Did she receive a paystub for the sick pay? I mean, did the employer or the third party insurance deduct federal, state taxes for the sick pay?
If yes, then she is entitled to receive a corrected W2 from her ex-employer.
BTW, haven�t heard about receiving sick pay from third party insurance, this is something new.
My wife worked as a full time employee and resigned after the delivery from Oct'08. She was paid the sick pay through a third party insurance and these wages are missing in the W-2. I tried contacting her employer and also wrote emails saying I would complain to IRS if they fail to provide a corrected W2. Today is 02/14 and we still didn't receive a new W2 for the sick pay or a corrected W2.
1) What consequences the employer would have to face if they fail to report correct wages on W2?
2) Does IRS is concerned about missing wages that are 1-2K?
3) Do you think I should complain to IRS?
I am planning to lodge an official complaint on Monday 02/16. I suppose it was a deadline date for all employers to provide W2 or a corrected one.

there is a gross misconception that iv is focusing "only" on 485 filing. and repeating is ad libidum is not helping.
the 485 measure is a short term tactical decision.it was taken after it became clear that nothing else could be added to an appropriation bill currently.remember that the attitude of the majority is to have a comprehensive bill ONLY.
certain members took to angrily denouncing the whole idea leading to a great deal of unpleasantness, of course the fault was on both sides as no tolerance for the opposing opinion was shown. it's sad though that some of these people now bad mouth iv on other forums.
as long as we insist on bickering and being divided, we will never succeed
let's just stop now, if that's all everyone wants to do on a daily basis. we can all stew in our own sweet juices for the next 20 years...WAITING.

I did not feel like signing along for two reasons: we are not US citizen yet, and I consider myself citizen of the world and will always be. I do not aspire to become citizen of the United States of America.
Even when Americans sang their national anthem in a church, I felt not right. Churches are not supposed to be linked to states. There should be no country boundary within the Christian world.
There should be no country boundary within the world we want to build either.
By the way, if the United States go to war with your country of birth, who will you side with? Will the United States trust you?

I am using EAD to work for my GC sponsoring company and I got laid off. My HR says that they are going to inform USCIS that I am no longer working for them. HR also says that they won’t cancel my approved I-140 and going to rehire me once I get the new project.
My question:
When I joined them there is information to USCIS.I just filled I-9 form and gave it to the company, no information to USCIS. Now when I got terminated what is the need for the company to inform this to USCIS? Anyhow I am going to join them once I get the new project in couple of months. Is it a new law? Will there be any problem at the POE if travel outside US and come back using AP? Is there any chance that USCIS sends me RFE?

Received the following RFE on H1B Extension.
1. copies of signed contracts between the petitioner and XXX (my name)
2. a complete itinery of services or engagements that specifies the dates of each service or engagement, the names and addresses of the actual employers, and the names and address of the establishment, venues, or locations where the services will be performed for the period of time request; and
3. copies of signed contractual agreements, statements of work, work orders, service agreements, and letter between the petitioner and the authorised officials of the ultimate end-client companies where the work will actually be performed that specifically list XXX (my name) on the contracts and provides a detailed description of the duties the beneficiary will perform, the qualifications that are required to perform the job duties, salary or wage paid, hours worked, benefits, a brief description of who will supervise the beneficiary and their duties, and any other related evidence.
NOTE: The evidence must show speciality occupation work for the beneficiary with the actual end-client company where the work will ultimately be performed. Merely providing contracts between the petitioner, through any other consultaants or staffing agencies, to an ultimate end-client.
My employer is a small consulting company for whom I work on corp-to-corp positions. Now my employer is saying that he cannot reply this RFE and asked me to work on EAD. I would like him to atleast reply the RFE. Any advise in this direction would be highly appreciated. Need to reply by Jan 29.

Having 3 years EAD/AP and ability to refile AOS (in the worst case) is the best workable solution to an economic turndown and lay-off. Having a recapture done will also help many

Can you please help me with this?...I have already submitted the affidavit copy and now they want it from Registrar office. Has any one got it from registrar office in India? if so, how difficult it is and what is the procedure?

If a birth certificate does not list the names of both mother and father, or the child, secondary evidence must be submitted to establish parentage. Secondary evidence includes, but is not limited to , copies of: medical records, school records, census records, government-issues identity cards, religious records and/or affidavits from at least TWO persons alive at the time of birth. The oldest available evidence that lists the names of both parents should be submitted."

Today I called. Automated phone system didn't provided me option 3 and 4 after "keep listening to updates on case" step. It's said invalid option. Second try again I think used 3,3,1 which takes me level 1 CC. Luckily level 1 guy asked few questions(last name, first name, receipt#, dob, A#, etc, etc.) and let me go to Level-2. Level-2 again asked me for same info (last name, first name, A#, etc, etc.) but told me "call after March 10th 2008". So not much success. What a wastage of time. :(

I was just thinking, the wastage of visa numbers we see, is that basically due to the per country quota. The rule that no country can have more than X% of GC's in a year, would mean that even though there are visa's available, they cannot be alloted due to that per country limit.
Anyway the smaller number of application is good news.
