Disclaimer - This is only based on my knowledge gathered from different forums so take it as its worth.
Depending on the timing of your return, you will get 2 or 3 years of RNOR (Returning non ordinary resident or something?). The RNOR status makes your overseas income non-taxable in India. So you can withdraw your 401K in those 3 years and pay less or no tax in US and no tax in India (on 401K withdraw). You will still have to pay a 10% penalty. This will ofcourse only work if you have low balance in 401K.
So for example, if you have a $30K in your 401K, you can withdraw $10K every year for 3 years, pay a $1K in penalty and avoid US taxes (due to exemption limits) as well as Indian taxes (due to RNOR status). But if you have a large 401K balance like 100K or something, there is no way to avoid taxes.

My wife plans for a vacation for 4 months. Should we wait for FP, complete the process and then go or we can do it later. How much time do we have after we get our FP notice.

Friends I think a great injustice is being done to NSC filers , their applications are taking months for ead and ap, while TSC filers are getting ead adn AP as soon as they get receipt, do you think this will improve for NSC in future, at this time looks like august NSC filers will haveto wait till the end of the year for EAD,ap, which is sad.

I got my FP apt on 12/14. There was no lud on my 485. I had opened SR for fp in october, but didnt help. Then I used the POJ method to get hold of IO at TSC on 12/7 and she created one for me, the notice date on FP says 12/7. Hope this helps.

I got RFE through attorney. It is asking following details
1. Emloyment verification letter with present and intended permanent employer
2. Last two months pay slips
3. "Although your I 140 petitioner indicated in your initial I485 filing that you were employed by company A at that time, your Form G325 indicated that you were employed by company B and you were authorized by B at that time, please explain discrepancy"
I am bit worried about question 3. I worked for company A and labor, I140 applied when I was with A.
But during I485 filing I was with company B and in G325 I mentioned that.
It looks like company A by mistake mentioned that I was still with them.
I called my attorney he said its upto me decide which company I should work for.
But I am not sure company A provides an employment letter for me because I am working for comapny B now.
If B provides employment letter since it is >180 days since I 485 applied, will there be any issues?
Please give your opinions...

Just to add, this is the risk of not working for the company after getting the EAD. The employer can easily prove that the person had no intention of working for the company. AC21 cannot protect that person.

What if you have to leave the job before 180 days, about after 150 days? When I say you have to that means there is no alternative. Employer-Employee issues. Quite a few folks here might be aware of it. But anyway, I read that USCIS will consider 180 days based on the I-485 'Received Date' and I-140 'Revoked date' will be the date USCIS act on the letter they receive from Employer requesting to revoke I-140 not the date employer will send letter to USCIS. I'm aware that there is no specific guidelines of which date USCIS will consider as 'Revoked date', but I heard USCIS mentioned verbally in many conference that they consider I-140 'Revoked date' as when USCIS act on the letter they receive from employer. Any thoughts?
