140 year old bank just vanished one morning... Merrill Lynch gone! Thats some serious S**T!! Its like waking up one morning to find out that Microsoft does not exist anymore! Ask your friends working in finance (if you have any) and they will tell you how serious this is! The layoffs in IT are coming my friends... Hold on to your jobs like your life depended on it... Because things are about to get nasty for the IT sector too... Good luck!

Unless you can play some smart games using an attorney, you cannot use an EAD to change job classifications as long as you are the primary applicant.
Wrong,you can use EAD for any job but when it comes to GC interview, you need to show that you have a job waiting based on LC.

Just wanted to emphasize that getting a valid H-1/H-4 stamp on the passport is good enough for re-entry. AP is not a requirement.

this post was for specific question as to whether his spouse and child can use AP while returning from his home country. They have a valid H4 or some status now which was going to expire and he wanted them to use AP( and not get a renewal) while entering back. My post address that issue. So hope the confusion is cleared

My college got his I140 approved just in 2 months with normal processing. He filed in EB2-I. Mine was also approved last year in 2 months in EB2-I. Does the location from where are you applying affect processing time?
Not necessarily , But it does depends on what is load of work at a given time at given location. TCS was ahead of NSC last year but they shifted workload from NSC to TCS so now TCS is little behind. But once TCS cleans up all files it can go ahead. Processing dates are nothing but indication for when to open a Service Request at local office. If your case is behind that date you can open SR.For straight forward cases approvals comes fast. For those who are stuck they should monitor Processing time and see if their app is lagging behind proc time. They should contact USCIS.

I think what is being conveyed is NOT that he is superior .... but that he has been in the US atleast 2 yrs more than when he actually started the journey towards GC by formally putting in an application

Well Aug 2008 is way different than May 2009. Dates for EB2 were current for 28 days then (for 2005 and part of 2006) ! They are not now for your PD.

Admin fix was the wrong thing to do anyways, else your Obama will create 101 rules that affect everyone, the check and balance system is a good thing for US
Admin fix should happen for small regulations not a big law like the CIR.

the title of this thread implies that obama is not doing admin fix.... its not always about the campaign & votes, sometimes its about the truth and the truth is that republicans leaked the draft admin memo and wrote letters to oppose admin fix.... but now everyone here is blaming obama..... i'm simply defending the absent.....

I am in the same Boat. My PD is May 26 2004. Mine and my wife's case was transffered to Des Moines Iowa on March 19th 2008 and says its for additional processing. I applied for EAD renewal on June 11th and no approvals yet. I called uscis and they say that my ead would not be approved until the additional processing on my 485 is completed.. I am guessing it would be an interview.
Not necessarily in the same boat, although in the same pond.. :) In your case if the email says 'additional"processing and clearly indicates the DEs Moines office then it might very well be for an interview. In the case of ABH though all it says is that it was transferred to a USCIS office for "standard" processing, which could be as simple as USCIS mailing the packets from CSC to NSC.

hi any suggestions for the question coophole put up. even i moved out of state and waiting to receive the rfe document. if they suggest that we go to the same civil surgeon is that a mandatory event. i think vin13 went to a different civil surgeon. so i guess we can go to a different civil surgeon. gurus please advice.

I just came back from india. Flew via Frankfrut (Lufthansa). Lufthansa was bad. Frankfrut was dirty, no customer service, service Reps are rude. Next time I will avoid Frankfrut. AND I will not pay a dime for transit visa. period.
American airlines was trying to stop me boarding the plane as the CSR was not aware that if someone has AP they would not need transit visa in Frankfrut. I had to fight and make them call Frankfrut to confirm.
Might not be pertinent but American Airlines food was horrible and tasteless. They were running out of food.
