This discussion is way off topic for this forum.
A nation has responsibility (to the extent possible in case of those not residing within its borders) for protecting its citizens.
Once you give up the citizenship of your country of origin, your allegiance, and therefore the expectation of "protection", should be towards and from the country of your citizenship, not from a "foreign government".

Well said! Being an Indian-Tamilian, it pains to see the whole SL Tamil community caught between the devil (LTTE) and deep sea (SL govt). The SL gov't has used this war cleverly to nurture the hatred between SL Tamil minority and Sinhala majority deep, very deep almost to the point of no return.

August 2003 is a good PD if it were EB2 and you could have stayed with your company. I heard in this forum from someone that, if the person is Masters graduate and worked in related for three years they are exempt from cap even though they applied in EB3 category. If this is true, it is good for you to stay in your current company and not try substitution. If this is not true and if I were you I would have gone for substitution.
What ever you do, do it with good terms with your current employer, so you can come back and join them and be able to use the 2003 PD, if some thing goes wrong with your substitution. If you leave the company and join something else, if you think that you cannot join them back, then it may not worth it. Again, it depends on your personal situation, if you don't have a spouse who is waiting for EAD to work, you should not be risking this.

What use it is to keep looking for an employer, extending your visas - is that not just a glorified version of H1B? True freedom is when you could quit an ass of any employer and come back home with your head held high :)
To qualify for TN status you need to become a Canadian citizen first, and that's what I'm going to do. It'll take about 4 years, maybe a little longer (3 year cumulative presence over the last 4 years + bureaucratic process of switching from PR to citizenship). With my Canadian passport I'll have many more options than with my current one. Working in TN status in the USA is just one of these options. It's mostly appealing to those who can get a better paying job in the USA. If I'm not happy with that job, I can always go back home -- to Canada.
Your concept of "true freedom" is rather limited, if you think about it. :) To me true freedom is when you can choose on any given day what you want to do: work, travel, sleep all day, have fun, etc. It requires much more than having a green card or even a US citizenship.

I have been waiting for 4.5 years, renewed 4 times EAD/AP, spent more than 8K(wife dosen't work and having 2 kids). If there is no sub labor system, I would have got long back.

Although using a pre-approved labor is a legal thing, how much of sagacity does it really have? Within my little 10-12 friend circle I have had atleast FOUR people who got their GC within 8 months through this same company - KFORCE, Rapidigm Inc., utilizing pre-approved labor. The fact is if you go to secondary (grade 6-12) school in a district that have the best schools like Colombo, Kandy and Jaffna (Jaffna used to have some of the best schools, now I am not sure), then you need to score higher than say from someoone from a backward district like Monaragala or Batticalloa that does not have good schools. This does not have anything to do with your ethnicity. It takes in to account that fact that those from areas with best schools with all the facilities have a better chances than those from less developed aras. So a Sinhalese from Colombo or a Tamil or a Muslim from Colombo needs to score slightly higher to get in to college than a Sinhalese from Monaragala or Tamil from Amparai.
Please do not fabricate this kind of propganda. Tamils do have equal rights just as Sinhalese and Muslims in the country. The core of the issue is this blood thirsty and power hungry LTTE terrorists does not want peace. They know that they cannot survive in a peaceful situaltion. That is why thet sabotaged all the previous peace talks.
The LTTE is right now cornered in an area less that 4 square miles. If the SL gov did not care about the safety of the civilians do you really think it is gonna take them this long to finish the LTTE. The reason is that the SL forces are moving very slowly and cautiously to minimize civilian casualties. The sad thing is that the LTTE terrorits are shooting at their own people to create a situaltion and get international attention. Isn't it ironical that the so called saviour of the SL Tamils Probhkaran now has to hide behind the saris of poor innocent tamils women to save his skin??????

I know people who got their GC in 7 months from the date they filed PERM. and then there are many people getting GCs every month. There are both good stories and bad stories to tell about getting GC in US.
There were times when H1 quota never reached the limit during the whole fiscal year, now they get used in just 2 days. This mess in GC process is a result mainly due to our own actions (temporary workers and consulting companies hiring temporary workers). Do you think majority of us once we get GC, stay with the consulting company that filed for our GC? When a consulting company files for PERM, they already have a foreign national working under H-1B in that position. So where is the real intent to hire an American when some foreigner is already working at that position?
This employment based GC is a way for us foreigners to immigrate to US easily at one point. Now due to our extreme usage and abuse of this process, there are genuine people who are being sponsored to immigrate to US are also suffering. In a true employment GC scenario, the company should be desperate to keep you for a long time (more than 6 years after H-1B is maxed) for your valuable skills that they were unable to find in others. But in most GC cases, looks like we temporary workers are more desperate than our employers for the GC? aren't we? Do you see any companies sweating on how to retain you with them, because you H-1B is expiring and they have no way to keep you?
Do not put all the blame on US immigration system, the majority of the blame should fall on us and the companies who are helping us to get GCs when our cases are not based on genuine sponsors.

All the people in the piple line are saved, but atleast it will prevent further misuse of this loophole.
There should be some enquiry or auditing done on the old LC substituion cases and green cards revoked for those whose received theirs illegally and those visa numbers added back (wishful thinking).
Any auditing done on these cases would reveal lots of scams and possibily avert others from being unscrupulous.
Its so unfair that people jumb ahead of the que for upto 5 years using LC substitution.

my friend you really need to dig deeper into stuff...most things are more than meets the eye. courts are very reluctant to strike down laws. the supreme court will strike down a federal law ONLY if it's against the constitution itself...ie there has to be a fundamental problem. this is true both in the US and in India.

The other provision of allowing 485 applications without current PDs is a bad idea in my opinion. Anyone who enters the country will be eligible for AC21 in 8 months which is about 80% of a GC. Such a provision will result in huge abuse like the L visa and/or Labor substitution.
On the flip side, Spouses on dependent visas who had plenty of experience and who were stuck for years by not being able to work. The provision to apply for 485 applications in july was god send opportunity.

All I am saying is, the DOS or USCIS can be unpredictible at times. I know TECHNICALLY there is NO way the July bulletin can retrogress IN JULY. However I would NOT be surprised if that happens. Coz this suddenly creates a FLOOD of Ead applications and AP applications not to mention Finger printing.
Once again, what is with this "Flood" and "too many". Petitions are postal packages. They are not Tsunami waves that would prompt them to shut down their doors to prevent flooding. They did get nearly 200,000 petitions in Vermont in one day. What happened ? Did the mail room clerk drown in fedex ? Were the packages overflowing in the parking lot ?
Guys please stop thinking these logistics, and get a life. USCIS has people who are capable of predicting several hundred mail packages and handling them. They are inefficient and slow but they are not galactically stupid. And if they stop accepting petitions, it wont be because they have received "Too many" because it takes time to define "too many". So chill and try to file it before 31st July.
These rumors are wreaking havoc on people who are not in a perfect position to control the timing of filing. Many lawyers and many employers will file between 25th and 31st July. And I can accept that. My own HR and lawfirm have made it clear that we will file before 31st July but there is no guarantee that it will be sooner than that and any sooner than that is not neccesary.
Those who are filing on their own can file on July 1st. But those who are depending on lawyers and their own HR, please relax and stop thinking too much.

I think your fear is that if you accept the argument that SL Govt is oppressing the Tamil minority, then by default, you would be *forced* to accept the argument that Indian govt is oppressing Kashmiris. It is an apples vs oranges comparison. The situation that is happening in SL is nowhere near anything that had happened in India. I like to see LTTE wiped out completely. BUT the real question is, would that result in equal rights for SL tamil citizens? Let us wait and watch ( without actively intervening) while the people for whom this war is fought perish one by one. Rajapakhse has termed this war as liberating Tamils from the clutches of LTTE. I think your fear is that if you accept the argument that SL Govt is oppressing the Tamil minority, then by default, you would be *forced* to accept the argument that Indian govt is oppressing Kashmiris. It is an apples vs oranges comparison. The situation that is happening in SL is nowhere near anything that had happened in India. I like to see LTTE wiped out completely. BUT the real question is, would that result in equal rights for SL tamil citizens? Let us wait and watch ( without actively intervening) while the people for whom this war is fought perish one by one. Rajapakhse has termed this war as liberating Tamils from the clutches of LTTE. Instead, it seems like, he is liberating people from their earthly life.
To be a fair judge, one should visit both Tamil leaning websites and defense.lk to get both sides of the story. It is suicidal to make a judgment from those flashy videos at defense.lk alone!

I never said that I'm disloyal to India or anything derogatory about India.
My statement "shame to hold Indian passport" is to express my resentment and to protest against the polices of the govt of India towards the Sri Lankan Tamil issue. I believe in freedom of expression and I have every right to protest what I deemed to be injustice.
I saying it again, in this country even burning of the national flag is considered a form of protest.
I'm expressing my feelings, if you or your so called "Tamil friends" are not matured enough to understand freedom expression and genuine protesting, I don't care and i don't owe any explanation to any one. Also I don't care what judgments other make about me.

you are such a contradicting personality. If I take the above oath, at least I will be loyal to the country of my citizenship. somebody washed your brain with too much of what it is not in reality. You have to put your country before your race, color, ethnicity and religion. That is what I learnt as definition for citizenship. I have very good tamil friends and even showed your statement. I am glad that they just hate your personality and you are an atypical Indian tamil.

Hello Sir/Madam,
Recently I have E-Filed for EAD renew and have sent all the supporting documents the following day. But I have recieved an RFE for the photos I haven't sent along with the documents and asked me submit 2 color passport photos. It was my understading that I don't have to send the photos while E-filing since they will be taken at the bio-metric appt. I am done with my bio-metric appt. Do i need to contact USCIS about this or is there any thing you can suggest me.
