C'mon dude, i wouldn't use the word "get lost" for someone who has kept cool and putting up thoughts without using extreme/harsg words. even if you suspect the person could be from anti-immigrant group, I don't think it's appropriate to sentence someone based on suspicion.

Friends: Don't predict the bulletin. I have seen how the thread pops up every time before the bulletin is out-- and I am sure that the DOS folks read our predictions here; get mad at us; and the bulletin never progresses. EB2 India will continue to be unavailable...

Why don't you contact some senator! You have been current for so long ..
because USCIS is not even willing to talk if the Service center does not have processing dates current. And if my case is in California (which website says), then the processing dates are not current and have never been current and probably will not be current for a very long time. CSC does not process 485 applications at all.

need help .
I140 denied from NSC .got REF on 03/08 . Was for A2p.fellows got same RFE and got approved from same employer but mine got denied .Didnt get official notice yet .What are my options .please advise.
Im on 4 ye H1b .and have option to change employer and also have option to keep the same employer and work for another employer at the same time .
please advise !!!
Keep your options open regarding changing employers and file for an appeal if you can. Notice should tell you the reason for denial. What is your employer/attorney saying?

I now applied for EAD for my wife (not because she is going to work, just go get SSN). I do plan to get SSN for her and then file amended 2008 return. I wonder if I will get stimulas package then (the one which was given in 2008)?
I amended my tax for 2007 (filed in early 2008), intially filed with my spouse's ITIN, to change my spouse's ITIN with new SSN. IRS did not send any check. They simply replied that people without ITIN are not eligbile, which I knew, and which was the reason of my amended tax filing. Looks like simply changing ITIN to SSN is not treated as a tax amendment.
If changed situation (new SSN, children etc.) allow the check, this year's tax should take care of it as per instructions on IRS website.

I spoke to 2 attorneys...we just cant trust them..it will be finally we who will get screwed big time..
1 said, we can get an RFE asking for the latest i94.
2nd said...in the worst case senario..we will get the H1 issued without the i94..which means that we have to back to home country for H1 stamping..that will be a nightmare in Madras in my case..!!

I am still waiting for everything. The only thing I have so far is Card Production email I received. I have not received approval mails or the cards. What is interesting is that 2 days before I received the CPO email I also received FP notices which is scheduled for first week of Nov. So I am confused whether or not they really approved my I-485.

My wife is currently pregnant and so she could not take all the vaccinations that are required. She did the other required medicals though. Will this cause our applications to be denied? Will they allow my wife to get the shots after our baby is born?
Dont worry - If you are on a family way or your wife is pregnant, no medication necessary, just specify that in the form under the remarks column through the Doctor. You can do the shot afterwards (after delivery).

Relax, LUDS could be internal updates no one can tell you with absolute certainty what they mean. I saw this whole thread you are in panic mode and restless. Just relax man your case will be approved soon.Think of it this that they are working on your case not like others who have filed and heir cases are lying on the shelf.

Very interesting. I thought affidavit from the mother or father along with a letter of non-availibility of birth certificate should be Ok.
Ofcourse the non-availibility is usally given in a piece of paper and not any official letter head. There might / might not even be an official seal in many cases.
Would be interesting to see what others think about your issue.

It is 6 months before status expiry date (I-94). This is not linked with visa stamp expiry date. You are mixing visa status dates with visa dates.
2) Currently your status is H1 , if you use AP then ur status will becom Parolee and if you use EAD then "???"

I think of these solutions...
1) Exit and Enter the country to match with your 797 dates.
or
2) Talk to your employer ,find a temporary employer to switch your h1 and switch back to your current employer. (do premium if necessary ).
Simple solution is to file H1 extension before I-94 date.

Don't want to get into a mudslinging fest here - just wanted to point out that sometimes posts like the original one are useful.
You can do hero worship of your lawyer whoever it is. I will not.
Ask him/her if he will do advocacy effort for you or sue USCIS since all his clients are struggling in the long wait and spending a lot of money on immigration consultations, fees etc.
Ask him if he contribute to IV instead?
Ask him to give you priority instead of your employer who gives him business every year.

My Lawyer does whatever my employer tells him. They never give any receipt notice or approval notice to employees.
They did not even let me file my EAD and AP along with I-485.
I can file EAD/AP myself but I'm worried they might not give me the receipt notice of my I-485 filed in july, in a last ditch effort to prevent me from fleeing(I don't yet have any intention btw) or atleast make it difficult for me.
I'm sure there would be many in this situation.
Any thoughts what can be done?
IF you have used your personal checks the receipt is usually at the back of the checks. Esle just call the help desk and give all your information and if the guy is in good mood he can provide you the receipt number.

I'm sure you might have thought about this when you switched to the Fortune 500 company and knew what you were getting into. If you feel you have a chance at the EB2 by switching back to the previous employer, I think you should do it. Once you get your residency, you will have plenty of opportunities to work for even Fortune 100 companies. For now, just take the plunge and get ready for your dates to become current.
